Dear Ms. Norton and Mr. Wojoski,  On behalf of Clayton Properties Group, LLC, we are requesting authorization from the USACE to  use NWP 29, as well as requesting a 401 WQC from NCDWR, for the following impacts:      The proposed total permanent direct impacts to jurisdictional waters are 0.27 acres (see table  below) and therefore is eligible for authorization under an NWP 29.                  We are also requesting an NCDWR Riparian Buffer Authorization for 76,928 sf of permanent  buffer impacts for construction of the proposed subdivision.  The proposed project consists of the construction of a 616‐lot mixed‐density residential  subdivision and associated infrastructure (roads, walking trails, stormwater management, etc.).  The proposed Georgia’s Landing subdivision consists of a 216.38‐acre parcel (PIN: 0560‐02‐52‐ Lick Creek and Martin Creek.  The Water Quality Classification for Lick Creek is: WS‐IV; NSW and  the Stream Index Number is: 27‐11‐(0.5).  The Water Quality Classification for Martin Creek is:  WS‐IV; NSW and the Stream Index Number is: 27‐11‐1.      Proposed Project  The purpose of the proposed project is to construct a mixed density residential subdivision to meet  the existing and growing demand for residential housing in Durham County.  The project consists of the construction of the following:   242 single family home lots   374 townhome lots   Construction of infrastructure (roads, greenways, utilities, stormwater management, etc.)  The proposed design for the internal roads will result in four stream crossings for roads.  “Street  F” will cross Stream 7 perpendicularly with a 36” RCP culvert.  “Street P” will cross Stream 5  perpendicularly with a 54” RCP culvert.  Riprap dissipators will be constructed below the culverts  to dissipate flow velocity to prevent erosion and sedimentation of the streams.  “Street G” has been designed to cross Stream 11 with a bottomless arch culvert to avoid stream  impacts.  “Street I” has been designed to cross Stream 9 with a bottomless arch culvert to avoid  stream impacts.  Bottomless arch culverts were utilized for stream crossing where the stream  channels were straight enough that the entire stream could be spanned with an arch culvert with  less than a 20‐ft span, which is the maximum span for arch culverts allowed by NCDOT.  The  sinuosity of Stream 5 (Street P) and Stream 7 (Street F) at the crossing locations would require a  span of more than 20‐ft, and therefore these crossings require traditional culverts. The bottomless  culverts are designed to include riprap stabilization along the internal edges of the streams to  prevent erosion to preserve the channel pattern and profile.  The proposed design will result in one wetland road crossing (Street N) which will cross Wetland  A perpendicularly at the narrowest point.   The internal gravity sewer and water force main will be installed using conventional open trenching  methodology.  The internal sewer will connect to a sewer outfall along the northern boundary of  the project being constructed by the City of Durham as part of the Southeast Regional Lift Station  project, which was permitted by City of Durham in 2019 (NCDWR Project #19‐0208; USACE AID:  Unknown).  Upon completion of construction, the subdivision roads and onsite gravity sewer system will be  dedicated to the City of Durham for ownership and maintenance as part of their public road and  sewer network.  Project History  WithersRavenel completed a delineation of the wetlands, streams, and riparian buffers for the  subdivision project area in September 2018, and a Preliminary JD Request was submitted to the  USACE requesting verification of the delineation.  Ross Sullivan with the USACE verified the  delineation on 11/14/2018 (AID: SAW‐2018‐01873).  In an email dated 12/4/2018, Mr. Sullivan been issued.  Please note that we are requesting issuance of the PJD in conjunction with issuance  of the NWP 29. A copy of the email from Ross Sullivan has been attached to this application.  NCDWR issued a Buffer Determination Letter (NBRRO #18‐291) for the project site on  9/13/2018, which has been provided as an attachment to this application.  A pre‐application meeting was conducted on 11/21/2019 with Samantha Dailey with the USACE  and Stephanie Goss with NCDWR to discuss the proposed project.  Additionally, WithersRavenel  submitted a Pre‐Filing Meeting Request on 11/02/2019, and received email notification, dated  2020‐12‐03, that a Pre‐Filing Meeting was not required for this project.  Therefore the 401  requirements for a pre‐filing meeting request under 40 C.F.R. Section 121.4(a) have been satisfied.   Both the Pre‐Filing Meeting Request form and email documenting that a pre‐filing meeting was  not required have been provided as an attachment to this application.  Proposed Impacts  The proposed impacts consist of:  Impacts from Subdivision Construction   0.189 acres of permanent wetland impacts   0.035 acres of temporary wetland impacts   285 lf of permanent stream impacts   165 lf of indirect (secondary) stream impacts from bottomless culverts   39 lf of temporary stream impacts   76,928 sf of riparian buffer impacts (Zone 1: 41,883 sf; Zone 2: 35,045 sf)    All proposed permanent wetland and stream impacts are necessary for construction of internal  roads to access developable uplands within the site.  “Street F” has been designed to cross Stream 7 (Impact 6, 7 & 8) perpendicularly at a location that  allowed for the shortest culvert possible to minimize stream impacts. The 36” RCP culvert will be  buried 12” below the stream bed.  A riprap dissipator will be installed below the culvert to prevent  erosion and sedimentation of downstream waters.  The riprap will be installed by burying the riprap  such that the top of the riprap matches the pre‐construction contours of the natural stream bed,  allowing for the passage of aquatic life and preventing a loss of function of this section of stream  channel.    “Street P” has been designed to cross Stream 5 (Impacts 9, 10 & 11) perpendicularly at a location  that allowed for the shortest culvert possible to minimize stream impacts. The 36” RCP culvert will  be buried 12” below the stream bed.  A riprap dissipator will be installed below the culvert to  prevent erosion and sedimentation of downstream waters.  The riprap will be installed by burying  the riprap such that the top of the riprap matches the pre‐construction contours of the natural  stream bed, allowing for the passage of aquatic life and preventing a loss of function of this section  of stream channel.    “Street G” has been designed to cross Stream 11 (Impact 32) with a bottomless arch culvert to  avoid stream impacts.  The bottomless culvers are designed to include riprap stabilization along  the internal edges of the streams to prevent erosion to preserve the channel pattern and profile.  “Street I” has been designed to cross Stream 9 (Impact 33) with a bottomless arch culvert to avoid  stream impacts.  The bottomless culvers are designed to include riprap stabilization along the “Street N” has been designed to cross Wetland A (Impacts 13 & 13a) perpendicularly at the  narrowest point.  The 72” RCP culvert will be embedded 12” to maintain hydrologic connectivity  within Wetland A.  A riprap dissipator will be installed below the culvert to dissipate flow and  prevent erosion, as Wetland A is located within a crenulation which experiences surface flow  during heavy rain events.   The installation of the onsite utilities (gravity sewer and water main) will be installed using  traditional trenchless methods and all impacts associated with the installation of the utilities will  be temporary.  The entire utility easements will be mowed/maintained through the wetlands in  perpetuity, resulting in 0.035 acres of permanent wetland conversion impacts.  During construction of the culverted road crossings, sewer crossings and water force main  crossings, work will be completed “in the dry” by constructing temporary coffer dams upstream  and downstream of the culverts within the impact areas and pumping flow around the construction  area.  Upon completion of construction, all temporarily impacted streams will be restored to pre‐ construction contours and the banks will be stabilized using a biodegradable matting and seeded  with a riparian seed mix.  No matting will be placed on the stream beds.  Additionally, all  temporarily impacted wetlands will be restored to natural grade and seeded with a wetland seed  mix to provide temporary stabilization until natural revegetation permanently stabilizes these  areas.  Avoidance and Minimization  Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted  so that impacts to wetlands and “waters” could be minimized.    Proposed permanent wetland and stream impacts for construction of the subdivision and  infrastructure have been minimized to only those necessary for construction of road crossings to  access developable uplands within the site. There are no impacts proposed for construction of lots  or stormwater SCMs.  All road crossings have been designed to cross wetlands at the narrowest  points and cross streams perpendicularly to minimize impacts to wetlands, streams, and riparian  buffers.  Bottomless arch culverts have been designed for two of the three stream crossings to avoid direct  stream impacts at these locations.  Indirect (secondary) impacts from shading have been assessed  and will be mitigated.  Additionally, headwalls have been designed at all five road crossings to  stabilize road fill and further minimize stream, wetland, and riparian buffer impacts.  Riprap dissipators will be constructed such that the riprap will be installed by burying the riprap  such that the top of the riprap matches the pre‐construction contours of the natural stream bed,  allowing for the passage of aquatic life and preventing a loss of function of this section of stream  channel.    Upon completion of construction, all temporarily impacted stream channels will be restored to pre‐ construction conditions and grades, and temporarily stabilized with biodegradable matting and  seeded with a riparian seed mix.  No matting will be placed on the stream bed.  The internal gravity sewer was designed to minimize impacts to wetlands and stream by locating  the sewer line within uplands and roads where possible.  Where wetland and stream crossings  could not be avoided, the alignments have been designed to cross wetlands, streams, and buffers Impacts to riparian buffers have been minimized to the greatest extent possible.  The proposed  riparian buffer impacts will occur from construction of road crossings, utilities (sewer/water) and  a walking trail.  All proposed riparian buffer impacts are for uses are classified as “deemed  allowable”, “allowable upon authorization” or “allowable with mitigation” in the Neuse River  Riparian Buffer Rules’ Table of Uses.    There are two buffer impacts which are “allowable with mitigation upon authorization”.  The sewer  line from manhole (MH) 185 to MH 200 will result in non‐perpendicular (parallel) impacts to the  riparian buffers of Stream 12.  The 4,277 sf of non‐perpendicular buffer impacts within Zone 1  (Impact 20) are “allowable with mitigation upon authorization”.  Additionally, the “Street P”  crossing of the riparian buffers associated with Stream 5 exceeds 1/3 acre and therefore is  “allowable with mitigation upon authorization”.  Therefore, riparian buffer mitigation will be  provided for these two impacts.    Access during construction will occur within uplands.  Additionally, sediment and erosion control  measures will be installed prior to construction.  Mitigation  Stream Mitigation  The proposed project will result in 285 lf of permanent stream impacts, of which 246 lf will result  in functional loss as depicted in the table below.  Direct Stream Impact Mitigation Table resulting in the provision of 492 lf of stream mitigation.      The applicant proposes to provide compensatory mitigation at a 1:1 ratio for indirect losses of WithersRavenel contacted mitigation banks within the Neuse 03020201 basin, and there was no  stream mitigation available.  Therefore, the applicant proposes to provide the 657 lf of stream  mitigation through the NCDMS.  The letter of acceptance from NCDMS for the 657 lf of stream  mitigation has been provided as an attachment.    Wetland Mitigation  The applicant proposes to mitigate for the 0.189 acres of permanent wetland impacts through the  purchase of offsite mitigation credits at a 2:1 ratio, resulting in the provision of 0.40 acres of  riparian wetland mitigation credits.  The applicant proposes to purchase the 0.40 acres of riparian  wetland mitigation credits from Wildlands Holdings within the Falling Creek Stream and Wetland  Mitigation Banking Instrument: McClenny Acres II Mitigation Site.  The Statement of Availability  from Wildlands has been provided as an attachment to this application.   Since permanent wetland conversion impacts from installation of the sewer and water lines, no  mitigation is proposed for the 0.035 acres of permanent wetland conversion impacts.    Buffer Mitigation to this application.  Stormwater Management Plan  The stormwater management plan consists of ten constructed stormwater wetland SCMs and one  wet detention SCM which provide a minimum of 30% nitrogen removal and therefore diffuse flow  is not required.  The stormwater management plan will be reviewed and approved by the City of Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and “waters” could be minimized. Proposed permanent wetland and stream impacts for construction of the subdivision and infrastructure have been minimized to only those necessary for construction of road crossings to access developable uplands within the site. There are no impacts proposed for construction of lots or stormwater SCMs. All road crossings have been designed to cross wetlands at the narrowest points and cross streams perpendicularly to minimize impacts to wetlands, streams, and riparian buffers. Bottomless arch culverts have been designed for two of the three stream crossings to avoid direct stream impacts at these locations. Indirect (secondary) impacts from shading have been assessed and will be mitigated. Additionally, headwalls have been designed at all five road crossings to stabilize road fill and further minimize stream, wetland, and riparian buffer impacts. Riprap dissipators will be constructed such that the riprap will be installed by burying the riprap such that the top of the riprap matches the pre-construction contours of the natural stream bed, allowing for the passage of aquatic life and preventing a loss of function of this section of stream channel. Upon completion of construction, all temporarily impacted stream channels will be restored to pre-construction conditions and grades, and temporarily stabilized with biodegradable matting and seeded with a riparian seed mix. No matting will be placed on the stream bed. The internal gravity sewer was designed to minimize impacts to wetlands and stream by locating the sewer line within uplands and roads where possible. Where wetland and stream crossings could not be avoided, the alignments have been designed to cross wetlands, streams, and buffers perpendicularly. Impacts to riparian buffers have been minimized to the greatest extent possible. The proposed riparian buffer impacts will occur from construction of road crossings, utilities (sewer/water) and a walking trail. All proposed riparian buffer impacts are for uses are classified as “deemed allowable”, “allowable upon authorization” or “allowable with mitigation” in the Neuse River Riparian Buffer Rules’ Table of Uses. There are two buffer impacts which are “allowable with mitigation upon authorization”. The sewer line from manhole (MH) 185 to MH 200 will result in non-perpendicular (parallel) impacts to the riparian buffers of Stream 12. The 4,277 sf of non- perpendicular buffer impacts within Zone 1 (Impact 20) are “allowable with mitigation upon authorization”. Additionally, the “Street P” crossing of the riparian buffers associated with Stream 5 exceeds 1/3 acre and therefore is “allowable with mitigation upon authorization”. Therefore, riparian buffer mitigation will be provided for these two impacts. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. All but two of the onsite streams are small intermittent streams which are not potential habitat for these species. Additionally, the onsite perennial streams (Streams 1 and 15) are not small rivers and are less than 15 meters wide) and therefore are not potential habitat for Carolina madtom and Neuse River waterdog. This site is ± 216.8 acres and comprised of undeveloped woodlands and a small abandoned homestead. During the site review WithersRavenel identified 17 Streams and 7 potential wetlands. This site was a head scratcher, which I why I’ve watermarked the data forms as a draft. Based on the regional supplement I was not able to find hydric soils. However, these areas meet the eye test as wetlands. The soils on this site are deep red in color and could be categorized as naturally problematic “red parent” soils, however the “red parent” soils are not applicable in LLR P. I’ve also attached as an appendix a Buffer and E/I/P determination from NCDWR. Please take a look at the attached request and let me know your availability for a site visit.
