4. Project Description and History
4a. Describe the existing conditions on the site and the general land use in the vicinityof the project at the time of this application:*
The proposed Project is situated on 10 parcels totaling approAmately 219 acres of land (Site) located southwest of the intersection of Holly Springs New Hill Road and Green Oaks
Parkway in Holly Springs, North Carolina, within Wake County. The Site is primarily comprised of pine forest and logged pine plantation.
The proposed development will consist of a Green Oaks Tech Building, associated amenities, roadway, stormwater control measures, and utility improvements (i.e. public water supply
and sanitary sewer alignment).
A delineation of the Site was completed by Timmons Group on February 15, 2021, February 17, 2020, May 6, 2019, and in 2016, and a site visit was conducted with James Lastinger of
the USACE on July 12, 2019 and July 27, 2020 confirming the boundaries utilized for avoidance and minimization during project planning. Impacts associated with the proposed project
are limited to those necessary for the development of the road crossings to connect the Site and for the sanitary sewer easement.

4h. Explain the purpose of the proposed project:*
The primary purpose of the project is to construct a research technology innovation park with the necessary amenities within the southwestern section of Wake County.
4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:*
Oakview Innovation Park is a two -phased project which will be for the development of a research technology park and associated amenities. Phase 1 will include the development of
public roads for the proposed facilities with connections to eAsting roads west and south of the intersection of New Hill Holly Springs Road and Green Oaks Parkway. Additionally, a
sanitary sewer main providing connection services will be installed and tied to the eAsting pump station south of the proposed development. The Wake County Parcels associated with
both Phases are: 0639842054, 0639941045, 0639943514, 0639937984, and 0639837664. However, Phase 1 will also require off -site utility line connection impacts on 0639837172,
0639837443, 0639721436, and 0639914852. Phase 2 of the proposed site development will involve construction of buildings, parking spaces and drive aisles, utilities and the other
associated infrastructure required for these parcels.
Additionally, portions of the proposed utility line to be developed with Phase 1 require a width of 50-ft in order to accommodate a future greenway to be designed and constructed at a
later date located on parcels: 0639837172, 0639837443, 0639721436, and 0639914852. It is not yet known what entity will be responsible for the proposed greenway design and
installation, and may fall to outside developments beyond the scope of this project.
All work will be conducted in accordance with local, state, and federal regulations. Traditional equipment will be used consisting of front-end loaders, bulldozers, paving equipment,
graders, and earth movers. SCMs are required and will be used.

Timmons Group submitted a combined Preliminary and Approved Jurisdictional Determination Request for the project Site. James Lastinger of the USACE conducted a site inspection
on July 12, 2019 and on July 27, 2020 reviewing and confirming the delineated boundaries utilized for site planning. The AJD portion of the reviewwas limited to four ephemeral stream
features within the Site which were confirmed to be non -jurisdictional. All other areas were included as part of the PJD review. Please see attached confirmed delineation map and the
jurisdictional determination received from James Lastinger on August 4, 2020.

This project is anticipated to be completed in appropmately 2-phases. The first phase, associated with this permit, will involve the required roads and utility lines (to become public
road/utility). Phase 2 of the proposed site development will involve construction of buildings, parking spaces and drive aisles, utilities and the other associated infrastructure required. A
later phase for installation of a future greenway within the proposed utility route is anticipated to be required, but it is anticipated Folly Springs will require it's installation as part of the
development plan stage for each individual parcel. Any future permitting will be addressed as needed.

Impacts 1, 3, 4, and 5 are associated with proposed road crossings. These crossings are necessary to provide required access to the site, including
required emergency access. The crossings locations were limited based on NCDOT requirements for where site entrances could be located on New
Hill Holly Springs Road and Green Oaks Road.
Multiple layouts were reviewed taking into account the road siting and building footprint requirements, with these impact locations/road orientations
chosen as the least impactful locations.
Impact 1 consists of 1,336-sq. ft. of temporary wetland impacts in order to install a road crossing, necessary to connect the proposed development to
Holly Springs New Hill Road. The road crossing includes the necessary grading per DOT standards for a safe and stable road.
Impact 2 consists of 494-sq. ft. of permanent wetland impacts in order for the installation of a parking lot at the required size for the future building at
this location.
Impact 3 consists of 687-sq. ft. of permanent wetland impacts in order to install a road crossing, necessary to connect the eastern and western
portions of the Green Oaks Tech Park. The road crossing will include the installation of a 48" Reinforced Concrete Pipe (RCP) culvert with NCDOT
required headwalls to either side, and the necessary grading of the surrounding area. The RCP will be countersunk underneath the road crossing to
maintain the hydrologic connection between the up gradient and down gradient portion of the wetland. The proposed wetland impacts are limited to
the required riprap dissipator pad at the outlet of the proposed culvert. The location and size of the dissipator pad were determined based on slope
and stream flow requirements.
Impact 4 consists of 466-sq. ft. of permanent wetland impacts in order to install a road crossing, necessary to connect the eastern and western
portions of the Green Oaks Tech Park. The road crossing will include the installation of a 48" Reinforced Concrete Pipe (RCP) culvert with NCDOT
required headwalls to either side, and the necessary grading of the surrounding area. The RCP will be countersunk underneath the road crossing to
maintain the hydrologic connection between the up gradient and down gradient portion of the wetland. A riprap dissipator pad will also be installed as
required based on slope and flow requirements.
Impact 5 consists of 16,435-sq. ft. of permanent wetland impact in order to install a road crossing, necessary to connect the proposed development to
Green Oaks Parkway. The road crossing will include the installation of a 54" Reinforced Concrete Pipe (RCP) culvert with NCDOT required headwalls
to either side, and the necessary grading of the surrounding area. The RCP will be countersunk underneath the road crossing to maintain the
hydrologic connection between the up gradient and doom gradient portion of the wetland. A riprap dissipator pad will also be installed as required
based on slope and flow requirements.
Impacts 6, 9, and 10 consist of temporary wetland impacts for the installation of a sewer line to connect the proposed development to public utilities.
The sewer line was sited based on requirements of gravity sewer flow. The temporary impacts will result in conversion of the wetland areas to
maintained herbaceous wetlands. Impacted areas will be stabilized and re -seeded immediately following installation.
Portions of the proposed sewer line are proposed to have a 50-ft width as required by the Town of Holly Springs. It is anticipated that the Town of Holly
Springs will require a future greenway installed along the proposed sewer line. If required, this greenway will be permitted by the future responsible
party.

stream.
Impacts S2, S4, and S6 consist of permanent no loss impacts associated with required riprap dissipator pads at the outlet of the proposed culverts for
impacts 3, 4, and 5. The location and size of the dissipator pads were determined based on slope and flow requirements.
Impacts S7, S8, S9, S10, and S11 (Impacts 6, 7, 8, 10A, and 10B) consist of temporary stream impacts for the installation of a sewer line to connect
the proposed development to public utilities. The sewer line was sited based on requirements of gravity sewer flow. Downstream flow will be maintained
during installation and all impacted areas will be returned to previous conditions immediately following installation.
E. Impact Justification and Mitigation
1. Avoidance and Minimization
la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
Impacts to jurisdictional features have been avoided and minimized to the maximum extent practicable by incorporating resourceful site planning,
including utilization of the wetland/stream delineation to adjust the layout of the Site design to avoid and minimize impacts. The remaining impacts
proposed are necessary in order for the project's goals to be realized.
The proposed sewer line was designed at a minimal slope while staying as consistent as possible With natural grade. Further, the proposed sewer line
was placed in a way to minimize wetland and stream impacts to the maximum extent practicable while still accounting for gravity sewer needs.
The road crossings were designed to use headwalls to minimize the amount of grading and culvert length required. A culvert will be installed beneath
the crossings to maintain the hydrologic connection of the wetland and stream areas up and down -slope. Roads were sited based on DOT
requirements for entrance locations and Town of Folly Springs requirements for emergency access.
Multiple layouts were reviewed during the preliminary planning stages of the proposed project, including multiple building, road, and parking lot
orientations. The project as proposed utilizes the layout found to be least impactful to jurisdictional features.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
Proper sedimentation and erosion control methods will be utilized during all phases of construction and installation as described in accordance With
the requirements of the North Carolina Department of Environment and Natural Resources: Erosion Control Planning and Design Manual (May 2013)
and local codes. All work will take place during dry conditions and can be facilitated from high, non -jurisdictional, stable ground. The contractor shall
install silt fence, inlet protection, sediment traps, diversion ditches, temporary coffer dams, tree protection, and clearing only as necessary to install
devices. All erosion and sediment control measures will be checked for stability and operation following every runoff producing rainfall, but in no case
less than once every week. Any needed repairs will be made immediately to maintain all measures designed. An erosion control inspections report is
required and Will be kept by the owner's representative.
Temporary seeding and permanent seeding plans are included to restore impacted areas. The project will meet all relative requirements of Best
Management Practices and Engineered Stormwater Control Structures as outlined through State and Local Stormwater Rules. Measures will be taken
to prevent oil, tar, trash, debris and other pollutants from entering adjacent jurisdictional features. Any excess excavated materials not utilized as back
fill will be placed and contained within upland areas and permanently stabilized to prevent erosion into adjacent jurisdictional features. Therefore,
stockpiling of excavated material within jurisdictional waters of the U.S. will be strictly prohibited as part of the construction of this project. All project
construction activities initiated within jurisdictional voters of the U.S. Will be carried to completion in an expeditious manner to minimize the period of
disturbance within jurisdictional waters.

A USFWS IPaC Report and NCNHP Natural Heritage Database Report were utilized for reviewof potential protected species in the vicinity of the
project Site. Species identified by IPaC as potentially occurring in the vicinity of the site include the red -cockaded woodpecker, the Cape Fear shiner,
and Michau)es sumac.
No occurrences of the aforementioned protected species were observed during site inspection nor were any occurrences noted by the NCNHP report.
Due to the maintained nature of open areas on -site and the absence of forested areas of an appropriate age, it is the opinion of Timmons Group that
the proposed project lacks suitable habitat and have no effect on the red -cockaded woodpecker and Michau)(s sumac.
The majority of the streams on -site were heavily shaded, contained sandy to cobbly, substrate, and constitutes poor habitat for the Cape Fear shiner.
The perennial streams (features E and G2) located along the southeastern boundary provide poor to moderate habitat and were primarily
characterized by heavily shaded, low gradient, slow moving reaches with gravel and sand beds. Further, according to the USFWS, the current range
of the species is limited to the tributaries and mainstems of the Deep, Haw, Rocky, and upper Cape Fear Rivers in Chatham, Harnett, Lee, Moore, and
Randolph Counties, with no known occurrences in Wake County (likely due to dams downstream preventing upstream movement). Therefore, it is the
opinion of Timmons that the proposed action will have no effect on the Cape Fear shiner.

The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to
accept payment for compensatory mitigation for impacts associated with the above referenced project as
indicated in the table below. Please note that this decision does not assure that participation in the DMS in-
lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts.
It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will
be approved. You must also comply with all other state, federal or local government permits, regulations or
authorizations associated with the proposed activity including G.S. § 143-214.11.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not
received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance will
expire. It is the applicant’s responsibility to send copies of the permits to DMS. Once DMS receives a copy
of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must
be made prior to conducting the authorized work. The amount of the in-lieu fee to be paid by an applicant is
calculated based upon the Fee Schedule and policies listed on the DMS website.

The North Carolina Natural Heritage Program (NCNHP) appreciates the opportunity to provide
information about natural heritage resources for the project referenced above.
A query of the NCNHP database indicates that there are records for rare species, important natural
communities, natural areas, and/or conservation/managed areas within the proposed project
boundary. These results are presented in the attached ‘Documented Occurrences’ tables and map.
The attached ‘Potential Occurrences’ table summarizes rare species and natural communities that
have been documented within a one-mile radius of the property boundary. The proximity of these
records suggests that these natural heritage elements may potentially be present in the project area
if suitable habitat exists. Tables of natural areas and conservation/managed areas within a one-mile
radius of the project area, if any, are also included in this report.
If a Federally-listed species is documented within the project area or indicated within a one-mile
radius of the project area, the NCNHP recommends contacting the US Fish and Wildlife Service
(USFWS) for guidance. Contact information for USFWS offices in North Carolina is found here:

Please note that natural heritage element data are maintained for the purposes of conservation

To Whom It May Concern:
The species list generated pursuant to the information you provided identifies threatened,
endangered, proposed and candidate species, as well as proposed and final designated critical
habitat, that may occur within the boundary of your proposed project and/or may be affected by
your proposed project. The species list fulfills the requirements of the U.S. Fish and Wildlife
Service (Service) under section 7(c) of the Endangered Species Act (Act) of 1973, as amended
(16 U.S.C. 1531 et seq.).
New information based on updated surveys, changes in the abundance and distribution of
species, changed habitat conditions, or other factors could change this list. Please feel free to
contact us if you need more current information or assistance regarding the potential impacts to
federally proposed, listed, and candidate species and federally designated and proposed critical
habitat. Please note that under 50 CFR 402.12(e) of the regulations implementing section 7 of the
Act, the accuracy of this species list should be verified after 90 days. This verification can be
completed formally or informally as desired. The Service recommends that verification be
completed by visiting the ECOS-IPaC website at regular intervals during project planning and
implementation for updates to species lists and information. An updated list may be requested
through the ECOS-IPaC system by completing the same process used to receive the enclosed list.
Section 7 of the Act requires that all federal agencies (or their designated non-federal
representative), in consultation with the Service, insure that any action federally authorized,
funded, or carried out by such agencies is not likely to jeopardize the continued existence of any
federally-listed endangered or threatened species. A biological assessment or evaluation may be
prepared to fulfill that requirement and in determining whether additional consultation with the
Service is necessary. In addition to the federally-protected species list, information on the
species' life histories and habitats and information on completing a biological assessment or

If your project contains suitable habitat for any of the federally-listed species known to be
present within the county where your project occurs, the proposed action has the potential to
adversely affect those species. As such, we recommend that surveys be conducted to determine
the species' presence or absence within the project area. The use of North Carolina Natural
Heritage program data should not be substituted for actual field surveys.
If you determine that the proposed action may affect (i.e., likely to adversely affect or not likely
to adversely affect) a federally-protected species, you should notify this office with your
determination, the results of your surveys, survey methodologies, and an analysis of the effects
of the action on listed species, including consideration of direct, indirect, and cumulative effects,
before conducting any activities that might affect the species. If you determine that the proposed
action will have no effect (i.e., no beneficial or adverse, direct or indirect effect) on federally
listed species, then you are not required to contact our office for concurrence (unless an
Environmental Impact Statement is prepared). However, you should maintain a complete record
of the assessment, including steps leading to your determination of effect, the qualified personnel
conducting the assessment, habitat conditions, site photographs, and any other related articles.
Please be aware that bald and golden eagles are protected under the Bald and Golden Eagle
Protection Act (16 U.S.C. 668 et seq.), and projects affecting these species may require

RE: Permit Pre-Application Consultation Request
On behalf of the Trustwell Property Group, Timmons Group would like to initiate Pre-Application
Consultation for proposed road and utility crossings within the project Site known as Oakview
Innovation Park (formerly known as Oakview). The purpose of this consultation is to confirm the
best route to achieve 404 and 401 permit compliance in order to streamline review and avoid
Requests for Additional Information (RAIs), enabling the fastest possible approval of 404 and
401 permits for the proposed project.
This project is the proposed development of road crossings and public utility connections for a
proposed commercial park located in Holly Springs, NC (Wake County). This project for
proposed road/utility development will be separate from another development for commercial
buildings. For the purposes of 404/401 permitting, the project area consists of an approximately
216-acres located south of New Holly Tree Church Road and west of Green Oaks Parkway. The
Site is occupied by mixed hardwood forest and early successional vegetation
Proposed impacts to jurisdictional features within the Site are associated with road crossings
and public sewer line installation. Sewer line placement is required by the local municipality and
will be maintained by the municipality following construction. The utility connections will be
coordinated in a way that allows for easier and more efficient planning of utility placement within
the Site. The project plans are currently underway and site plans for permitting are anticipated
around early 2021. Preliminary plans with anticipated impact locations and amounts are
attached.
Timmons Group conducted a field delineation in 2016 and on May 6th, February 17th, and
February 27th, 2020 to identify potential jurisdictional Waters of the U.S. (WOTUS) within the
216-acre project Site. A site visit was conducted by James Lastinger on July 12th, 2019 and July
28th, 2020, 2020 and a preliminary jurisdictional determination was issues on August 8th, 2020
(SAW-2015-02137). The features depicted in the request reflect the results of the agency visit
and the updated proposed project boundaries. The Site is not located in one of the North
Carolina -protected riparian buffer watersheds.
Impacts to wetlands and streams delineated on-Site are limited to those necessary to install the
necessary utility connections and road crossings for a future commercial park (where
necessary). Four proposed road crossings will be required for connectivity of this site and will
include five areas of permanent wetland impact (totaling ~0.47-acres) and three areas of
permanent stream impact (totaling ~0.017-acres and ~376.4-ft). In addition, eight utility line
crossing impacts will be required. The utility line crossing impacts will all consist of temporary
disturbance for line installation, with directional boring to be utilized wherever possible.
Temporary utility line impacts include three areas of temporary wetland impact (totaling ~0.091-
acres) and seven areas of temporary stream impact (totaling ~0.007-acres) Impacts are limited
to those necessary for connection to public roads and utilities, and project design utilized the
confirmed delineation to place impacts where the minimum amount of impact would occur.
Multiple potential road and utility layouts were investigated to reduce impacts as much as
possible within the constraints of the necessary road and utility connections.
The Site is located within an area with the potential for occurrences of three (3) federally
endangered species (see attached IPaC). No critical habitat is listed as occurring within the Site
limits or a 1-mile radius. According to the NC Natural Heritage Program (NCNHP) report, there
are no known occurrences of protected species or natural/managed areas within the project
area. No occurrences of protected species or their associated suitable habitat were noted on
Site. There is one (1) historic resource identified within 1-mile of the project site (see attached
SHPO Map and list). This resource is not listed on the National Register of Historic Places and
is located 0.83-miles north of the Site. No historical resources are listed as occurring within the
Site. Further, according to FEMA FIRM Map panels 3720062800J (eff. 5/2/2006) the Site is
located within Zone X (area of minimal flood hazard) and therefore not within a FEMA-
designated floodplain or floodway.
We are proposing to permit the proposed project through submittal of a PCN for use of
Nationwide Permit 39, Commercial and Institutional Developments and the corresponding
General Certification No. 4139. Due to the amount of stream impacts (~376.4-ft permanent
impact) we anticipated a request for a waiver of the 300-ft limit will be required. We would like to
consult with you to confirm the best permitting route and any anticipated additional information
required in order to permit the planned impacts.

The species list generated pursuant to the information you provided identifies threatened,
endangered, proposed and candidate species, as well as proposed and final designated critical
habitat, that may occur within the boundary of your proposed project and/or may be affected by
your proposed project. The species list fulfills the requirements of the U.S. Fish and Wildlife
Service (Service) under section 7(c) of the Endangered Species Act (Act) of 1973, as amended
(16 U.S.C. 1531 et seq.).
New information based on updated surveys, changes in the abundance and distribution of
species, changed habitat conditions, or other factors could change this list. Please feel free to
contact us if you need more current information or assistance regarding the potential impacts to
federally proposed, listed, and candidate species and federally designated and proposed critical
habitat. Please note that under 50 CFR 402.12(e) of the regulations implementing section 7 of the
Act, the accuracy of this species list should be verified after 90 days. This verification can be
completed formally or informally as desired. The Service recommends that verification be
completed by visiting the ECOS-IPaC website at regular intervals during project planning and
implementation for updates to species lists and information. An updated list may be requested
through the ECOS-IPaC system by completing the same process used to receive the enclosed list.
Section 7 of the Act requires that all federal agencies (or their designated non-federal
representative), in consultation with the Service, insure that any action federally authorized,
funded, or carried out by such agencies is not likely to jeopardize the continued existence of any
federally-listed endangered or threatened species. A biological assessment or evaluation may be
prepared to fulfill that requirement and in determining whether additional consultation with the
Service is necessary. In addition to the federally-protected species list, information on the
species' life histories and habitats and information on completing a biological assessment or

If your project contains suitable habitat for any of the federally-listed species known to be
present within the county where your project occurs, the proposed action has the potential to
adversely affect those species. As such, we recommend that surveys be conducted to determine
the species' presence or absence within the project area. The use of North Carolina Natural
Heritage program data should not be substituted for actual field surveys.
If you determine that the proposed action may affect (i.e., likely to adversely affect or not likely
to adversely affect) a federally-protected species, you should notify this office with your
determination, the results of your surveys, survey methodologies, and an analysis of the effects
of the action on listed species, including consideration of direct, indirect, and cumulative effects,
before conducting any activities that might affect the species. If you determine that the proposed
action will have no effect (i.e., no beneficial or adverse, direct or indirect effect) on federally
listed species, then you are not required to contact our office for concurrence (unless an
Environmental Impact Statement is prepared). However, you should maintain a complete record
of the assessment, including steps leading to your determination of effect, the qualified personnel
conducting the assessment, habitat conditions, site photographs, and any other related articles.
Please be aware that bald and golden eagles are protected under the Bald and Golden Eagle
Protection Act (16 U.S.C. 668 et seq.), and projects affecting these species may require
development of an eagle conservation plan (http://www.fws.gov/windenergy/
eagle_guidance.html). Additionally, wind energy projects should follow the wind energy
guidelines (http://www.fws.gov/windenergy/) for minimizing impacts to migratory birds and
bats.

Not all Threatened and Endangered Species that occur in North Carolina are subject to section 7
consultation with the U.S Fish and Wildlife Service. Atlantic and shortnose sturgeon, sea
turtles,when in the water, and certain marine mammals are under purview of the National Marine
Fisheries Service. If your project occurs in marine, estuarine, or coastal river systems you should
also contact the National Marine Fisheries Service, http://www.nmfs.noaa.gov/

Federal agencies to include conservation of threatened and endangered species into their project

information about natural heritage resources for the project referenced above.

The proposed project at the Oakview Innovations site located in the Town
of Holly Springs, North Carolina within Wake County includes the
development of roads and utilities for a future commercial park. Any future
development of commercial buildings is anticipated to be a separate project
by others. Stream and/or wetland impacts will be necessary for road
crossing, utilities, and associated grading.
Sewer line placement is required by the local municipality and will be
maintained by the municipality following construction, and road crossing
impacts are required for connectivity and access throughout the site. The
project plans are currently underway and site plans for permitting are
anticipated around early 2021. Preliminary plans with anticipated impact
locations and amounts are attached.
A formal Pre-Application Meeting Request to DWR and the USACE will be
forthcoming to set up a joint meeting and/or discussion.
