On March 22, 1994, the North Carolina Environmental Management Commission Department of Water
Quality issued Permit WQ0009005 for construction and operation of approximately 255 linear feet of 6-
inch gravity sewer and approximately 81 linear feet of 8-inch gravity sewer to convey up to 500 gallons
per day (GPD) of collected domestic wastewater to Into the Metropolitan Sewerage District of Buncombe
County's (MSD) existing sewerage system.
On March 5, 2020, ownership of the portion of those facilities described in the permit as approximately
"81 linear feet of 8-inch gravity sewer" was conveyed to the MSD. This correspondence Is being
submitted in accordance with provision 5 of the permit for transfer of ownership as confirmed via email
correspondence from Christyn Fertenbaugh, PE on Sunday February 28, 2020 at 9:36 PM EST, to request
a modification to the permit to remove the portion of the facilities that were conveyed to MSD.
The remaining facilities described at 255 linear feet of 6-inch gravity sewer which Includes taps for up to
5 business tenants at a total discharge volume of 500 GPD is to retain coverage under permit
W00009005.
Attached to this letter are the completed Form FTA 04-16, a copy of the ownership conveyance from F.
Louie Justus to MSD as registered at the Buncombe County Courthouse, a copy of permit W00009005, a
site map, and the applicable permit modification fee of $480 payable to North Carolina Department of

Statutes of Nonh Carolina, hereinater rekned to as Grantee Ithe designations Grantor and Grantee as used

WITNESSETH:
THAT WHEREAS, the Grantor has developed property known located at 1529 Smoker Park Hwy
Asheville Nonh Carolina as shown on a plat recorded in Plat Book Itf31_ as Page 652 Buncombe
County Registry, and operates a business an said property.
WHEREAS. the Grantor installed sewer lines and sever related improvements (hereinafter Sewer
Lines end Sewer Related Improvements) according to plans and specifications prepared by McGill
ASSOCIATES, PA.. Gary D. Davis. P.E. N.C. License NO. 12296. an engineer licensed in the State of
North Carolina;
WHEREAS, Grantor obtained a permit to construct and install the sewer line and sewer related
improvements from the Metmpoliunt Sewerage District of Buncombe Cowry, Nonh Carolina, to wit, Permit
Number WQ0009005 Issued March 22, 1994; and
WHEREAS, Gary D. Davis. PR McGill ASSOCIATES certified by letter dated October 27.1994
that the sewer lines and sewer related improvements were constructed and installed as designed; and
WHEREAS. the Sewer Lines and Sewer Related Improvements constructed by the Grantor are
shown on as -built drawings prepared by _McGill ASSOCIATES. PA., Gary D. Davis. P.E. N.C. License
NO. 12296 entitled ES IVER LJVE TO.SERVE .JIISTUS' PROPERTY dated 2/IP'94 reference to which
drawings is made for a complete description of the Sewer Lines and Sewer Related Improvements:
WHEREAS, it is the intent of the Grantor to convey to MSD approximately RI linear feet of S.mch
gravity sewer fine encased in steel under US 19-23 and a connected manhole adjacent to the 1520 Smokey
Park Highway property- (hereinafter the "Sewer Lines and Sewer Related Improvements to he Conveyed").
This line Is connected to an existing MSD manhole on the South side of ❑S 19-23.
WHEREAS, (irantor obtained an encroachment permit from the North Carolina Department of
Transportation TO install and construct the sewer line within the right of way of US Highway 19-23.

WHEREAS, the Grantor retains the Sewer Lines and Sewer Related Improvements shown on the
same as buih drawings to continue business operations on the 1520 Smokey Park Hwy.: and defined In the
F. Louie Justus WASTEWATER COLLECTION PERMIT as approximately 255 linear feet of 6 inch
gravity sewer (with 5 collection taps) to serve the Justus Property, and die discharge of 500 GPD of collected
domestic wastewater into the Metropolitan Sewerage District of Buncombe County's existing sewerage
system.
WHEREAS, the Grantee now desires to procure from the Grantor and the Grantee is willing m
accept the Sewer Lines and Sewer Related Improvements to be Conveyed, including any and all liabilities
associattxl with the Sewer lines and Sewer Related Improvements to be conveyed occurring prior to, during.
and following the transfer of said property, becoming elTective upon the time of transfer of the Sewer Lines
and Sewer Related hnpmvemcnts to the Grantee. To the extent permitted by law, the Grantee, its successors,
assigns. and any representatives agree to indemnify the Grantor from and against any and all liabilities related
to the Sewer Lines and Sewer Related Improvements to be Conveyed. To the extent pemiined by law. this
indemnification shall extend beyond the Grantor and include its successors and assigns_
NOW, THEREFORE., the Grantee, for and in consideration of the sum of EIGHTEEN
THOUSAND DOLLARS (S18,000.00), and other good and valuable consideration, the receipt and adequacy
of which is hereby acknmvledged, has given, granted and conveyed, and by these presents does give, grant
and convey tram the Grantee, its successors and assigns. the Sewer lines and Sewer Related Improvements.
said Sewer Lines and Setter Related Improvements consisting of approximately 81 linear feet of 8 inch
gravity sewer line encased in steel under CS Highway 19.23, being a portion of the Sewer Lines and Sewer
Related Improvements shown on the as -built drawings prepared by Gary Davis dated 2(10/94, together with
the full right of reasonable access to the Sewer Lines and Sewer Related Improvements in order to pmperly
operate and maintain the Sewer Lines and Sewer Related Improvements and to repair and replace the Sewer
Lines and Sewer Related Improvements as necessary.
IT IS UNDERSTOOD DY AND BETWEEN THE GRANTOR AND THE GRANTEE:
L That the Grantee shall have the right. but not the obligation, to keep the properly clear at all
times, and the right. but not the obligation, to go upon the property for the purpose of clearing the same and
removing therefrom all brush, tees and otter obstructions of any kind.
2. That the Grantor shall at all times, other than while the Sewer Lines and Sewer Related
Improvements are under actual construction, have the right to use said property in the same manner as has
been heretofore done; provided .such use shall in no manner interfere with or be inconsistent with the use
thereof by Grantor as provided herein.
3. Thal the Grantee agrees to restore the topography of the property alter any accessary repair
or replacement of the Sewer Lines and Sewer Related Improvements to the same condition as existed
prior to the repair or replacement.
4. That the Grantor shall have the rights to pass oter and upon said property with appropriate
roadways for the full use of its property, provided, however. that the construction, maintenance and use of
said roadways shall in no way interfere with the Sewer Lines and Sewer Related Improvements. As to
paved roads, the Grantee, in future repairs or maintenance of said Sewer Lines and Sewer Related
Improvements, shall only be responsible for regraveling, tamping and patching the portion of said paved
roads disturbed in connection with any repairs or inaintenance. As to non -paved roads, the Grantee shall
only be responsible for regmveling and tamping in connection with any repairs or maintenance.

S. The Grantee will at no cost to the Grantor; Transfer Permit to the ownership of the MSD.
transfer the DOT Encroachment Agreement —US 19-21 to the MSD and have the WASIE WATER
COLLECTION PERMIT for F. Louie Justus revised to reflect the Transfer of Ownership of the Sewer
Lines And Sewer Related Improvements.
Application for these changes to be submitted within ten weeks of signing the agreement with hard copies to
be delivered to the Grantor. Ilard copies of the approved Permits and Encroachment to be delivered to the
Grantor within two weeks of completion.
6. Any fights of Grantor and Grantee herein shall be subject to the North Carolina Department of
Transportation's rights in and ownership of US Ilighway 19.23.
TO HAVE AND TO HOLD said Sewer Line and Sewer Related Improvements unto said Grantee,
Its successors and assigns, forever upon the tens set forth herein.
The Grantor covenants to and with the Grantee. its successors and assigns that the Grantor is the
owner of the Sewer Lines and Sewer Related Improvements. and that said Sewer Lines and Sewer Related
Improvements therefor are free from any and all liens.

WASTEWATER COLLECTION PERMIT
In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as
amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

Buncombe County
FOR THE
construction and operation of approximately 255 linear feet of 6 inch gravity sewer and approximately 81
linear feet of 8 inch gravity sewer to serve the Justus Property, and the discharge of 500 GPD of collected
domestic wastewater into the Metropolitan Sewerage District of Buncombe County's existing sewerage
system, pursuant to the application received February 14, 1994, and in conformity with the project plan,
specifications, and other supporting data subsequently filed and approved by the Department of
Environment, Health and Natural Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until rescinded and shall be subject to the
following specified conditions and [imitations:
1. This permit shall become voidable unless the facilities are constructed in accordance with the
conditions of this permit, the approved plans and specifications, and other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes described in the
application and other supporting data.
3. The facilities must be properly maintained and operated at all times.
4. The sewage and wastewater collected by this system shall be treated in the Metropolitan Sewerage
District of Buncombe County Wastewater Treatment Facility prior to being discharged into the
receiving stream.
5. This permit is not transferable. In the event there is a desire for the facilities to change ownership,
or there is a name change of the Permittee, a formal permit request must be submitted to the
Division of Environmental Management accompanied by an application fee, documentation from
the parties involved, and other supporting materials as may be appropriate. The approval of this
request will be considered on its merits and may or may not be approved.
6. Construction of the sewers, pump station(s) and force main shall be scheduled so as not to
interrupt service by the existing utilities nor result in an overflow or bypass discharge of
wastewater to the surface waters of the State.

Upon completion of construction and prior to operation of this permitted facility, a certification
must be received from a professional engineer certifying that the permitted facility has been
installed in accordance with this permit, the approved plans and specifications, and other
supporting materials. Mail the Certification to the Water Quality Permits and Engineering Unit,
P.O. Box 29535, Raleigh, NC 27626-0535.
8. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a
minimum of five years from the date of the completion of construction.
Failure to abide by the conditions and limitations contained in this permit may subject the Permittee
to an enforcement action by the Division of Environmental Management, in accordance with North
Carolina General Statute 143-215.6(a) to 143-215.6(c).
10. The issuance of this permit does not preclude the Permittee from complying with any and all
statutes, rules, regulations, or ordinances which may be imposed by other government agencies
(local, state, and federal) which have jurisdiction.
11. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, the Permittee shall take immediate corrective action, including those as may be required
by this Division, such as the construction of additional or replacement wastewater collection
facilities.
12. Noncompliance Notification:
The Permittee shall report by telephone to the Asheville Regional Office, telephone number
704/251-6208, as soon as possible, but in no case more than 24 hours or on the next working day,
following the occurrence or first knowledge of the occurrence of either of the following:
a. Any process unit failure, due to known or unknown reasons, that renders the facility incapable
of adequate wastewater transport, such as mechanical or electrical failures of pumps, line
blockage or breakage, etc.; or
b. Any failure of a pumping station or sewer line resulting in a by-pass directly to receiving
waters without treatment of all or any portion of the influent to such station or facility.
Persons reporting such occurrences by telephone shall also file a written report in letter form within
15 days following first knowledge of the occurrence. This report must outline the actions taken or
proposed to be taken to ensure that the problem does not recur.
13. This permit shall become voidable unless the agreement between F. Louie Justus and the
Metropolitan Sewerage District of Buncombe County for the collection and final treatment of
wastewater is in full force and effect.
