PROJECT SUMMARY: The applicant is proposing an 8single-family lot subdivision, 6-townhomes, 5 duplexes, 5 condominiums, an elevated boardwalk, associated utilities, and road construction including the installation of 1 culvert for §404 wetland crossing. PROJECT DESCRIPTION: The project site is located at 3265 Old Ferry Road, on the mainland side of Holden Beach, adjacent to the Atlantic Intracoastal Waterway, in Brunswick County. To get to the site from Wilmington take US Hwy 17 S to NC Hwy 211, turn left onto NC Hwy 211 and travel approximately 0.3 miles to Stone Chimney Road. Turn right onto Stone Chimney Road and travel approximately 7.2 miles to the project site, which is located on the right. The subject property is a 15.06-acre tract of land, which extends to an un-named tributary of the AIWW. The property has approximately 3.8 acres of § 404 wetlands and approximately 1.1 acres of coastal wetlands. The property is bordered to the west by an un-named tributary of the AIWW with approximately 1004 lineal feet of shoreline, and is bordered by the Tropical Shores Subdivision to the north. The property is bordered by undeveloped land, coastal and §404 wetlands to the south. The property is primarily undeveloped and is forested with hardwoods, conifers, and native underbrush. The only man-made features currently on the property consist of four existing structures (1 house & 3 small buildings). The current average elevation of the property is approximately 10' above mean sea level (MSL). The high ground portion of the property has been largely untouched with the exception of the existing dwelling area. There is a vast stance of coastal and §404 wetlands which border the western and southern side of the property and span from approximately 75' to 300' to the normal high waterline (NHW). The coastal wetlands consist primarily of Salt Marsh Cordgrass (Spartina alterniflora), Black Needle Rush (Juncus roemarianus), Bulrush (Scirpus spp.), and other species in this area include Wax Myrtle (Myrica cerfera) and Southern Redcedar (Juniperus virginiana L). The highground vegetation primarily consists of Loblolly Pine (Pines taeda), Live Oak (Quercus virginiana), and Red Maple (Ater rubrum). The Brunswick County Land Use Plan classifies the upland areas of this project as Transitional. The waters of the project site are classified as SA, HQW by the NC Division of Water Quality. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. PROPOSED PROJECT: The applicant is proposing to create a multifaceted subdivision consisting of 8single-family lots, 6-townhomes, 5 duplexes, 5 condominium buildings and related infrastructure and amenities. The 6-townhome buildings would contain 24 units, the 5 duplex buildings would contain 10 units and the 5 condominium buildings would contain 20 units. As proposed, the entire subdivision would have a density of 4.11 units per acre. As proposed, all dwelling units, roads and stormwater ponds would be located landward of the 30' Coastal Shoreline Buffer. As proposed, a portion of 3 townhomes, 2 retention ponds, a portion the road and a pump station would be located within the 75'AEC. This would result in approximately 9,048 sq. ft. of impervious surface coverage for the townhomes, approximately 2,011 sq. ft. for the road and approximately 900 sq. ft. for the pump station. The total amount of impervious surface coverage would be approximately 11,959 sq. ft. or 17.6% within the 75'AEC (see Sheet E4 of 11). The applicant is also proposing a nature trail, which would consist of an elevated wooden boardwalk through §404 wetlands (see Sheets E3 & E7 of 11). The elevated boardwalk would measure approximately 6' wide by 2,006' long of which, approximately 748 linear feet would be located within the 75'AEC of which, approximately 590 linear feet would be located within the 30' Coastal Shoreline Buffer. The applications states that the boardwalk would be elevated a minimum of 3' above the substrate. In addition, the proposed roads would result in permanently impacting approximately 210 sq. ft. of §404 wetlands for the installation of a reinforced concrete pipe culvert measuring approximately 18' in width by 30' in length, located on Moonraker Trail and landward of the 75' AEC. The culvert would be placed in the §404 wetlands and an azea measuring approximately 6' in width by 35' in length would be backfilled for the roadbed construction (see Sheets E4A & ES of 11). As proposed the culvert would be buried at a depth of approximately 1' below the existing bottom contour. The proposed height of the culvert would be approximately 10.5' above NHW. Lawson's Landing Page Three The applicant states that all existing structures on the property are to be demolished and the debris will be disposed of off site. The applicant also states that silt fences will be installed before demolition to prevent any debris and sediments from entering the wetlands. 10. ANTICIPATED IMPACTS The proposed subdivision, installation of the roads, utilities and stormwater measures would disturb approximately 9.1 acres of highground and approximately 210 sq. ft. of §404 wetlands. The proposed impervious surface coverage for the entire subdivision is 161,222 sq. ft or 24.5% of the total site. Of this, approximately 84,724 sq. ft. would consist of pavement and approximately 76,480 sq. ft. for structures. The proposed elevated boardwalk would result in the shading of approximately 8,562 sq. ft. of §404 wetlands. Of this, approximately 4,488 sq. ft. would be located within the 75'AEC and approximately 3,540 sq. ft. would be located within the 30' Coastal Shoreline Buffer. The applicant states that a State Stormwater Permit application to the Division of Water Quality was submitted concurrently. The application states that a Sedimentation and Erosion Control Plan to the Land Quality Section for all land disturbance activities has not been submitted. A §404 Wetlands delineation has been completed and was approved on 02/15/05 by the U. S. Army Corps of Engineers (USACOE). Submitted by: Debra Wilson Date: May 18, 2007 Office: Wilmington RECEIVED DCN1 WILMINGTON, NC Lawsons Landing MAR 0 5 2001 Project Narrative Project Description Lawsons Landing is a 15 acre tract in Brunswick County, located one lot away from where Old Ferry Road meets the Intracoastal Waterway. The community lay dormant for years after the ferry system was rendered unnecessary by the bridge to Holden Beach. At this time, the community is experiencing growth as more homeowners are discovering their love of the water and long to live in a natural coastal environment. Surrounding Lawsons Landing are several undeveloped tracts and residential developments in progress. Adjacent to Lawsons Landing is Tropical Shores, an established subdivision. A roadway connection from Lawsons Landing to Tropical Shores is planned. The vision for Lawsons Landing is a small, quiet community where residents can enjoy a natural environment near the Intracoastal Waterway and take advantage of a comfortable amount of recreational and green space. A homeowner's association will be established to maintain the recreational areas and protect the natural resources of the property. Lawsons Landing will offer a variety of living styles: 8 patio home sites, 24 townhomes, 10 duplex homes and 20 condominiums; for a total of 62 dwellings. Homes will be built in clusters to avoid impacts to the sensitive natural features of the property. Density is 4.11 homes per acre. The development plans feature recreational areas that include picnic space, lawn sports, and nature trails. In the 404 wetland areas, the nature trails will be elevated boardwalks to preserve these sensitive areas while allowing the residents to enjoy the natural beauty of their surroundings. The elevated boardwalk will not be built in the costal wetland areas or on inside the mean high water line. Natural Resources Coastal wetlands, 404 wetlands, mean high and low water lines, and areas of environmental concern have been established and are depicted on the site plan in this package. The 404 wetlands have been approved by the US Army Corps of Engineers. RECEIVED dCM WILMINGTON, NC MAR 0 5 2007 Regulations for building in and around Areas of Environmental Concern have been strictly adhered to in the development of this project. No stormwater treatment ponds, structures or other impervious surfaces are proposed within 30' of the mean high water line. The 6' wide elevated boardwalk, allowed in the Costal Shoreline per 15A NCAC 07H .0209 (d) (10) (D), is strictly for pedestrian use to promote exercise and appreciation for the natural environment. Impervious area in the AEC totals 17.6%, well below the acceptable limit of 30%. In addition, creative methods have been employed to minimize impervious area in the project as a whole, such as providing parking under the buildings. The 404 wetlands have been completely avoided, except for one road crossing where an 18" culvert will be installed to maintain the natural movement of water through the site. Demolition and Construction Several buildings exist on the site that will be removed. Siltation devices will be installed before demolition begins to protect water resources. Building debris will be disposed of off site. Site work construction will be performed by conventional earthwork equipment such as dump trucks, backhoes, road graders, etc. Structures will be prestressed concrete. Conclusion Lawsons Landing as planned has successfully avoided and minimized the impacts to natural resources. Impacts to 404 wetlands have been limited to the installation of one culvert to accommodate a perpendicular road crossing. There are no impervious surfaces proposed in the 30' mean high water line buffer. Only 17.6% of the AEC is proposed to be impervious, well within the 30% limit. The state stormwater application will be submitted concurrently with the CAMA Major Development Application. The developer understands the CAMA Major Permit cannot be issued until the stormwater Certification has been issued. The land plan has been revised to satisfy comments received from NCDENR- DWQ on February 6, 2007, including relocation of stormwater ponds, elevated boardwalks, and buildings.
