Proiect Summary: The applicant wishes to dredge an upland boat basin with a catwalk, supported by a vinyl bulkhead. Field Investigation Report: Steve and Geri LaBreck Pap-e 2 9. Narrative Description: The property is located in Oriental at 104 Whittaker Point Road, off NC Hwy 55E in Pamlico County. This site is developed with a single family dwelling, a docking facility, and a bulkhead. This parcel is 23,559 square feet. Both of the adjacent properties are similarly developed with single family residences, bulkheads, and docking facilities. The elevation of the high ground of the parcel is about +5.0' above the normal water level. Vegetation on the lot mainly consists of lawn grasses. This lot has approximately 52' of continuous shoreline at the very end of this canal, located at the headwaters of the west branch of Whittaker Creek. Immediate offshore water depths adjacent to the lot range from about —2.5' to —6.0' nwl. The subaqueous substrate is soft without shell. There are no Coastal Wetlands at this location. This feature is a man -made canal system that is contiguous with the west branch of Whittaker Creek. This waterbody is about 75 feet across at this location. These waters are classified as a Primary Nursery Area and there is no submerged aquatic vegetation present in the vicinity of the project area. This area is closed to shellfish harvest and is classified as SA; HWQ, Nutrient Sensitive Waters. There is not a defined channel in this area. This project area is subject to the Neuse River Riparian Buffer Rules. 10. Proposed Development: The applicants wish to construct an upland basin supported by a vinyl bulkhead with a catwalk cap, dredge the canal to connecting water depths, and modify the existing docking facility. The proposed development will take place at 104 Whittaker Point Road in Oriental, Pamlico County. The lot is currently developed with a docking facility and a single - family dwelling. The proposed basin would be entirely excavated from high ground. Due to the size of the applicant's boat, the proposed basin will support this single boat slip. The basin will be 15' wide and 30' long. The existing +5' elevation will be dredged down to -5' nwl depth within the basin footprint. This will result in the removal of approximately 167 cubic yards of material. The upland basin will be stabilized with a 75' long vinyl bulkhead. Some of the upland dredge material will be stored on site and used as backfill for the bulkhead. The applicant will excavate using traditional "clam shell -to- truck" means, and stabilize the upland basin by leaving the existing bulkhead and an earthen plug in place in order to minimize sediments from entering the adjacent canal waters. Once the new bulkhead and basin have stabilized, the applicant will remove the portion of the existing bulkhead and existing dockage that are along the canal frontage. The applicant then proposes to dredge out to the center of the canal's connecting -6' nwl depth. This entrance channel into the upland basin will be 15' wide and 20' long. It will result in the removal of approximately 34 cubic yards of subaqueous material. Any unused dredge spoil material will be transported off site to an upland parcel owned by the contractor, located off of NC HWY 55 in Pamlico County. The applicant proposes to surround the basin with a 3' wide and 75' long wooden, slatted decking cap Brad Connell October 3, 2012 Morehead City Meld Investigation Report: Steve and Geri LaBreck Page 3 over the propesed bulkhead. This 3' wide decking will then extend out into the canal 17' waterward, replacing the existing dock's configuration. This watenvard portion of dockage ~gill be within 15' of the adjacent riparian property lines. 10. Anticipated Impacts: The proposed basin excavation will alter the 75' Estuarine Shoreline AEC and the 50' NCDWQ Neuse River Basin Riparian Buffer at this location. The newly created 75' Estuarine Shoreline AEC and the 50' NCDWQ Neuse River Basin Riparian Buffer will encroach into both of the neighboring canal front properties. This proposal will increase the amount of impervious surface within the 75' AEC, and a portion of the house will be located within the 50' buffer. The proposed basin excavation will remove 450 square feet of high ground, and 300 square feet of shallow bottom. The yard slope will stay the same and therefore, it will not increase the amount of runoff into these Estuarine Waters. The proposed bulkhead backfill, tie backs with dead men anchors, and dredge spoils will fill 1,650 square feet of high ground. The proposed bulkhead cap decking will shade 225 square feet of high ground, and the proposed connecting finger piers will shade 102 square feet of the Public Trust Waters AEC. This proposed shading impact over Estuarine Waters is an approximated 150 square foot decrease in the shading impact from the existing one -slip docking facility, to which it will be replacing. There will not be a change of use at this single family residence. The modified one -slip docking facility encroaches into the adjacent riparian 15' setbacks. Both neighbors have waived their 15' setback rights and been notified of the proposal by Certified Mail — Return Receipt Requested. This proposal is also subject to the NCDWQ Neuse River Basin Riparian Buffer rules. Temporary turbidity impacts are anticipated at the time of construction. The proposed dredging will slope down from the -5'nwl contour at the landward end, to the connecting -6'nwl depth in the center of the canal. This should promote adequate flushing and not degrade water quality standards at this location. This proposal has the potential need for future maintenance excavation. These waters of the west branch of Whittaker Creek are connecting to a designated Primary Nursery Area and there is no submerged aquatic vegetation present in the vicinity of the project area. This area is closed to shellfish harvest and is classified as SA; HWQ, Nutrient Sensitive Waters. There is not a federal channel in this area. Development a involves the filling andlor excavation of more than one acre of wetlands and/or open water areas: $475 60%($285) 40%-($190) Project Narrative 1 '04 Whittaker Point Road Oriental, NC 28571 The project will consist of constructing a single residential boat slip 15' wide by 30' long for our private use by excavating into the high ground at our residence. An estimated 250 — 300 cubic yards of fill will be removed from the site and trucked to the contractor's yard. Any fill left on site to be used as backfill will be stored in our front yard, approximately 100' from the canal. A fabric fence will be used as a precaution to keep fill from re- entering the site. All excavating and bulkheading for the new slip will be completed before it is tied in to the existing bulkhead and to the modified existing dock. This will greatly minimize any impact on the existing canal. We plan to leave an earth dam in place above NWL, across the front of the basin facing Whittaker Creek, where there is an existing bulkhead. This earth dam, together with the existing bulkhead will hold back the water from the creek until the work inside the basin in the high ground is complete. The earth dam will be removed at that time to connect the basin to the creek and allow ingress to and egress from the newly constructed boat basin. The existing bulkhead will be tied to the new bulkhead. The existing dock will be reconfigured to align with the new 3' wide wood bulkhead cap that surrounds 3 sides of the new basin. To accomplish this, the inner portion of the existing dock and pilings will be removed, leaving a 3' wide section of dock on each side projecting into the creek. The removed pilings will be reused to support these 3' wide sections of dock. Nothing new is being added to the dock, we are just removing a substantial area of dock and reusing some pilings. We would like to make clear that the 3' sections of dock that will remain are already there, we are just reusing some pilings to support the inner edge of these 3' sections of dock once the center portion of the dock has been removed. The area in between the newly configured dock will then be maintenance dredged to the same depth of the canal which is 6'.We have a large flat yard where storage of equipment and materials can be kept well back from the canal during the construction process. The project will not have an effect on the riparian corridors of our two neighbors, since we live at the dead end of the canal and riparian corridors are wedge shaped. The new proposed configuration will be beneficial to our neighbors by giving them more room in this cul de sac.
