The onsite meeting was performed in conjunction with a document review performed prior to the meeting. Attached to this letter are the findings from the audit. Note that as a condition of approval and 15A NCAC 02T.0306(b)(5), PWC Fayetteville is required to incorporate any amendment to the requirements of statues, regulations, or sewer minimum design criteria pertaining to the local sewer extension permitting program within sixty days of the effective date of the amendments. Within 60 days of receiving this letter, please provide all update documents in duplicate to my attention at the address at the bottom of this page. If more time is required, please contact this office, however it is imperative and a condition of delegation approval that these amendments be incorporated into the current program and apply to all projects currently under review. Along with the updates requested with this letter, please continue to supply the Central and Regional offices with quarterly reports summarizing any permitting actions. General Comments 1. Attached to this letter is the letter of approval delegating authority for sewer extensions to PWC Fayetteville. The approval letter references collection systems that will continue to be permitted by the Division which includes low pressure sewer systems (any alternative sewer systems not referenced in the minimum design criteria). During the onsite evaluation, there was discussion related to the types of collection systems that PWC Fayetteville could issue under their delegated program. Should PWC Fayetteville have any questions in regards to the permitting authority, please contact our office to discuss. II. Application 1. The application page references a variety of information that is out of date. In particular: • Form FTSE 10/07 has been updated recently by the Division • Form WSCAS 12/07 has been updated recently by the Division • Section X refers Environmental Assessments to the Design Management Unit. Note that the Design Management Unit no longer exists. Any projects that are not under the delegated permitting authority (see approval letter) should be forwarded to the Division • Section 8 of the application references "NCDWQ", this should be "NCDWR" • Section 13 of the application does not reference the Minimum Design Criteria for Pump Station and Force mains. It is also unclear that if a variance is requested (for the MDC or 15A NCAC 2T) then the variance must be approved by the Division III. PWC Fayetteville Minimum Design Standards 1. As was discussed during the onsite evaluation, the minimum design standards provided during the audit process contain items that have not been updated. In particular: • References to NCDWQ per page 1.12 (should be NCDWR) • References to Subchapter 2H per page 2.1 (should be Subchapter 2T) • References to 15A NCAC 2H .0219(1) per page 2.2 (should be 15A NCAC 02T .0114) • Page 2.13 & 2.14 requires manholes to be set 1 foot about the 100 year flood elevation. This is less stringent then the MDC requirement of 24-inches above the 100-year flood elevation (MDC IV.F) • Page 2.16 doesn't reference the minimum 50 foot separation required for wetlands as referenced in 15A NCAC 02T.0305(f). The Division allows alternatives where separations cannot be meet, however the rule does not address manholes or pump stations within the 50 foot separation. As a result, the Division has implemented draft language related to these situations (see attached design criteria) • Page 2.19 references a minimum of 12-inch separation between storm sewer and sanitary sewer. This is less stringent then the separation requirement of 24-inch referenced in 15A NCAC 02T.0305(f) • Page 2.21 contains number references to 15A NCAC 2H (should refer to 15A NCAC 02T) Please Revise. Glass, PE Water Resources Engineering Manager PWC/Fayetteville PO Box 1089 Fayetteville, NC 28302-1089 Subject: Approval of Delegated Local Permit Program for Sewer Extensions Dear Mr. Glass: In accordance with your request for delegation of the local permit program for sewer extensions received on March 14, 2002 and additional information received on March 20, 2003, April 1, 2003, July 25, 2003, August 7, 2003 and September 9, 2003, the Division of Water Quality is hereby forwarding confirmation of your approval granted by the Environmental Management Commission on September 11, 2003 (draft minutes enclosed). This approval has been granted in accordance with NCGS 143-215.1(f) and 15A NCAC 2H .0218 based upon the submittal of your proposed permit program information. The PWC/Fayetteville has been approved to issue permits for the construction and operation of new gravity sewer lines, pump stations and force mains, and modifications to proposed or existing gravity sewer lines, pump stations and force mains within the corporate limits and areas of extraterritorial jurisdiction. The following collection systems shall continue to be permitted by the Division: 1. Outfalls into a basin where sewer service has not yet been provided; 2. Low pressure sewer systems or STEP systems; . 3. Projects involving Environmental Assessments; and 4. Any collection system where a variance from state regulations is required. ,ems an approved local program the PWC/Fayetteville will be responsible for the following: 1. Any future amendment to the requirements of the statute, regulations or sewer minimum design criteria pertaining to the local sewer extension permitting program shall be incorporated into the PWC/Fayetteville local sewer system program within sixty days of the effective date of the amendments; 2. The Fayetteville Regional Office shall approve all wastewater flow tributary to the appropriate wastewater treatment plant. The PWC/Fayetteville shall meet with the regional office to determine how flow allocations shall be handled prior to starting your delegated program. 3. Each project permitted by the local sewer system program shall be inspected for compliance with the requirements with the local program at least once during construction; N. C. Any changes to the approved minimum design specifications must be submitted to the Division for approval prior to incorporating these changes into the local permitting program. Any other changes to the local permitting program, including adjustments to wastewater flow rates, shall receive prior approval from the Division. 5. A quarterly report shall be submitted to the Non -Discharge Permitting Unit and the Fayetteville Regional Office listing for each local permit issued during the quarter, the name of the project, permit number, the treatment facility receiving the waste, and the design flow and the type of waste for sewer system extensions or changes. The report shall also provide a listing and summary of all enforcement actions taken or pending during the quarter. The quarters begin on January 1, April 1, July 1, and October 1, and the report shall be submitted within 30 days after the end of each period. Enclosed you will fmd Form DQR-09/01. This Division form is to be used to submit your quarterly reports. The Division will notify of updated forms as necessary. 6. Per previous discussion, the revised ordinance should be adopted as quickly as possible as well as all other Division recommended modifications to your Design Manual. If necessary, the Division will continue to accept any applications for permitting from the approved local programs for which the delegated authority is uncomfortable permitting. The rule requires that sewer systems be located at least 50 feet away from all wetlands and provides alternative criteria for instances when the setback cannot be maintained. The following provisions are relevant to this policy: (f) The following minimum separations shall be provided for the sewer system except as allowed by Paragraph (g) of this Rule: Waters classified WS (except WS-I or WS-V), B, SA, ORW, HQW, or SB from normal high water (or tide elevation) and wetlands ... 50 feet (g) Alternatives where separations in Paragraph (f) of this Rule cannot be achieved. (5) For all other separations, materials, testing methods and acceptability standards meeting water main standards (15A NCAC 18C) shall be specified. While the rule provides alternatives for piping material when the separation to wetlands cannot be met, the rule does not address manholes and pump stations. In accordance with the provision for alternative design covered under 15A NCAC 2T .0105(n), adherence to the following criteria shall be considered equivalent to the Rule .0305(f): A. Sewer systems shall be designed to maintain maximum feasible separations when a 50 foot separation cannot be met. B. With regards to pump stations serving a single building: 1. Pump stations shall be of a type specifically engineered to be watertight in floodplain conditions including watertight lids. 2. Wet wells shall be constructed of either high density polyethylene or fiberglass reinforced polyester resins with all seams thermally welded and factory tested for leak tightness. 3. All necessary penetrations shall be factory sealed and tested. No field penetrations will be allowed. 4. The pump station shall be located no further than 50 feet from the building served and shall be vented back to the building. For calendar year 2014, FPWC is requesting an allocation of 800,000 gallons for the Rockfish Creek WRF. Currently, the Rockfish Creek WRF receives an average flow of 13.5 MGD, with a permitted capacity of 21 MGD. For 2013 (through November), FPWC has allocated approximately 28,000 gallons of wastewater flow for the Cross Creek WRF. We are requesting an allocation of 150,000 gallons for the Cross Creek WRF for calendar year 2014. Currently, the Cross Creek WRF receives an average flow of 11.6 MGD, with a permitted capacity of 25 MGD.
