Background: Revised stream flow information has been obtained from Water Resources on the 7Q10 flow estimates in the First Broad River due to proposed water plant expansions for Shelby and Cleveland County Sanitary District. Previous WLAs had used a summer 7Q10 of 70 cfs,Water Resources has determined that the 7Q10 will be reduced to 44.3 cfs at the WWTP discharge point. Facility has been notified by letter (11/20/92) of anticipated revisions in effluent . limits. Facility Name SHELBY-BROAD RIVER WWTP Permit # NC0024538_ Pipe # 001 _ CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT (QRTRLY) The effluent discharge shall at no time exhibit chronic toxicity using test procedures outlined in: 1.) The North Carolina Ceriodaphnia chronic effluent bioassay procedure (North Carolina Chronic Bioassay Procedure - Revised *September 1989) or subsequent versions. The effluent concentration at which there may be no observable inhibition of reproduction or significant mortality is _12_% (defined as treatment two in the North Carolina procedure document). The permit holder shall perform quartery monitoring using this procedure to establish compliance with the permit condition. The first test will be performed after thirty days from the effective date of this permit during the months of_ FEB MAY AUG NOV_. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B. Additionally, DEM Form AT-1 (original) is to be sent to the following address: Attention: Environmental Sciences Branch North Carolina Division of Environmental Management 4401 Reedy Creek Road Raleigh, N.C. 27607 Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Environmental Management indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate retesting(within 30 days of initial monitoring event). Other Special Items: N/A PART IV - EVALUATION AND RECOMMENDATIONS The applicant, City of Shelby, is requesting renewal of its permit for the discharge of treated wastewater. An on -site inspection revealed satisfactoryoperation and maintenance of the waste treatment facilities. The City is currently operating under the constraints of JOC No. 89-01 Ad because of inabilities to comply with the final effluent limitations for biochemical oxygen demand (BOD5), total suspended solids (TSS), and fecal coliform. A blackish colored effluent was prominent due to the contribution of wastewater from textile industries. The receiving stream is noticeably impacted due to the color. Facility Name SHELBY-BROAD RIVER WWTP Permit # NC0024538_ Pipe # 001 _ CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT (QRTRLY) The effluent discharge shall at no time exhibit chronic toxicity using test procedures outlined in: 1.) The North Carolina Ceriodaphnia chronic effluent bioassay procedure (North Carolina Chronic Bioassay Procedure - Revised *September 1989) or subsequent versions. The effluent concentration at which there may be no observable inhibition of reproduction or significant mortality is _17 % (defined as treatment two in the North Carolina procedure document). The permit holder shall perform quarterly monitoring using this procedure to establish compliance with the permit condition. The first test will be performed after thirty days from the effective date of this permit during the months of_ FEB MAY AUG NOV_. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Environmental Management indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate retesting(within 30 days of initial monitoring event). Concern about the accuracy of the revised 7Q10 flow is understandable considering the 37% reduction in estimated flow from 70 cfs to 44.3 cfs. According to your letter, you thought that the water withdrawals from the Cleveland Co. Sanitary District (CCSD) and City of Shelby had been included in the previous flow estimate of 70 cfs. It has been verified through USGS that the flow estimate given to our Branch in 1989 was based on natural stream flow without additions or withdrawals. USGS does not know the location of water supply intakes in relation to the gaging stations that record flow data, and therefore these intakes are not considered in the calculations and estimates of 7Q10 flow. The revised flow of 44.3 cfs given in the letter to Mr. Brickhouse was evaluated by the Division of Water Resources (DWR) in our Department. Our documentation indicates that DWR included data from a discontinued USGS gaging station on the First Broad River as well as the proposed water withdrawals from CCSD and Shelby. We are confident that the revised estimates are more accurate and than the 1989 flow estimates. I have a question concerning the calculations used to determine the flow. It appears that you have taken the total removal rate of both CCSD and the City of Shelby, instead of using only the additional withdrawal amount. My opinion of the 7Q10 at the WWTP: The 7Q10 of 1st Broad River = 70 cfs (45 mgd). This was determined while the water plant was extracting 15.5 cfs (10 mgd) and had been part of the 7Q10 at the WWTP.
