Orr Regional Manager In accordance with our telephone conversation of this date, please find attached a letter for the Director's consideration. Also attached is a copy of the- C:ity's monitoring schedule request and substantiating information. The former Director granted an indust rial allocation for metals finishing wastewater to the City of Shelby which was operating -and continues to operate under JOC. At the time the industrial allocation was granted, the City discharged to Hickory Creek (IWC 73%). In return for granting the industrial allocation, the Director required additional metals monitoring because of toxicity concerns at the Hickory Creek location (IWC 73%). Effective 1/26/90 the City relocated its discharge to First Broad River (IWC 12%). Since that time the City has been in compliance with toxicity limitations. The regional staff believe that the metals monitoring requirements contained in JOC t189-01 Allocation #2 can be dropped since toxicity monitoring and reporting reallirements contained in the City's NPDES Permit and JOC now f!i 1. fi 1.l. e ' intent of the requirements specified in Allocation ff2. Cobey, Jr., Secretary Director Mr. Don Rhom, Plant Engineer City of Shelby Wastewater Treatment Facility Box 207 Shelby, North Carolina 28150 Subject: Monitoring Schedule Modification City of Shelby Wastewater Treatment Facility Cleveland County Dear Mr. Rhom: This letter is provided in response to the City of Shelby's written request received August 23, 1990 concerning metals monitoring requirements included in JOC # 89-01 - Allocation # 2 dated November 2, 1989. Increased monitoring was required in Allocation # 2 as a result of aquatic toxicity concerns associated with Curtis Wright's metals finishing wastestream and the City's discharge location at Hickory Creek. On January 26, 1990 the City of Shelby relocated their outfall from Hickory Creek to the First Broad River. Since relocation of the wastewater discharge point, the treatment facility has consistently been in compliance with chronic toxicity requirements at the First Broad River location. As a result of demonstrated toxicity compliance and continued toxicity monitoring and reporting requirements contained in the City of Shelby's Judicial Order by Consent and NPDES Permit, the metals monitoring requirements contained in JOC # 89-01 - Allocation # 2 are hereby rescinded. As you can see they remain the about same from week to week. These test were ordered by Mr. Wilms in his letter dated Nov. 2 1989. Box 207 Shelby, North Carolina 28150 SUBJECT: Judicial Order by Consent Allocation Request City of Shelby JOC # 89-01, Allocation #2 NPDES Permit No. NC0024538, Cleveland County Dear Mayor Clay: R. Paul Wilms Director In accordance with the City's request of October 6, 1989, and as allowed under paragraph 10 of the subject Consent Judgment and pursuant to the provisions of NCGS 143-215.67(b), I hereby authorize the acceptance of up to 300 GPD of additional industrial/domestic wastewater into the Shelby Wastewater Treatment Plant. This allocation is supplementary to a previous allocation authorizing the acceptance of up to 2.18 MGD of additional wastewater which was granted by letter dated August 30, 1989. The Division may evaluate toxicity at the Shelby Wastewater Treatment Plant and any study which projects significant impacts on the receiving stream may result in the Division suspending flow allocations to the treatment system. Acceptance of flow into the treatment facility is subject to the following conditions: i 1). The 300 GPD industrial/domestic allocation shall be committed to Curtis Wright Flight Systems. 2). Monthly reports on connections to the system shall be submitted to the attention of Mr. Roy Davis, Department of Environment, Health, and Natural Resources, Division of Environmental Management, 59 Woodfin Place, Asheville, NC 28801 listing those projects which have allocated flows, amount allocated, and once connected data on actual water consumption. Please note that any violation of your Consent Judgment including effluent limitations and schedule dates shall be enforced thereunder and shall terminate this flow allocation. Any portion of the authorized additional waste not previously connected to the system shall not thereafter be connected until the necessary sewerage system improvements have been completed and placed in operation.
