Good Afternoon Crystal,
Per Our Phone Conversation.
Last year there was a CMP culvert, under SR 1565 Henry Bird Road that collapsed, causing sediment to go downstream.
The stream was a UT to the Tuckasegee River and it is 0.23 miles from culvert site to the Tuckasegee River (Critical
Habitat for Appalachian Elktoe Mussel). NCDOT maintenance crews, hand removed the majority of the sediment, that
the pipe failure caused. NCDOT Jackson County Maintenance Department was to replace the collapsed CMP culvert last
March/April 2020, however, due to the state-wide budget freeze, they were unable to replace the collapsed culvert.
David McHenry had consulted with Claire Ellwanger and Jay Mays last year about hand removal of sediment and fixing
the collapsed culvert. This is a foot-for-foot replacement (36” x 148’) and normally would qualify for NWP 3 Non
Notification, however, we are closer than 0.50 miles from Critical Habitat of the Appalachian Elktoe. Our office was
contacted by the NCDOT Jackson County Maintenance Department today about moving forward with the CMP culvert
replacement, since funds are now available. They have ordered the CMP pipe and it will take approximately 3 weeks to
arrive. During replacement county maintenance crews will close the road, dewater the channel and replace the
collapsed CMP culvert. Since the road will be closed, County EMS crews will be on standby, due to residents not having
access from their homes. County maintenance crews will work a 24/hr. shift to replace the culvert as fast as feasible.
Would it still be possible to complete and submit an “after the fact” EPCN? Or would the EPCN need to be submitted and
approved prior to culvert installation? The County Maintenance Engineer told us today, that the project would need to
be completed by June 30, 2021 due to funding requirements. I have attached a standard drawing of the culvert to be
replaced as well as architecture/archaeology screening. We will be utilizing the new PA Agreement, since the culvert
replacement will occur within existing disturbed right-of-way for Section 106. If there are any questions or if you need
