This letter is provided to serve as the "Agent Authorization Letter" to provide the NCWRC signature
authority for the owner /applicant, that being Duke Energy Carolinas, LLC, for upgrade work proposed at
Bear Creek Access Area. The work includes the replacement of the two concrete boat ramps and
repositioning of the existing courtesy dock as needed to align with the new boat ramps. This construction
work is proposed to occur later this year during the seasonal lake drawdown that may or may not occur.
The improvements will improve boat launching capabilities for the general public. It is understood this
work will take place after all the permits are acquired.
This authority is granted to assist the NCWRC in acquisition of necessary permits to satisfy Section 404
and /or Section 10 Nationwide, Regional and General Permits, Section 401 general Water Quality
Certifications, and Riparian Buffer and Watershed Buffer Rules.

The North Carolina Wildlife Resources Commission, Engineering Services requested a permit to rebuild
the boat launch and dock at Bear Lake in Jackson County. Comments from the Commission on this
proposal are offered for your consideration under provisions of the Clean Water Act of 1977 (33 U.S.C.
466 et seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661- 667d).
This work will not harm trout and does -not need to be avoided during the spawning moratorium. Impacts
of the project on aquatic habitats should be minor provided the project is completed as described in the
application. We do not recommend adding any special conditions to the permit.

Subject: Bear Creek Lake Boating Access Area launch ramps and dock replacement, Jackson
County, North Carolina. East Fork Hydroelectric Project (FERC Project No. P- 2698).
This is the report of the U.S. Fish and Wildlife Service on the designs for Bear Creek Lake
Boating Access Area launch ramps and dock replacement at the Duke Energy Corporation (Duke
Energy), Bear Creek Lake in Jackson County, North Carolina. This report is submitted in
accordance with the provisions of the National Environmental Policy Act; the Fish and Wildlife
Coordination Act, as amended (16 U.S.C. 661- 667e); and section 7 of the Endangered Species
Act of 1973, as amended (16 U.S.C. 1531 -1543) (Act).
Fish and Wildlife Recommendations. We have reviewed the information provided and are
familiar with the site. We have no objections to the project as proposed. With respect to natural
resources, the proposed project will probably have no more than temporary effects on fish and
wildlife and their habitats. In order to minimize the effects of the proposed project on fish and
wildlife resources, we recommend the following measures:
1. Shoreline vegetation should be left unaltered as much as possible. Riparian
buffers should be maintained.
2. Stringent erosion - control measures should be installed where soil is disturbed
and should be maintained until project completion. Excavated material should
not be stockpiled where sediment will erode to surface waters.
3. Wet concrete is toxic to aquatic organisms. During any construction, wet
concrete should not be allowed to come in contact with surface waters. The
boat ramp should be constructed using a "pour and push" method, where the
ramp is formed and poured on shore, then pushed into its final place after the
concrete has sufficiently cured. The reservoir will be drawn down to install
the proposed boat ramp.
Endangered Species. According to our records and a review of the information you provided,
no federally listed species or their habitats occur on the subject site. Therefore, we believe the
requirements under section 7 of the Endangered Species Act are fulfilled. However, obligations
under section 7 of the Endangered Species Act must be reconsidered if (1) new information
reveals impacts of this identified action that may affect listed species or critical habitat in a
manner not previously considered, (2) this action is subsequently modified in a manner that was
not considered in this review, or (3) a new species is listed or critical habitat is determined that
may be affected by the identified action.
We look forward to working with you and Duke Energy to ensure that our recommendations are
implemented and that impacts to fish and wildlife resources are minimized. If you have specific
