Dear DWQ:
Enclosed, please find five (5) copies of the 401/404 application (PCN form). A check
for the application review fee is also enclosed. This project is for a new reinforced
concrete dam on the upper reaches of Rochester Creek, in the Cedar Hill Subdivision,
Cashiers, North Carolina. Rochester Creek is classified as C; Tr:+ from its source to the
Horsepasture River. Due to the topography, there is no opportunity for -an off -line
impoundment on the parcel. The proposed dam is 68 -ft long and will have a hydraylic
height of 8 -ft. The impountment will be 0.08 acre (3,528 Square feet). The
impoundment vol will be approximately 0.32 Acre -Feet. The Owner reports that the
parcel has approximately 900 linear feet of stream frontage. The total disturbed trout
buffer will be 82 linear feet including the dam and impoundment. The impoundment is
for recreational use and improved aquatic habitat. See attached Sketches SK -1 thru SK -7.
By copy of this letter, a trout buffer variance is hereby requested from the NCDENR —
Division of Land Resources (igpplicable). The buffer disturbance is less than ten
percent of the stream frontage. All disturbed areas not to be filled or flooded will be
vegetated pursuant to the seeding schedule in the Erosion and Sediment Control Planning
and Design Manual. Two (2) full size plan sets have been submitted under separate
cover to the NCDENR -DLR Dam Safety Engineer for review. An "exemption letter"
dated July 5, 2005 was previously issued by the NCDENR Dam Safety. If you have any

3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this
application:
The project site is situated on a 4.39 Acre parcel in the Cedar Hill Subdivision in Cashiers, NC. The site is wooded and
heavily vegetated. Rochester Creek crosses the parcel from east to west.
3b.

Explain the purpose of the proposed project:
To create a small impoundment for private recrational use and aquatic habitat.
3e.
Describe the overall project in detail, including the type of equipment to be used:
Install new reinforced concrete arch dam across the upper reaches of Rochester Creek. The Dam is to be situated
downstream from the base of the existing falls on Rochester Creek. The Dam is to have a Hydraulic Height of 8 -Ft,
Centerline Length 68 -Ft, Impoundment surface area 0.08 acres, and Impoundment vol 0.32 Ac -Ft. The principle spillway
shall be a bottom draw cold water release type suitable for trout waters. Due to the steep topography bordering the the
site, an off -line pond is not feasable. See attached Sketches Sk1 thru SK7. The creek will be temporarily diverted
(piped) around the Dam site to create a dry work area. The length of the temporary diversion culvert will not exceed 149 -
Ft. The construction work will be accomplished by using the smallest equipment capable of safely perform the subgrade
excavation. Equipment shall work from dry work area created by the stream diversion. No equipment will be placed in
the creek. Sould the dry work area need to be dewatered during construction; sedimentation and turbidity will be
controlled by pumping. All dewatering discharge shall have a turbidity of not more than 10 NTUs above background or as
otherwise specified in DWQ's Turbidity Standards (15A NCAC 02B.0211(3.)(k.)). To satisfy the required turbidity limit, the
dewatering pump discharge shall be filtered through a Bag Filtration Unit equal to Model BF -400 from Rain- for -Rent with
a 100 to 1 micron nominal rating (P.O.C. at Rain - for -Rent is Jeremy at 704 - 393 - 3345). The turbidity level of all discharge
shall be monitored with calibrated turbidity meters and the filtration equipment shall be adjusted as necessary to insure
compliance with Water Quality Standards. The water downstream of the work area shall likewise be monitored with
calibrated turbidity meters and the turbidity control measures shall be adjusted as necessary to insure compliance with
Water Quality Standards.
Uncured concrete shall not be allowed to come into direct contact with surface waters. This will be accomplished by
establishing a "dry work area" as described above. "High Early" concrete shall be used in the work to minimize curing
time.

D. Impact Justification and Mitigation
1. Avoidance and Minimization

Work shall be performed during periods of normal flow or low flow. No work shall be performed during high flow or flood
conditions. No work shall be performed when unusually severe weather is forecasted. The work area shall be secured and
protected from scour and erosion when high flow and severe weather is forecasted.
Work shall be performed in- the -dry to the extent practicable. Sand bags shall be used as a coffer dam for the temporary creek
diversion (pipe around) to create a dry work area for the Dam construction. No equipment shall be placed in the creek water.
A dry work area will be created to comply with Water Quality Standards.

To minimize disturbance during construction, the work will be accomplished with the smallest mechanical equipment
practicable, and equipment will be located in the dry work area after the creek has been diverted. No equipment shall be
located in the creek water. Sand bags and turbidity curtains will be used around the work area. The upland disposal area for
the excavated materials from the footer excavation have no return water and there will be no wetlands impacted.
Concrete placement will be accomplished "in the dry" by installing a sand bag coffer dam around the proposed work area.
The dewatering discharge will be filtered to DWQ Water Quality Standards prior to release.
