Enclosed is a 401 WQC application for your review. This application is submitted on
behalf of Mr. Howard Penton with Shinnwood West, LLC for the construction of the Shinnwood
West Subdivision, a residential development located off of Greenville Loop Road in
Wilmington, NC. The applicant proposes to impact 0.25 acre of wetlands in order to gain access
to uplands within the site. The applicant has attempted to avoid and minimize impacts to
wetlands as much as possible while still maintaining an economically viable project. To mitigate
for unavoidable impacts, the applicant proposes to buy into the NC EEP for the restoration of
0.25 acre of non - riparian wetlands in the Cape Fear River Basin. In addition, approximately 13
acres of remaining wetlands on site will be placed in preservation.
The Pre - Construction Notification form, associated maps, and site plan are enclosed for

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
The applicant has attempted to avoid and minimize impacts to wetlands as much as possible while still maintaining an
economically viable project. Because of the location of wetlands within the site, some impacts are necessary to provide
access to uplands. The applicant attempted to minimize impacts by placing these crossings at narrow points when
possible. Another challenge that affected wetland impacts is the location of utilities. Sewer lines need to be installed at
least 3' deep. In order to maintain this depth, straight sections of pipe with few manholes are required. This is why Impact
#2 cannot be avoided. No wetland impacts are requested for individual lots. Additionally, the applicant has designed
buffers around wetlands to ensure that lot owners do not encroach into them.
