Dear Mr. Brown:
The Division received your application for a wastewater discharge permit on June 30, 1998.
Division personnel have reviewed and approved your application. Accordingly, we are forwarding the
attached NPDES discharge permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215 .1 and the Memorandum of Agreement between North Carolina and
the U.S. Environmental Protection Agency dated December 6, 1983, and as subsequently amended.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such
demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division
may 'require modification or revocation and reissuance of the permit.
This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Water Quality or permits required by the Division of Land Resources, the
Coastal Area Management Act or any other Federal or Local governmental permit that may be
required.

II, III, and IV hereof.
The permit shall become effective February 1, 1999

1. Continue to operate an existing 6.0 MGD wastewater treatment facility consisting of a bar
screen, grit removal, cylindrical fines screen, aeration basin, two primary clarifiers, two
trickling filters, four final clarifiers, pump stations, two chlorinators, two sulfonators, sludge
pump station, aerated sludge holding tank, two filter belt presses, ten bay sludge compost
building, dual standby power generators and sludge incinerator (presently not is use) located
at Broad River Wastewater Treatment Plant, off NC Highway 18, southwest of Shelby,
Cleveland County (See Part III of this permit), and
2. Discharg from said treatment works at the location specified on the attached map into the
First Broad River (Class C waters) in the Broad River Basin.

monitoring shall be grab samples taken 3/wk (Jun -Sep) and 1/wk (Oct -May).
The monthly average effluent BOD5 and Total Suspended Solids concentrations shall not exceed 15% of the respective influent value (85% removal).
The daily average effluent dissolved oxygen concentration shall not be less than 5.0 mg/l.
The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units.
The detection limit for cyanide is 10 ug/I. If the measured levels of cyanide are below the detection limit, then the measurement is considered to be zero for
purposes of compliance evaluation and should be reported on the DMR as < 10 ug/i.
Toxicant monitoring shall coincide with toxicity sampling.

There shall be no discharge of floating solids or visible foam in other than trace amounts.

SUPPLEMENT TO EFFLUENT LIMITATIONS
AND MONITORING REQUIREMENTS
SPECIAL CONDITIONS
A(2). CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT (QRTRLY)
The effluent discharge shall at no time exhibit chronic toxicity using test procedures outlined in the "North
Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised November 1995, or subsequent
versions.
The effluent concentration at which there may be no observable inhibition of reproduction or significant
mortality is 17 % (defined as treatment two in the procedure document). The permit holder shall perform
uarterl monitoring using this procedure to establish compliance with the permit condition. The tests will be
pe ormed during the months of February, May, August, and November. Effluent sampling for this testing
shall be performed at the NPDES permitted final effluent discharge below all treatment processes.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge
Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B.

Test data shall be complete and accurate and include all supporting chemical/physical measurements performed
in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent
toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required,
the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating
the facility name, permit number, pipe number, county, and the month/year of the report with the notation of
"No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences
Branch at the address cited above.
Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will
begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will
revert to quarterly in the months specified above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly
monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test
requirement will revert to quarterly in the months specified above.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division of
Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to
include altemate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival, minimum control organism reproduction, and appropriate environmental controls, shall
constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day
of the month following the month of the initial monitoring.

RESPONSE:
This agency has reviewed the draft permit and determined that the proposed
discharge will not be sufficiently close to any existing or know proposed
public water supply intake so as to create an adverse effect on water quality.
We concur with the issuance of this permit provided the facility is operated
and maintained properly, the stated effluent limits are met prior to discharge,
and the discharge does not contravene the designated water quality standards.

ty located at the Broad River
Wastewater Treatment Plant,
off NC Highway 18, southwest
of Shelby, Cleveland County.
The facility is permitted to dis-
charge 6.0 MGD of treated do-
mestic and industrial
wastewater from one outfall In-
to the First Broad River, a
Class C stream in the Broad
River Basin which has a 7010
flow of 44.3 cfs. BOD, ammo-
nia, cyanide, and selenium are
water quality limited. For some
parameters, the available load
capacity of the immediate re -
ceiving water will be consumed.
This may affect future
water quality based effluent
limitations for additional dis-
chargers within this portion of
the watershed.

- July 1993, the WLA was revised because Shelby WTP expansion would cause 7Q1OS
flow to decrease from 70 cfs to 44.3 cfs. This would increase instream waste
concent!ation from 12 to 17 percent.
- January 1994, NPDES permit issued with two sets of effluent sheets: (1) WWTP
requirements prior to WTP expansion and (2) WWTP requirements after WTP
expansion.

Instream monitoring data were examined from January 1996 through June 1998.
Dissolved oxygen (DO) concentrations often decreased downstream of the discharge
location, but recovered further downstream. DO values never dropped below 6.0 mg/1.
Conductivity values consistently increased from the up- to downstream monitoring
locations. Fecal coliform numbers were often higher down- than upstream, but values
do not appear to have been related to fecal in the effluent. Several high fecal coliform
values instream (Region may want to examine potential causes).
WLA Summary
Monitoring and limits will remain the same for the majority of parameters in the permit.
Review of DMR and instream data indicate that oxygen consuming wastes and nutrients
have generally not been a problem. The highest total nitrogen (12 mg/1) and phosphorus
(2.8 mg/1) values should not be a concern because the receiving stream is not nutrient
sensitive and instream waste concentration equals seventeen percent.
Review of the industry wastewater characteristics summarized in the application form
indicated that sulfide and oil and grease are discharged from one or more industries, but
are not monitored in the NPDES permit. Industrial effluent oil and grease concentrations
did not exceed 40 mg/l. Oil and grease monitoring is required in the Long Term
Monitoring Plan (LTMP) and will not be required in the NPDES permit. Sulfide was
detected in the effluent of two industries in concentrations not exceeding 0.4 mg/l.
There is no water quality standard, nor is there a federal criterion. Thus, sulfide
monitoring will not be required.
Review of effluent data from the individual industries indicated that chloride and phenol
were detected in one industry's effluent and chloroform was detected in a second
industry's effluent. Chloride has a standard in trout waters and has an action level in
non -trout waters. In addition, concentrations detected were generally below the action
level. Phenol was detected infrequently in one industry's effluent. Phenolic compounds
only has a standard in water supply waters. Thus, chloride and phenol will not be
monitored in the NPDES permit. Chloroform was detected at concentrations below the
federal criterion. In addition, chloroform is a byproduct from the treatment of drinking
water and would hopefully volatilize during the WWTP process. Chloroform will not
be monitored in the NPDES permit.

A reasonable potential analysis indicated that cyanide and selenium will be limited
during the forthcoming permit period. Cadmium, chromium, copper, lead, nickel, and
zinc are all monitored in the LTMP. The reasonable potential analysis indicated that
copper, silver, and zinc all exceeded their action levels. Monitoring (but no limit) will
be required for these three parameters. Monitoring will not be required for cadmium,
chromium, lead, and nickel.
Other
On August 7, 1998, Shelby WWTP requested an increase in flow from 6.0 MGD to 8.0
MGD. They must conduct an environmental assessment prior to requesting permit
modification to account for this increase. Thus, Shelby WWTP will be renewed at 6.0
MGD.

paved access road.

c. Describe receiving stream features and pertinent downstream uses: Good flow
observed in the receiving stream at the point of discharge. There are no known
dischargers between the WWTP's discharge and the Broad River. Downstream
uses are primarily agriculture.
PART II - DESCRIPTION OF DISCHARGE AND TREATMENT WORKS

WWT facilities consist of mechanical screening and grit removal followed by two
primary clarifiers, two trickling filters, six diffused aeration tanks, four final
clarifiers, a chlorine contact chamber, dechlorination, an aerated sludge
mixing/holding tank, a sludge thickener, belt filter press, and an invessel compost
facility.

Description of proposed WWT facilities: Changes and/or up -grades to the existing
WWT facilities will be necessary prior to this facility being capable of expanding
to the proposed 8.0 MGD.
Possible toxic impacts to surface waters: This facility is consistently passing it's
toxicity tests.

2. Residual handling and utilization/disposal scheme: Residuals are being composted using
an invessel type operation and are distributed as a Class A soil conditioner.

2. Special monitoring or limitations (including toxicity) requests: The City has asked for the
following changes/modifications to the current monitoring requirements:
a. Request that the Permit contain a CBOD5 limit instead of a BOD5 limit.
b.
Defer comment to the TSB.
Request a reduction in the monitoring frequency from weekly to twice per month
for Cd, Cr, Ni, Pb, SE, and cyanide.
If , in the opinion of the staff of the TSB that there is sufficient data to support this
request, this Office will offer no objection.
3. Important SOC/JOC or Compliance Schedule dates: N/A
PART IV - EVALUATION AND RECOMMENDATIONS
The ty of Shelby requests renewal of the subject Permit for the continued operation of
the City's WWTP. There have been an upgrade of the WWTP since the Permit was last issued. A
description of all current WWTP facilities can be found in Part II. No. 1(e).
The City has also requested in a subsequent letter dated August 7, 1998, that the Permit
contain effluent limitations for both 6.0 and 8.0 MGD. The City, it appears, may be faced with a
possible WWTP expansion/upgrade during the term of this NPDES Permit renewal. Additional
flow from prop
osed annexation areas as well as expected flow from various industrial
contributors result in average daily flows at or near current permitted (and design) capacity.
Such being tle case, the City will need to begin planning for the anticipated expansion using the
yet -to -be -promulgated effluent limitations at 8.0 MGD. For this reason, it is recommended that
the Permit be renewed as requested and containing effluent limitation pages for both 6.0 and 8.0
MGD flows.

Pursuant to an onsite meeting on August 6, 1998 with Mr. Mike Parker of the
Mooresville Regional Office on Ref. permit renewal; the city hereby requests
that the 'renewal application submitted on June 26, 1998 be modified as follows:
• The City of Shelby requests that the draft permit to be issued to include
effluent discharge limitations and monitoring requirements for a permitted
flow of 8.0 MGD.
This request is based upon the following factors:
• The recent plant upgrade completed in December of 1997 included piping,
basin, and sludge processing infrastructure to accommodate a hydraulic
capacity in excess of 8.0 MGD.

operating very consistently within the current effluent discharge limitations.

• Shelby has experienced major annexation of county urbanized areas and plans
to expand it's collection system to provide sewer service to these areas over
the next five years.
• Additional commercial/industrial growth is anticipated by way of major
regional highway improvements and urbanization effects of the
Mecklenburg/Gastonia county growth.
• Shelby's land use plan update has determined sewer service availability is a
key component for the future.

Attached are three (3) copies of the application for Ref. permit together with a
check for the permit application processing fee in the amount of $300.00.
The City of Shelby Wastewater Treatment Plant is currently permitted to discharge
6.0 MGD to the First Broad River under Permit No. NC0024538 which expires on
December 31, 1998. This application is for renewal of the current permit.
Since the previous NPDES permit application, Shelby has constructed a septage
receiving station at the plant headworks. The structure has been completed and the
city anticipates beginning to receive septage toward the end of the third quarter of
1998.
The city requests DWQ's serious consideration of the following items for permit
renewal:

1. Request that DWQ establish the 7Q10 flow in the First Broad River at the
Wastewater Treatment Plant discharge point,further that DWQthis g and use th
value in any analysis to develop permit limits. Please provide documentation
of the methods used to establish the 7Q10 flow. The City of Shelby is very
interested in an accurate 7Q10 flow and therefore offers to assist DWQ as
needed in establishing this value at the Wastewater Treatment Plant discharge
point.
2. Request that the permit contain a CBOD limit instead of a BOD limit.
3. Request a reduction in monitoring frequency from weekly to two times per
month for cadmium, chromium, nickel, lead, cyanide, and selenium.
4. Request permit language setting non -detect equal to a value of zero for
purposes of averaging to determine compliance.
5. Provide the City of Shelby with the Fact Sheet prepared as part of the draft
permit development, as soon as it is available.
6. Provide documentation of methodology, data, and assumptions used in any
Reasonable Potential Analyses that may be conducted.
7. Provide information addressing DWQ's consideration of metals partitioning
and bioavailability in the development of permit limits.
8. Provide documentation of the reference location used in any bioassessment
evaluation.
9. Request a copy of any comments that DWQ may receive from the public
regarding this permit renewal.

We understand that DWQ has formed a Triennial Review Advisory Committee
which has made recommendations for changes to some of the surface water quality
standards, One of the recommendations of the Committee is to allow the use of
dissolved, or other toxic forms of cadnium, nickel, and other metals to develop
permit limits for the protection of aquatic life. The proposed rule change would
allow facilities to conduct studies to determine the toxicity of these metals in their
discharge. Although the proposed rule essentially states that the studies must be
provided at the time of application by the permittee, we understand that numerous
comments were received about that statement at the public meetings on the
proposed rule changes and that DWQ will consider removing "at the time of
application" from the proposed rule. The City of Shelby may conduct studies to
support the determination of the toxic form of metals limited in our draft permit.

Narrative Description of the Sludge Management Plan
The sludge management system includes sludge holding, dewatering,
and composting facilities. The aerated sludge holding tank is the
receiving point for primary sludge, scum from the trickling
filters,and thickened waste activated sludge. Aeration is
primarily for maintaining sludge freshness, but mixing will also
occur. The stored sludge is pumped to belt presses for dewatering.
Dewatered sludge is discharged to the amendment mixer where the
amendment product, such as tree trimmings, yard waste, sawdust,
etc., are added and blended. The sludge/amendment mix is loaded
into one of the mechanically aerated/agitated invessel compost
bays. After 21 days of treatment plus 30 days of curing, the
compost is available for use as a Class A soil conditioner. Odor
control is managed through the use of a biofilter adjacent to the
compost area.

SUPPLEMENT TO PERMIT COVER SHEET
City of Shelby
is hereby authorized to:
1. Continue to operate an existing 6.0 MGD wastewater treatment facility consisting of a bar
screen, grit removal, cylindrical fines screen, aeration basin, two primary clarifiers, two
trickling filters, four final clarifiers, pump stations, two chlorinators, two sulfonators, sludge
pump station, aerated sludge holding tank, two filter belt presses, ten bay sludge compost
building, dual standby power generators and sludge incinerator (presently not in use) located at
Broad River Wastewater Treatment Plant, off of NC Highway 18, southwest of Shelby,
Cleveland County (See Part III of this Permit), and
2. Discharge from said treatment works at the location specified on the attached map into the First
Broad River which is classified Class C waters in the Broad River Basin.

The effluent discharge shall at no time exhibit chronic toxicity using test procedures outlined in:

Bioassay Procedure - Revised *September 1989) or subsequent versions.
The effluent concentration at which there may be no observable inhibition of reproduction or
significant mortality is 17% (defined as treatment two in the North Carolina procedure document).
The permit holder shall perform quarterly monitoring using this procedure to establish compliance
with the permit condition. The first test will be performed after thirty days from the effective date
of this permit during the months of February, May, August and November. Effluent sampling for

this testing shall be performed at the NPDES permitted final effluent discharge below all treatment
processes.
All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter
code TGP3B. Additionally, DEM Form AT-1 (original) is to be sent to the following address:
