Director August 22, 2012 Dee Freeman Secretary DWQ Project # 10 -0735 Union County Subject Property: Professional Buildings and Parking on Lawyer's Road, Stallings, NC UT to Four Mile Creek [030834, 11- 137 -9 -4, C] APPROVAL OF MODIFIED STORMWATER MANAGEMENT PLAN Dear Mr. and Mrs. Bigham: On November 9, 2012, the Division of Water Quality (DWQ) issued an Authorization Certificate to impact approximately 1,100 square feet of the Good Creek protected riparian buffers for the purpose of constructing the two bioretention cells and discharge pipe from the dry detention basin at the subject property. In order to meet Condition 1 (Written Stormwater Management Plan) of the Authorization Certificate, your consultant, Mr. Nicholas Parker, P.E. of Amicus Engineering, requested a modification to the approved stormwater management plan (dated July 23, 2012 and received July 26, 2012). The modification requested is to shift bioretention cell BR -I approximately 10 feet to the east to provide a larger perimeter buffer as requested by the Town of Stallings. The DWQ approves the proposed modification to relocate bioretention cell BR -1 as satisfying Condition I of the Buffer Authorization Certificate. This approval is for the purpose and design that you described in your application and modification request. If you change your project, you must notify us and you may be required to send us a new SMP. This approval requires to you follow the conditions listed in the Authorization Certificate for the project and the following additional conditions listed below: 1. T- he -SM-P— approved- by4he- D -W-Q- consists -of _two- (2)- bioretention_cellsrone (1) dry detention pond and all associated stormwater conveyances, inlet and outlet structures, and the grading and drainage patterns depicted on the approved plan sheets. The footprint of all stormwater management devices as well as an additional 10 -foot wide area on all sides of the devices shall be located in either public rights -of -way, dedicated common areas or recorded easement areas. The final plats for the project showing all such rights -of -way, common areas and easement areas shall be in accordance with the approved plans. 3. Maintenance activities for the approved BMPS shall be performed in accordance with the notarized O &M agreement. The O &M agreement must transfer with the sale of the land or transfer of ownership /responsibility for the BMP facility. DWQ must be notified promptly of every transfer. 4. The applicant and/or authorized agent shall provide a completed Certificate of Completion form to the DWQ within thirty (30) days of project completion (available at http•/ /portal ncdenr.or web /wq /swp /ws /401 /certsandpermits /apply /forms).
