The stream is labeled as "A" on the attached map initialed by Ms. Merritt on September 19, 2012. Staff from the Town of Carrboro conducted an on -site perennial determination of the subject stream on May 25, 2012. In your letter to the Director dated July 2, 2012, you requested an appeal of their determination as provided within 15A NCAC 02B .0267(4) (d). At your request, we conducted an appeal of their perennial stream determination as stated above. During our review we evaluated four reaches within the stream using four DWQ Stream Classification Forms identified as "Form A ", "Form B ", "Form C" and "Form D ". The reaches evaluated along with their corresponding forms and calculated scores are described as follows: • Form A, 20 points — upstream of the confluence where the Town of Carrboro made their perennial stream determination • Form B, 23.5 points — downstream and directly below the confluence where the Town of Carrboro made their perennial stream determination • Form C, 25 points — further downstream of the confluence • Form D, 30 points - Below perennial flag A (flagged onsite) The form states that if the score is "greater than or equal to 19 points the stream is at least intermittent. Additionally, if the score is "greater than or equal to 30 points the stream is perennial ". This determination shall replace the determination originally performed by the Town of Carrboro and shall expire five years from the date of this letter. To contest the Director's decision you must file a petition for an administrative hearing. You may obtain the petition form from the office of Administrative hearings. You must file the petition with the office of Administrative Hearings within sixty (60) days of receipt of this notice. A petition is considered fled when it is received in the office of Administrative Hearings during normal office hours. This letter only addresses the applicability to the buffer rules and does not approve any activity within the buffers. Nor does this letter approve any activity within Waters of the United States or Waters of the State.
