There are four streams on the property totaling 4,069 linear feet: Irish Buffalo Creek — 1734 linear feet, CH 100 — 1797 linear feet, CH 200 — 326 linear feet, and CH 300 — 212 linear feet (an isolated stream). There is 0.629 acre of wetlands (WL 1000, WL 1100, WL1200, WL 1300, WL 3000, WL 3100, WL 3200, WL 3300, WL 5000, and WL 6000). Wetlands 3000, 3100, 3200, 3300, 5000, and 6000 are isolated. The enclosed permit application request is for impacts to two streams and six wetlands. The Corps impacts include S1 for 61 linear feet (0.003 acre) and W1 for 0.027 acre. The remaining impacts are to an isolated stream and isolated wetlands. S2 for 212 linear feet of isolated stream. This feature is in the side ditch of an old road and is low quality. Isolated wetland impacts consist of impacts W2 for 0.014 acre, W3 for 0.076 acre, W4 for 0.008 acre, W5 for 0.065 acre, and W6 for 0.006. These wetlands are also low -quality areas adjacent to an old road that have been disturbed in the past from the airport that used to operate on site. Total Corps impacts include 61 linear feet of stream impact and 0.027 acre of wetland impact for a road crossing. Total DWR impacts include 212 linear feet of isolated stream impact and 0.169 acre of isolated wetland impacts for road construction and lot fill. No mitigation is required for this project. Corps stream impacts total Tess than 0.02 acre and Corps wetland impacts total less than 0.10 acre. Total stream impacts total 273 linear feet which is less than the 300 linear feet mitigation threshold for DWR stream impacts (15A NCAC 02H .0506 (c)). Total isolated wetland impacts total 0.169 acre which is less than the 0.5 acre isolated wetland mitigation threshold (15A NCAC 02H .1305 (a)(3) and 15A NCAC 02H .1305 (c)(2)). Over 68% of the Corps and DWR wetlands have been avoided. Fill slopes are the steepest allowed for local approval. The lots along the floodplain of Irish Buffalo Creek had to be raised to avoid flooding impacts. Impacts to the 100 year FEMA floodplain have been avoided except for construction of a public greenway trail system. Public parking is located on site for the greenway trail. The US FWS comment letter is enclosed. The US FWS office has no objections to the project. The NC HPO comment letter is enclosed. The office suggested that the applicant provide a 50' buffer in the area of the off -site Phifer cemetery. The applicant has provided this requested 50' buffer and is donated the property in that area to the cemetery. Enclosed are the necessary permit application documents and additional information. We submit the following comments in accordance with the provisions of the Fish and Wildlife Coordination Act, as amended (16 U.S.C. 661-667e); the National Environmental Policy Act (42 U.S.C. §4321 et seq.); and section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543) (Act). Project Description According to the information provided, the proposed project would consist of a residential development on approximately 70 acres in Concord, North Carolina. Onsite habitats consist of successional forest, transitional edges, riparian and open, maintained grassland. Development plans have not been provided at this time. However, your correspondence indicates that Irish Buffalo Creek occurs onsite, and that the proposed work may require authorization from the U.S. Army Corps of Engineers. Federally Listed Endangered and Threatened Species Service records indicate multiple mist net captures for the federally threatened northern long- eared bat (Myotis septentrionalis) in the proposed project vicinity. Suitable summer roosting habitat may be present in the project area for this animal. However, the fmal 4(d) rule (effective as of February 16, 2016), exempts incidental take of northern long-eared bat associated with activities that occur greater than 0.25 miles from a known hibernation site, and greater than 150 feet from a known, occupied maternity roost during the pup season (June 1 — July 31). Based on the information provided, the project (which may or may not require tree clearing) would occur at a location where any incidental take that may result from associated activities is exempt under the 4(d) rule. The service appreciates the applicant's efforts to avoid associated tree clearing activities during this animal's maternity roosting season from May 15 — August 15. We would therefore concur with a "may affect, not likely to adversely affect" determination for this species from the appropriate action agency. Based on the information provided, it appears that suitable habitat is present onsite for the federally endangered Schweinitz's sunflower (Helianthus schweinitzii). However, targeted botanical surveys conducted September, 2020 did not detect evidence for these species at that time. Due to the presence of suitable habitat, but lack of evidence for these species collected during the optimal survey window, we believe the probability for project -mediated loss of this plant is insignificant and discountable. Therefore, we would concur with a "may affect, not likely to adversely affect" determination from the federal action agency, and we require no further information at this time. We have no concerns for project -mediated impacts to any other federally protected species. Please be aware that obligations under section 7 of the Endangered Species Act must be reconsidered if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered, (2) this action is subsequently modified in a manner that was not considered in this review, or (3) a new species is listed or critical habitat is determined that may be affected by the identified action. We offer the following general recommendations for the Applicant's consideration: Erosion and Sediment Control Measures to control sediment and erosion should be installed before any ground -disturbing activities occur. Grading and backfilling should be minimized, and existing native vegetation should be retained (if possible) to maintain riparian cover for fish and wildlife. Disturbed areas should be revegetated with native vegetation as soon as the project is completed. Ground disturbance should be limited to what will be stabilized quickly, preferably by the end of the workday. Natural fiber matting (coir) should be used for erosion control as synthetic netting can trap animals and persist in the environment beyond its intended purpose. Low Impact Development We recommend that consideration be given to the use of pervious materials (i.e., pervious concrete, interlocking/open paving blocks, etc.) for the construction of roads, driveways, sidewalks, etc. Pervious surfaces minimize changes to the hydrology of the watershed and can be used to facilitate groundwater recharge. Pervious materials are also less likely to absorb and store heat and allow the cooler soil below to cool the pavement. Additionally, pervious concrete requires less maintenance and is less susceptible to freeze/thaw cracking due to large voids within the concrete. Riparian Buffers Natural, forested riparian buffers are critical to the health of aquatic ecosystems. They accomplish the following: 1. catch and filter runoff, thereby helping to prevent nonpoint-source pollutants from reaching streams; 2. enhance the in -stream processing of both point- and nonpoint-source pollutants; 2 3. act as "sponges" by absorbing runoff (which reduces the severity of floods) and by allowing runoff to infiltrate and recharge groundwater levels (which maintains stream flows during dry periods); 4. catch and help prevent excess woody debris from entering the stream and creating logjams; 5. stabilize stream banks and maintain natural channel morphology; 6. provide coarse woody debris for habitat structure and most of the dissolved organic carbon and other nutrients necessary for the aquatic food web; and 7. maintain air and water temperatures around the stream. Forested riparian buffers (a minimum 50 feet wide along intermittent streams and 100 feet wide along perennial streams [or the full extent of the 100-year floodplain, whichever is greater]) should be created and/or maintained along all aquatic areas. Impervious surfaces, ditches, pipes, roads, utility lines (sewer, water, gas, transmission, etc.), and other infrastructures that require maintained, cleared rights -of -way and/or compromise the functions and values of the forested buffers should not occur within these riparian areas. No archaeological survey is recommended. However, the Phifer Cemetery is located immediately adjacent to the project area. Our office was contacted regarding the potential for unmarked human burials associated with the Phifer Cemetery. While the Phifer Cemetery has an associated stone wall that encloses marked graves, given the age of the of the interments, unmarked graves may also be present within or outside of this stone wall. We recommend providing a 50 ft buffer around the cemetery wall to avoid inadvertent impacts to any potential unmarked graves. If ground disturbance cannot be avoided in this area, we recommend that an archaeological survey be conducted by an experienced archaeologist. Our office now requests consultation with the Office of State Archaeology Review Archaeologist to discuss appropriate field methodologies prior to the archaeological field investigation.
