Raleigh, North Carolina 27699 Re: South Lakes Subdivision — Phases SF -4, SF -7 & SF -8 — NWP 29 PCN Submittal Previous Corps AID # - 2oo62o162; 2oo6o163 W &R Project #02110074.00 Dear Mr. Lastinger and Mr. McMillan, On behalf of South Lakes Investors, LLC, we are requesting authorization from the USACE to use NWP 29 for 0.24 acres of temporary wetland impacts, 0.38 acres of permanent open water impacts, 48 if of temporary stream impacts and 90 if of permanent stream impacts for the construction of future Phases SF -4, SF -7 & SF -8 of the South Lakes Subdivision. We are requesting 401- Certification from NC -DWQ for the aforementioned impacts, as well as o.16 acres of permanent impacts to isolated wetlands. We are also requesting Buffer Compliance Authorization from NC -DWQ for 21,339 sq ft of impacts to riparian buffers. The project is ±198 acres in size and is located approximately 1400 if west of the intersection of Old Honeycutt Road and Kennebec Road in Fuquay - Varina, Wake County (Latitude: 35.5756751N; Longitude: - 78.742347 °W)• The project is located in the Neuse River basin and onsite waters drain to Black Creek. The Water Quality Classification for Black Creek is B;NSW and the Stream Index Number is: 24-4541)• The cataloging unit forthe site is 03020201. Project Purpose The purpose of the proposed project to construct Phases S -4, SF -7 & SF -8 of the South Lakes Subdivision and the associated infrastructure. The project will require the expansion of the existing dam in order to accommodate a 2 -lane road, utilities (i.e. water, sewer, etc.) and greenway trail in order to provide internal access and shared utilities between the existing and proposed phases of the South Lakes Subdivision. The proposed connector road and greenway will also provide internal access for use of amenities, as well as domestic services (i.e. garbage trucks, mail carriers, landscapers, etc.) thereby reducing the traffic on surrounding public roads (i.e. NC -55, Old Honeycutt Road and Kennebec Road). The road will also provide an additional access point for emergency services such as EMS, Fire, Police, etc. Project History In 2005, the Corps issued NWPs 12 & 39 (AID #2oo62o162 & 2oo62o163) for the initial phases of the South Lakes subdivision. AID #2oo62o162 authorized o.191 acres of temporary wetland impacts for installation of utility lines and AID #2oo620163 authorized 0.003 acres of permanent wetland impacts for construction of subdivision roads. A copy of the permit has been provided as an Appendix. 1410 Commonwealth Drive I Suite 1011 Wilmington, NC 28403 1 tel: 910.256.9277 1 fax: 910.256.2584 www.withersravene[.com I License No. C -0832 WITHERS II RAVEN EL ENGINEERS I PLANNERS I SURVEYOR5 In 2oo6, a NWP 12 (AID #20o62oi62) was issued for additional phases of the South Lakes subdivision, which authorized o.91 acres of temporary wetland impacts and 102 If of temporary stream impacts for construction of utility lines. A copy of the permit has been provided as an Appendix. AID #2oo62o162 replaced the previous NWP 12 issued in 2005, and the o.91 acres of temporary impact included the previously approved o.191 acres of temporary impacts. In 2007, W &R submitted a PCN to Jamie Shern with the Corps of Engineers requesting o.o18 acres of permanent wetland impacts for construction of a cut -de -sac, as well as 0.344 acres of temporary wetland impacts and 35 If of temporary stream impacts for construction of utility tines. The applicant did not receive any correspondence from the Corps within 45 days of submittal of the application. In a letter dated September 5, 2007, W &R notified the Corps that the permit had been issued by default and the applicant would proceed with the project as proposed in the application. A copy of the notification letter submitted to the Corps has been provided as an Appendix. Copies of the Wetland Survey has been provided as an Appendix for verification and signature. Martin Richmond with NCDWQ issued a Buffer Determination Letter on August 21, 2012 for the proposed project area (NBRRO# 12 -059). A copy of the DWQ Buffer Determination Letter has been provided as an Appendix. Proposed Impacts The proposed impacts consist of 0.24 acres of temporary impacts to jurisdictional wetlands, 48 If of temporary stream impacts, 90 If of permanent stream impacts, o.16o acres of permanent impacts to isolated wetlands, 0.38 acres of permanent open water impacts and 21,339 sq ft (Z1: 14,305 sq ft; Z2: 7,034 sq ft) of permanent impacts to riparian buffers. The proposed 0.24 acres of temporary wetland impacts and 48 If of temporary stream impacts are necessary for installation of a sewer tine to service the proposed Phases SF -7 & SF -8 of the South Lakes Subdivision. WITHERS RAVENEL Page 2 of ENGINEERS I PLANNERS I SURVEYORS WITHERS II RAVEN EL ENGINEERS I PLANNERS I SURVEYOR5 The proposed 0.38o acres of open water impacts will occur from expansion of the existing dam to accommodate a 2 -lane road, 8' greenway and utilities (i.e. water, sewer, etc.) which will service Phases SF -7 & SF -8. Per our meeting with Lauren Witherspoon & Ian McMillan with NC -DWQ and James Lastinger with the Corps of Engineers, the open water impacts were determined based on the fill placed within the lake waterward of the toe of slope of the existing dam (see Dam Cross Section Appendix). The construction of the proposed internal connector road will result in 5,915 sq ft or permanent impacts to Zone 1 and 2,832 sq ft of permanent impacts to Zone 2. The proposed connector road will provide internal access for use of amenities, as well as domestic services (i.e. garbage trucks, mail carriers, landscapers, etc.) thereby reducing the traffic on surrounding public roads (i.e. NC -55, Old Honeycutt Road and Kennebec Road). The road will also provide an additional access point for emergency services such as EMS, Fire, Police, etc. The proposed 90 if of permanent stream impacts will result from installation of a new outlet structure for the lake and the dissipater pad below the outfall structure. The proposed outlet structure will allow the dam to meet the current and future loo -year storm levels without overtopping the dam. The current outlet structure is insufficient and must be upgraded to meet the loo -year storm requirements. The construction of the new outlet structure will require excavation of a portion of the existing dam (both above and below the water level), lake bottom and adjacent uplands. The excavation of the lake bottom does not constitute an open water impact. The excavation will result in permanent impacts to 5,517 sq ft of Zone 1 buffers and 2,537 sq ft of Zone 2 buffers. Due to the location of an existing utility easement, greenway and platted lots, the applicant is unable to establish a new riparian buffer adjacent to the new edge of lake created by the excavation, and buffer mitigation will be provided for the loss of riparian buffers. The proposed o.16 acres of permanent impact to isolated wetlands will occur from construction of a subdivision road within SF -7. Avoidance and Minimization Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and "waters" could be minimized. Phase SF -4 will not require wetland, stream impacts or buffer impacts. Phase SF -7 will result in o.16 acres of permanent impact to an isolated wetland for construction of a subdivision road. Impacts for installation of sewer lines have been minimized to only 0.243 acres of temporary wetland impacts and 48 if of temporary stream impacts. Impacts required for expansion of the existing dam were minimized in several ways. The existing dam is located between an open water lake located upstream, and a beaver impoundment /wetland located downstream. When determining which side of the dam to expand, W &R assessed the functional value of each feature on opposite sides of the dam. The beaver pond /wetland located downstream of the dam consists of a mixture of scattered canopy trees, shrub /scrub wetland vegetation and herbaceous /emergent vegetation. This beaver impoundment /wetland system is complex, and provides significant water quality treatment, as well a habitat for a multitude of waterfowl species and aquatic wildlife. While the upstream lake does serve some water quality value, the overall functional value is extremely low in comparison to the beaver pond /wetland WITHERS C\ RAVENEL Page 3 of ENGINEERS I PLANNERS I SURVEYORS WITHERS II RAVEN EL ENGINEERS I PLANNERS I SURVEYOR5 system below the dam. Therefore, it was determined that expansion of the dam within the upstream lake would result in less environmental /ecological impact, thereby minimizing functional loss. Also, due to the relatively shallow depth of the lake upstream of the dam, it would require less fill and subsequent impacts to expand the dam north versus expanding the dam to the south, which minimized impacts further. Open water impacts were also minimized by designing backslopes to stabilize fill forthe dam expansion at a 2:1 slope. Prior to construction, the water level of the lake will be drawn down to allow construction to be completed in the dry. While the lake is drawn down, an aerator will be used to maintain dissolved oxygen levels within the water during the drawdown. Upon completion of the expansion of the dam and installation of the new outfall structure, the water level within the lake will be restored to the current water level, which is approximately 3o6' NAD 88. Cumulative Impacts Impacts associated with the construction of the Phases SF -4, SF -7 & SF -8 of the South Lakes Subdivision are considered cumulative with authorized impacts from previously constructed phases. The following table documents the cumulative impacts to jurisdictional wetlands and waters for the existing and proposed phases of the South Lakes Subdivision. Mitigation urisdictional Wetlands Cumulative permanent wetland impacts for the existing and proposed phases of the South Lakes Subdivision are less than o.10 acres, and no new permanent impacts to jurisdictional wetlands are proposed. Therefore, mitigation is not proposed forthe cumulative permanent wetland impacts. WITHERS RAVENEL Page 4 of ENGINEERS I PLANNERS I SURVEYORS WITHERS II RAVEN EL ENGINEERS I PLANNERS I SURVEYOR5 The installation of sewer lines within Phase SF-8 will result in 0.24 acres of "permanent conversion" impacts to jurisdictional wetlands as a result of conversion of forested wetlands to herbaceous wetlands through regular maintenance of the utility easements. The applicant proposes to mitigate for the 0.24 acres of permanent conversion impacts through the purchase of 0.25 acres of riparian wetland mitigation from EEP. A copy of the Letter of Reservation from EEP has been provided as an Appendix. Open Water Mitigation is not required for impacts to Open Waters. Riparian Buffer The proposed dam expansion /road construction will result in 5,915 sq ft of permanent impacts to Zone 1 and 2,832 sq ft of permanent impacts to Zone 2. Since the proposed road crossing is perpendicular and impacts less than 1/3 acre of riparian buffer, it is considered an "allowable" use and mitigation is not required. The proposed excavation for installation of the outlet structure and rip -rap dissipater pad will result in permanent impacts to 5,517 sq ft of Zone 1 buffers and 2,537 sq ft of Zone 2 buffers. Due to the location of an existing utility easement, proposed road, existing greenway and cleared platted lots, the applicant is unable to establish a new riparian buffer adjacent to the new edge of lake, and buffer mitigation will be provided forthe loss of riparian buffers. The applicant proposes to mitigate for these permanent buffer impacts through the purchase of 20,356.5 sq ft of riparian buffer within the Lane Island Riparian Buffer Mitigation Bank. A Letter of Availability from Lane Island Riparian Buffer Mitigation Bank has been provided as an Appendix. Stream s Because the proposed cumulative permanent stream impacts are less than 150 lf, stream mitigation is not proposed. Isolated Wetlands & DWQ Since cumulative permanent impacts to isolated and jurisdictional wetlands are less than 1.o acres, and cumulative permanent stream impacts are less than 150 lf, mitigation is not required by NC- DWQ. Construction Phasin The construction of proposed project will occur in phases. The construction of the dam expansion and connector road will be constructed first in order to extend utilities to the east side of the lake which will service Phases SF -7 & SF-8. The sewer line and other subsurface utilities must be installed prior to construction of lots within the proposed Phases SF -7 & SF-8. The proposed connector road will also serve as the construction access during construction of these phases. Phases SF -4, SF -7 & SF-8 of the South Lakes subdivision will be constructed at a later date, pending DWQ approval of the Stormwater Management Plan for each specific Phase. Stormwater Management WITHERS C\ RAVENEL Page 5 of ENGINEERS I PLANNERS I SURVEYORS WITHERS II RAVEN EL ENGINEERS I PLANNERS I SURVEYOR5 The Stormwater Management Plan is conceptual at this point as Phases SF -4; SF -7 & SF -8 have not been fully designed. While the overall project does not exceed 24% impervious, individual phases may do so and final impervious percentages are not known at this time. The Conceptual Stormwater Management Plan, documenting the anticipated BMP locations and drainage areas, has been provided as an Appendix. Upon final design, a Stormwater Management Plan will be designed for each phase meeting stormwater regulations and BMP Manual requirements, and will be submitted to DWQ for approval prior to construction of each phase. We are requesting conditional approval of the 401 WQC to authorized immediate construction of the proposed dam expansion, with approval of a Stormwater Management Plan being required prior construction of the proposed future phases. The current request is for 0.24 acres of temporary impacts to jurisdictional wetlands, 90 if of permanent impacts to jurisdictional streams, 48 if of temporary stream impacts, o.16 acres of permanent impact to isolated wetlands, 0.38 acres of permanent open water impacts and 21,339 sq ft (Z1: 14,305 sq ft; Z2: 7,034 sq ft) of permanent impacts to riparian buffers (see the attached maps and PCN for details). Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and "waters" could be minimized. Phase SF -4 will not require wetland, stream impacts or buffer impacts. Phase SF -7 will result in 0.16 acres of permanent impact to an isolated wetland for construction of a subdivision road. Impacts for installation of sewer lines have been minimized to only 0.243 acres of temporary wetland impacts and 48 If of temporary stream impacts. Impacts required for expansion of the existing dam were minimized in several ways. The existing dam is located between an open water lake located upstream, and a beaver impoundment/wetland located downstream. When determining which side of the dam to expand, W &R assessed the functional value of each feature on opposite sides of the dam. The beaver pond /wetland located downstream of the dam consists of a mixture of scattered canopy trees, shrub /scrub wetland vegetation and herbaceous /emergent vegetation. This beaver impoundment/wetland system is complex, and provides significant water quality treatment, as well a habitat for a multitude of waterfowl species and aquatic wildlife. While the upstream lake does serve some water quality value, the overall functional value is extremely low in comparison to the beaver pond /wetland system below the dam. Therefore, it was determined that expansion of the dam within the upstream lake would result in less environmental /ecological impact, thereby minimizing functional loss. Also, due to the relatively shallow depth of the lake upstream of the dam, it would require less fill and subsequent impacts to expand the dam north versus expanding the dam to the south, which minimized impacts further. Open water impacts were also minimized by designing backslopes to stabilize fill for the dam expansion at a 2:1 slope. Prior to construction, the water level of the lake will be drawn down to allow construction to be completed in the dry. While the lake is drawn down, an aerator will be used to maintain dissolved oxygen levels within the water during the drawdown. Upon completion of the expansion of the dam and installation of the new outfall structure, the water level within the lake will be restored to the current water level, which is approximately 306' NAD 88.
