Subject: Notice of Violation - Parker McFadyen Estates, Sewer Main Extension
Dear Mr. Yates:
On October 26, 2005, a Notice of Violation was issued for the above referenced
project. This Notice was for the installation of a sewer main for the subject project
without the issuance of an extension permit as required by North Carolina Administrative
Code Title 15A, Part 0.2H, Section .0300 and PWC's Local Permitting Ordinance. On
October 31, 2005, this office issued the required permit for the sewer main extension.
The issuance of the required permit constitutes compliance with this Notice of
Violation and the Notice is hereby rescinded. Your continued cooperation is requested in
ensuring that the conditions of the permit are adhered to throughout the construction of
the project. Continued compliance will include the submittal of the proper
documentation at the conclusion of construction and prior to the mains being placed in
service.

Subject: NOTICE OF VIOLATION — Parker McFadyen Estates
Dear Mr. Yates:
This letter serves as a Notice of Violation for the proposed Parker McFadyen Estates, at
the intersection of Century Circle and Gus Drive. This project is in violation of the North
Carolina Administrative Code, Title 15A, Part 0.2H, Section .0200, for failure to obtain a permit
prior to constructing a sewer main extension.
As you are aware, issuance of permits have been delayed, pending acquisition of off -site
easements. Since that easement has not yet been acquired, none of the required permits have
been issued. On October 24, 2005, it came to our attention that a portion of the sewer system has
been installed. Installation of sewer mains without the proper approved permits is in violation of
PWC's Local Permitting Ordinance, as well as State rules and regulations.
In order to correct this violation, you must cease all construction activities relative to the
installation of the sewer main and obtain the required sewer permit. Failure to cease construction
of the sewer utilities could result in further legal action being taken. Such action could include
the assessment of a civil penalty of up to $25,000 per day per violation.
We appreciate your cooperation and would like to avoid taking further enforcement
action. However, it is your responsibility to comply with all provisions of the Local Permitting
Ordinance and applicable State regulations. Upon request, we can provide copies of the
Ordinance and/or State regulations. Should you have any questions concerning this notice or
