The Division of Water Quality issued a Coastal Stormwater Management Permit, Number
SVV8961235 to Glad Tidings Pentecostal Holiness, for a High Density stormwater pond to
serve Glad Tidings Pentecostal on 5/22/1997. This permit expired on 5/22/2007. Section
,10O3(h) of 15 A NCAC 2H .1000 (the stormwater rules) requires that applications for permit
renewals shall be submitted 180 days prior to the expiration of a permit and must be
accompanied by a processing fee, which is currently set at $420.00. If this is still an active
project please complete and submit the enclosed renewal application in a timely manner. If this
project has not been constructed and a permit is no longer needed, please submit a request to
have the permit rescinded. If you have sold the project, or are no longer the permittee, please
provide the name, mailing address and phone number of the person or entity that is now
responsible for this permit. Enclosed is a form for change of ownership, which should be
completed and submitted if the property has changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted
treatment units a certification of completion be submitted to the Division from an appropriate designer
for the system installed. This'is to certify that the permitted facility has been installed in accordance with
the permit, the approved plans, specifications and supporting documentation. Please include a copy of
the certification with your permit renewal request and processing fee. Enclosed is a copy of a sample
certification. Also enclosed is a new Operation and Maintenance agreement that should be completed
and submitted along with your renewal application.
You should be aware that failure to provide the Designer's Certification and the operation of a
stormwater treatment facility without a valid permit, are violations of NC General Statute 143-215.1 and
may result in appropriate enforcement action including the assessment of civil penalties of up to
$10,000 per day.

On May 22, 2007, Wilmington Regional Office personnel performed a Compliance Inspection
of the subject project, located at 4621 Country Club Dr. in Morehead City, Carteret County,
North Carolina. The inspection was performed to determine the status of compliance with
Stormwater Permit Number SW8 961235, issued to you on May 22, 1997.
The project has been found in violation of Stormwater Permit Number SW8 961235, issued
pursuant to the requirements of 15A NCAC 21-1.1000. The violations found are:
Failure to perform the required operation and maintenance necessary to assure
the permitted stormwater system functions at optimum efficiency. Based on an
inspection performed on June 15, 2007 it appears that the operation and
maintenance agreement is not being followed in its entirety. The inspection
revealed issues such as sediment in the fore bay and storage pond, lack of
mowing, erosion on the pored slopes and excessive vegetation on the aquatic
shelf.
2. Failure to submit a certification from an appropriate designer for the system
installed. Upon completion of construction, prior to issuance of a Certificate of
Occupancy, and prior to operation of this permitted facility, a certification must be
received from an appropriate designer for the system installed in accordance with
this permit, the approved plans and specifications and other supporting
documentation. Any deviations from the approved plans and specifications must
be noted on the Certification.
3. Failure to submit and receive approval for revised plans, specifications and
calculations for any modification to the approved plans. It appears that the berm
located on the south side of the wet detention pond and the emergency spillway
for the pond has been modified.

on or before August 6, 2007,

management system. The Designers Certification must be from an
appropriate designer.

the date designated in the "Plan of Action", are considered violations of 15A NCAC
2H.1000, and may result in the initiation of enforcement action which may include
recommendations for the assessment of civil penalties, pursuant to NCGS 143-215.6A.
By copy of this letter to the Carteret County Building Inspector, this Office is requesting
that the Building Inspector consider withholding building permits and Certificates of
Occupancy for this project until this matter is satisfactorily resolved.

amount of built -upon area.
3. All the built -upon area associated with the project is graded such that the
runoff drains to the system.
4. The outlet/bypass structure elevations are per the approved plan.
5. The outlet structure is located per the approved plans.
6. Trash rack is provided on the outlet/bypass structure.
7. All slopes are grassed with permanent vegetation.

9. The inlets are located per the approved plans and do not cause short-
circuiting of the system.

Inspection Summary:
The following items of concern were noted during the inspection and need your immediate attention:
1.The drainage area is no longer consistent with the approved plans. A berm on one side of the pond has been leveled
and a portion of the pond has fill material in it.
2. The vegetated filter appears to hav been modified somewhat. A drain pipe discharges to an area that has been
enlarged next to the filter.
3. No emergency spillway was noted, nor could the outlet spreader be observed.
4. The riprap flow dispersal structure was replaced by a curbed inlet directly to the forebay
5. You could not tell the forebay from the permanent pool area.
6. There was a lot of trash that needed to be cleaned out. Fill material was placed in close proximity
to the outlet structure, and the outlet structure was covered with debris.
7. There are no O & M records for the BMP
8. The permit expired on May 22, 2007. To date, no renewal request has been received.
9. Mr. Gould, the Facilities Director said that some of the changes were made after consulting with a Corp agent. He was
wanting to tile the drain ditch where the vegetative filter is, the agent indicated that he could clear the bank by cutting
them, but not remove any of the roots and that he could eventually fill in the pond. No written correspondence was
available.

Dear Messrs.. Wellons and Barts:
On February 13, 1997, personnel ofthis office inspected a project located NCSR 1 117 in
County, North Carolina. This inspection was performed to determine compliance with the North
Carolina Sedimentation Pollution Control Act of 1973. The inspection revealed a land -disturbing
activity of approximately 6 acres being conducted.
It is our understanding that you and your firm are responsible for this land -disturbing activity.
The purpose of this letter is to inform you that this activity was found to be in violation of the Act,
NCGS 113A-50 to 66, and Title 15A, North Carolina Administrative Code, Chapter 4. If you feel that
you are not responsible for the following violations, please notify this office immediately.
The violations that were found are:
1. Failure to conduct a land -disturbing activity in accordance with the provisions of an approved
erosion and sedimentation control plan. NCGS 113A-61.1
The erosion control measures called for on the approved plan have not been installed, the
stormwater basin, the swale and sediment trap, and a majority of the proposed silt fence. The
parking lot layout has been revised.
The erosion and sedimentation control plan approved by this office on May 15, 1996 must be
immediately implemented on the site sufficient to restrain off -site sedimentation, or an
immediate plan revision must be provided that reflect changes including revised erosion control
measures.
2. Failure to file an acceptable, revised plan after being notified of the need to do so. NCGS 113A-

In our June 28, 1996 inspection report, you were notified of the need to submit a revised plan
if plan revisions were made.
3. Failure to take all reasonable measures to protect all public and private property from damage
by such land -disturbing activities. 15A NCAC 4B.0005.
The erosion control measures proposed but not installed are necessary to prevent eventual
erosion of the site and resultant off -site sediment.
To correct these violations, you must:
Either provide the required sedimentation and erosion control measures required on your
approved plan or submit a revised plan suggesting amended measures that will be immediately
installed.
2. Provide a plan that accurately reflects all new site improvements.
Please be advised that if these violations are not corrected within 20 days of receipt of this
notice, the Director, Division of Land Resources, will be requested to take appropriate legal action
against you pursuant to NCGS 1 13A-64. That action could be the assessment of a civil penalty and
the amount may be up to $500 per day for each day of the violation. The penalty may be assessed
from the date of your receipt of this Notice of Violation. (15A NCAC 4C.0007). If these violations
are corrected within the time period specified for compliance, no further legal action will be pursued.
Please be advised that any new land -disturbing activity associated with this project must not
begin until the area presently disturbed is brought into compliance with the Act. When corrective
actions are complete, you should notify this office so the work can be inspected. You should not
assume that the property is in compliance with the Act until we have notified you. After installation,

On February 19, 1997, Wilmington Regional Office personnel performed a Compliance Inspection
at the project known as Glad Tidings Pentecostal Holiness Church, located at 4621 Country Club Road,
Morehead City in Carteret County, North Carolina. The inspection was performed in response to the
violations of the sedimentation erosions control plan issued to the church on February 13, 1997.
The project has been found in violation of 15A NCAC 2H.1000. The violations found are:
1. Failure to receive a permit prior to construction. The project applied for a stormwater
management permit on December 27, 1996. Additional information was requested on January
16, 1997. The requested information was received on February 19, 1997, but it has not been
reviewed and a permit has not been issued.
2. Failure to construct stormwater control measures prior to the construction of an impervious
surface. A gravel parking lot and concrete building pad with a steel structure and roof are
under construction. Runoff from these surfaces is currently untreated.

The following items of concern were noted during the inspection and need your immediate attention:
1. The drainage area is no longer consistent with the approved plans. A berm on one side of the pond has been leveled and a
portion of the pond
has fill material in it.
2. The vegetated filter appears to have been modified somewhat. A drain pipe discharges to an area that has been enlarged next
to the filter.
3. No emergency spillway was noted, nor could the outlet spreader be observed.
4. The riprap flow dispersal structure was replaced by a curbed inlet directly to the forebay
S. You could not tell the forebay from the permanent pool area due to heavy weed growth and sediment.
6. There was a lot of trash that needed to be cleared out. Fill material was placed in close proximity to the outlet structure inside
the Pond, and the outlet structure
was covered with excessive debris.
7. There are no O & M records
S. The permit expired on May 22, 2007. To date, no renewal request has been received.
9. Mr. Gould, the Facilities Director said that some of the changes were made after consulting with a Corp agent. He was wanting
to tile the ditch and vegetative
filter area. The agent indicated that he could clear the bank by cutting the trees, but not remove any of the roots. He also
advised that the pond could eventually
be filled in. No written correspondence was available.
