I hope that you are doing well. We recently received notification that the Section 401 certification for the subject
project was issued. I have also attached a copy of what we received. I noticed that the Section 401 was issued, but I did
not see a Riparian Buffer Authorization. I was emailing to see if that was forthcoming. I know that the Town of
Hillsborough is listed as a delegated authority for the Neuse River Buffers; however, since this is a Town-funded project
that they are constructing, our understanding was that the authority reverted back to the State since the Town could
not permit itself. Is that correct or is there some other authority we should be applying to for our buffer authorization? I
wanted to make sure before the Town proceeds with any work associated with the project. If you could email me back
when you have an opportunity it would be much appreciated.
