In order to receive final permit limits, a formal application will have to be submitted to the Division's Permits and Engineering Unit. It should also be noted that an expansion of more than 0.5 MGD for an existing facility will require that an environmental document be prepared by the applicant. The N.C. Environmental Policy Act and its associated rules requires that an environmental assessment (EA) and Fonsi (Finding of No Significant Impact) be prepared before application for a permit expansion is submitted. If deemed appropriate, an environmental impact statement (EIS) might be necessary. Monica Swihart of the Water Quality Planning Branch can provide further information regarding the EA requirement. As discussed in previous correspondence, the 7Q10 flow in the First Broad River has been revised downward based on projected expansions of upstream water treatment plants. North Carolina is evaluating all NPDES dischargers for ammonia toxicity following the Environmental Protection Agency (EPA) guidance to protect the waters for an instream criteria of 1 mg/1 in the summer and 1.8 mg/1 in the winter, under 7Q10 flow conditions. An acceptable level of chlorine in your effluent is 28 µg/1 to ensure protection against acute toxicity. The process of chlorination/dechlorination or an alternate form of disinfection, such as ultraviolet radiation, should allow the facility to comply with the total residual chlorine limit. -- The instream waste concentration (IWC) at 8.5 MGD is 23%. A chronic toxicity testing requirement with quarterly monitoring will remain a condition of the NPDES permit. A complete evaluation of limits and monitoring requirements for metals and other toxicants will have to be addressed at the time of formal NPDES application. Information concerning these constituents is not readily available but the Town can assume that effluent limits and/or monitoring for cadmium, chromium, nickel, cyanide, lead, copper, zinc, and silver will continue. DEM is implementing a basinwide water quality management initiative. Our schedule for the Broad River Basin is set for 1998. The plan will attempt to address all sources of point and nonpoint pollutants where deemed necessary to protect or restore water quality standards. In addressing interaction of sources, wasteload allocations may be affected. Those facilities that already have committed to high levels of treatment technology are least likely to be affected. This information should provide some assistance in our planning endeavors. Final NPDES effluent limitations will be determined after a formal permit application has been submitted to the Division. Ran model for BOD and NH3 limits, also did mass balance for NH3 toxicity limits. Recommended BOD based on oxygen consuming and NH3 based on toxicity. Toxicity analysis was done for metals, etc. However didn't incorporate the limits into the speculative letter. Gave basic generic statement that toxicity limits would be further evaluated New analysis indicated that several metals now limited would be reduced to monitoring requirements per this evaluation. New IWC and chlorine limits was also evaluated. IWC = (8.5 * 1.55) = 13.18 = 0.229* 100 = 22.9%= 23% (8.5*1.55) +44.3 57.48 Joe Pearce of Pretreatment says that Shelby plant is poorly designed at this time, also have operational problems and periods of high BODs. Current removal BOD rate is 75% and TSS removal rate is 77%. Influent BOD is 152 mg/I and goes out at 38 mg/l. Influent TSS is 127 mg/1 and goes out at 30 mg/I. New plant should do better. However, Shelby is working on their sludge problems first, not water quality treatment. The plant currently operates under NPDES Permit NC0024538 which expires on December 31, 1993. The permit has recently been renewed, and a new permit has been issued which expires on December 31, 1998. The new permit average monthly limits after completion of the upstream water treatment plant expansion in November 1994 are: 6.0 MGD Flow, 25.0 mg/1 BOD, 30 mg/1 TSS, 18.5 mg/1 NH3 as N, 200.0/100 ml Fecal Coliform. As a part of our planning, we would appreciate receiving an opinion regarding effluent limits which may be imposed on the City of Shelby's referenced wastewater treatment plant in permit renewals in the foreseeable future. We request that limits be evaluated for a future maximum monthly average flow of 8.5 MGD. The corresponding annual average flow is estimated to be 7.0 MGD. We realize that the treatment limits furnished by the Technical Support Branch are speculative at this time.
