APPROVAL OF MODIFIED STORMWATER MANAGEMENT PLAN
Dear Mr. Helms:
On November 17, 2010, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification
to impact 0.01 acre of wetland and 64 linear feet of stream in order to install a relocated dumpster pad for
an apartment complex located on Highway 421 in Boone, North Carolina. Condition 2 of the Water
Quality Certification requires you to provide a stormwater management plan if the parcel is further
developed beyond the 22 percent impervious surface coverage depicted in the approved site plan.
On July 25, 2012, the DWQ received a revised stormwater management plan (dated July 23, 2012) for
Bob Helms Parking Lot Revisions from your consultant, John Villas of Environmental Consulting
Services, Inc. The purpose of the requested revision is to replace parking spaces for the apartment
complex lost as a result of the Highway 421 widening project. The revised site and stormwater
management plan reflects an additional four lots that were added to the site (acquired by you since the
Water Quality Certification was issued on November 17, 2010).
The DWQ approves the revised site and stormwater management plan as satisfying Condition 2 of the
General Water Quality Certification. This approval is for the purpose and design that you described in
your application. If you change or expand your project, you must notify us and you may be required to
send us a new SMP. This approval requires to you follow the conditions listed in the General Water
Quality Certification for the project and the following additional conditions listed below:

1. As long as the total impervious surface on lots 17, 18, 20, 21 and 22 does not exceed 26,325 square
feet, an engineered stormwater best management practice (BMP) is not required to treat the site per
the 401 Water Quality Certification Program.
2. If any additional impervious surface (over 26,325 square feet) is added to lots 17, 18, 20, 21 and 22,
then a stormwater BMP must be provided. This BMP must be designed to remove 85 percent of the
total suspended solids from the runoff the stormwater generated by the additional impervious surface
(exceeding 26,325 square feet). Furthermore, you will be required to provide a completed BMP
Supplement Form with all the required items for review and approval by the DWQ. The BMP
Supplement Forms are available at the following web site:

3. The applicant and/or authorized agent shall provide a completed Certificate of Completion form to
the DWQ within thirty (30) days of project completion (available at
