Dear Mr. Walker:
On March 3, 2021, Isaiah Reed from the Asheville Regional Office of the Division of Energy,
Mineral and Land Resources (DEMLR), conducted a site inspection for the Janesville
Acoustics facility located at 157 Lackey Town Road, McDowell County, North Carolina.A
copy of the Compliance Inspection Report is enclosed for your review.The site visit and file
review revealed that the subject facility is covered by NPDES Stormwater General Permit
NCG170000 under Certificate of Coverage NCG170392. Permit coverage authorizes the
discharge of stormwater from the facility to receiving waters designated as the Catawba
River, a Class C waterbody in the Catawba River Basin.
As a result of the site inspection, the following permit conditions violations are noted:
1) Stormwater Pollution Prevention Plan (SPPP)
The Stormwater Pollution Prevention Plan (SPPP) was not made available at the time of the
inspection.
2) Good Housekeeping
Waste material from the industrial process was observed around the facility in several
locations, in the stormwater system, and at the outfall.

You are asked to respond to this office, in writing,within 15 calendar days from receipt of
this notice. Your written response should include a reasonable explanation as to why the
aforementioned violation(s) have occurred as well as a Plan of Action to prevent these
violation(s) from recurring.
Thank you for your attention to this matter. This Office is considering sending a
recommendation for enforcement to the Director of the Division of Energy, Mineral &Land
Resources regarding these issues. Your above-mentioned response to this correspondence
will be considered in this process.This office requires that the violations,as detailed
above,be properly resolved.These violations and any future violations are subject to
a civil penalty assessment of up to $25,000 per day for each violation. Should you have

Inspection Summary:
On March 3, 2021 this facility was inspected for compliance. During the inspection, the following violations were noted:
1) Facility staff were unable to locate a Stormwater Pollution Prevention Plan(SWPPP). The permittee shall immediately
revise the facility training program to include all staff necessary to locate, maintain and make the SWPPP available for
inspection. The permittee shall include all staff that may have to locate the SWPPP in the event that other staff are out of
the office.
2) Previous discussions with facility staff outlined a modified process which would prevent waste material from escaping the
site/Waste material from the industrial process was again observed built up in various locations including; against the
perimeter fences, on the asphalt, in the grass, in the storm drains, and at the outfall. The permittee shall immediately
develop a plan to prevent future waste material from leave the site and remove all existing buildups and accumulations of
waste material from the industrial process.
Please give the above items your immediate attention. This facility will be reinspected on or after April 7, 2021. If the above
items have not been addressed,further action will be taken.
