The Asheville Regional Office of the NC Division of Water Quality has been informed that
portions of the property, previously authorized for impacts to, and protection of waters, may not
be owned by Haw Mountain Enterprises, LLC. In order for your 401 Water Quality Certification
to be valid, you must either own, or have legal rights of access to, the property in question.
Prior to performing impacts to, or placing required deed restrictions on waters and buffers, you
must submit to this office, clear proof of or right of access for mitigation, regarding the properties
in question. If you have no rights to the property in questions you must request a modification to
the 401 Water Quality Certification.
