Good evening. I submitted the PCN form last night via the website and received the following confirmation from the
contractor today, "We will not be digging out of the river. We will be placing rock at the bottom of the banks for the
toe." Therefore, I believe we should be good with regard to Condition 11.9. of GC 4134. Let me know how/where to make
the payment for the permit. Thanks again.

Andrew,
Thanks for the information. I've tried to read through all the literature. It's a bit overwhelming so please
steer me in the right direction if you see me going astray. I agree with you that written authorization is
required for my proposed project. I went to the link below to submit the Pre -Construction Notification
form; however, I wasn't sure if the submittal type should be "401 application," "Riparian Buffer
Authorization," or "Shoreline Stabilization." Can you advise? Also, do you know if I'm located within a NC
DCM Area of Environmental Concern? I assume not but don't know.
I received verbal confirmation from my contractor that we will be placing the rock toe without
excavation but I've requested it in writing as well so we have a trail. GC4134 has a lot included there. If
there are any other thoughts or concerns beyond the turbidity already mentioned, please let me know.

I have attached to this email 401 Water Quality Certification Number 4134 (GC4134),
which corresponds to the US Army Corps of Engineers Nationwide Permit 13. The
second page of the attached document lists a number of thresholds or circumstances
under which you are required to apply for, and receive, written approval from the
Division for your proposed project. If your proposed project will not exceed any of the
thresholds listed, then written approval is not required, provided that all of the
conditions of GC4134 will be met.
The Elk River at 7 Water Sound Drive is classified B; Trout. Therefore, based on the
current design, it appears that your project will exceed threshold h and will require
written approval from the Division.

You may submit the Pre -Construction Notification electronically at the following

As we discussed, in accordance with Condition 11.9. of GC4134, all work in streams must
be conducted in such a way as that the flowing stream does not come in contact with
the disturbed area. If your project will require excavation in flowing water, you will need
to provide a description of how the excavated area will be isolated from the flowing
stream (sandbags, jersey barriers, etc...). If the rock toe will be placed or seated without
excavation, no isolation of the work area will be required.

Amanda,
Good evening. Per your instruction, I've updated the original form and
provided additional detail. Within the description of the overall project
(3e), I added a note to reference that we will be targeting rock sizes of
approximately 2ft x 2ft on average for the rock toe and that the
vegetation planted will be native. I'm not sure what plants we will end
up using but I'll coordinate with Christine to ensure they are native. At
the end of the file, I've also included the map you provided, as well as a
sketch of the scope of work as I understand it. Finally, I've attached a
copy of the GIS image and pics of the erosion to this email.
Please review and let me know if you need anything further. Once I hear
that you have everything required on your end, I will reach out to the
folks at WRC and DWR as appropriate and pass along the permit
application. Appreciate your help.
