Expedited permits are generally simple 100% domestics (e.g., schools, mobile home parks, etc) that can be administratively renewed with minor changes, but can include facilities with more complex issues (Special Conditions, 303(d) listed water, toxicity testing, instream monitoring, compliance concerns). DWR agrees that the summer ammonia limit is sufficient; toxicity testing has been removed. o Ammonia Nitrogen (NH3-N) Limits and Monitoring - In the current permit you monitor weekly for NH3-N and have and have an effluent limit in place only in summer months. Your previous summer ammonia limits were a daily maximum of 35 mg/L and a monthly average of 12 mg/L. Based on the in -stream dilution available at the outfall and current EPA water quality criteria, your summer ammonia limits must be adjusted to 10 mg/L daily maximum and 2.0 mg/L monthly average. Recent review by Division staff has noted that 15A NCAC 2B .0404(c) requires that winter waste load allocations for oxygen consuming waste be no less stringent than 2 times the summer waste load limit. To meet this rule requirement, winter limits for NH3-N must also be adjusted in the permit. The new winter ammonia limits based on current EPA criteria are 35.0 mg/L daily maximum and 12.0 mg/L monthly average. o Compliance Schedule - A review of the monitoring data over the last permit cycle indicates that there were many instances where daily maximums and monthly averages would have exceeded the proposed limits for ammonia. Based on the DMR data review from the last permit cycle it appears that these new limits may impact facility compliance. In order to avoid placing this facility in non-compliance with permit limits, the Division has included a compliance schedule. Compliance with new limits should be achieved prior to the expiration of this permit in June 2024. Please see section A. (3) for additional details and requirements. o HUC was added to the outfall description on page 2 o The outfall map has been updated o Regulatory citations were added throughout the permit o Section A. (4) Electronic Reporting of Discharge Monitoring Reports was updated to be current with federal requirements for electronic reporting. Before issuing final permit, ammonia limits were updated. Previously, the summer limit (12.0 mg/L) appears to have been based on oxygen consumption rather than EPA chronic critera, though the original WLA is unclear. The facility has never had a winter limit. Based on their DMR data, it appears they may have some trouble meeting these new limits, so I have also included a compliance schedule. We deliberated on this for a while, thus the delay getting this permit finalized. I wanted WSRO to be aware and have a chance to comment before transmitting the updated draft to the permittee.
