I have objections to the replacement of the pipe. While the pipe was existing at some point prior to this request (likely
in violation), it is not currently in place. The pipe represents a violation of the diffuse flow portion of the buffer rules
and is prohibited under G.S. 143 -215.1 as "no person shall make any outlets to waters of the State ". It would also be a
violation of the wetland standards 15A NCAC 213 .0231, as it would be altering the natural hydrological conditions of the
wetland which it is intended to drain.
I can approve the bulkhead and have no objection to the project without the pipe.
I will be sending a hold letter to the applicant stating my objections.
