In response to your Notices of Deficiency (NOD-2021-PC-0104 and NOD-2021-PC-
0105) of March 16, 2021 for JLM Indian Woods Farms, LLC (8-34) and JLM Republican
Farms, LLC (8-2) I submit the following:
Deficiency 1: Failure to maintain required lagoon freeboard.
We have had a tremendous amount of rainfall in the last 14 months and we have been
very careful in land application so as to not allow ponding nor runoff. Because of the
copious rainfall and wet conditions, one lagoon on each of these farms recently
encroached the red -zone. We provided the required 30-day POA to Mrs. Salyer and
have since gotten these lagoons back in compliance and hope to keep them in
compliance.
1 regret that high freeboard has occurred and we are managing
damage to our environment.
