Nowell/3 THRU: Ruth Swanek 'R(� Carla Sanderson SUBJECT: Revision of Second Downstream Monitoring Site City of Shelby NPDES Permit No. NC0024538 Cleveland County The Technical Support Branch has been contacted by Mike Parker of the MRO concerning the second downstream monitoring site designated in the August 22nd letter to Mr. Don Rhom of Shelby. A recent trip to the recommended site (0.5 mile above mouth of First Broad River near State Road 1218) found that instream sampling is also inaccessible at this point. It is the recommendation of the MRO that the site be revised to the First Broad River just above the confluence of Beaverdam Creek. The river can be reached not too far from State Road 1148 which crosses Beaverdam Creek. Since this appears to be only accessible site for instream sampling to be taken, Technical Support requests that the draft permit be revised to include this site. The two downstream monitoring sites for the City of Shelby -Broad River WWTP should now be: 1) The First Broad River just above Sticey Shoals Dam 2) The First Broad River just above the confluence of Beaverdam Creek (The upstream monitoring site, 100 feet upstream of Shelby's discharge, shall remain the same.) Please be assured that your requests have been given thorough consideration. Our recommendations concerning these monitoring requirements are as follows: 1. Instream sampling at the mouth of the First Broad River. Our request for sampling at two downstream sites is based on the results of our Level B modeling analysis for the Shelby WWTP discharge. The model predicts that under low flow conditions in the First Broad River, the discharge causes two dissolved oxygen sags with the minimum DO level occurring at the mouth of the river. North Carolina regulation 15 NCAC 2B .0505(c)(2)(b) states that, "Sampling points shall be established in the receiving waters at ... at least one but not more that three downstream locations adequate... to measure impact of the discharge on receiving waters;". Your request for more accessible sampling at State Road 1140 is only 1.3 miles downstream of the first sampling site, above Sticey Shoals Dam. Sampling at SR1140 would not show the impact of the discharge at the predicted minimum DO sag point. If sampling at the mouth of the First Broad River is not possible, we recommend another site above the confluence of Yancey Creek. Our maps show that State Road 1218 has a section of unimproved road that ends approximately 0.2 miles from the First Broad River. We recommend the maintenance of two down- stream monitoring sites, however, the second downstream monitoring site should be revised to the point on the attached map. Please contact the Mooresville Regional Office, if this new site is inaccessible, for assistance in finding a mutually beneficial site. Pollution Prevention Pays P.O. Metal limits and testing. The effluent limitations and monitoring requirements for metals were determined after a review of Shelby's submitted pretreatment information. The submitted data do seem to indicate that limits have not been exceeded, but monitoring and limits are still necessary (Reference 15A NCAC 2B .0211(b)(3)(L)). But a review of data for copper and silver show that the plant is consistently exceeding the chronic values, 59.7 ug/1 and 0.5 ug/l, respectively, for these constituents. These values' are based on action levels (not water quality standards), therefore, limitations cannot be applied; however, based on the concentrations discharged, the monitoring requirements should not be removed (Reference 15A NCAC 2B .0211(b)(4)). 3. Toxicity Testing. The Technical Support Branch recommends that the quarterly chronic toxicity testing requirement remain the same. The designation of testing frequency is the policy of the Division of Environmental Management. Per the Division's Environmental Sciences Branch, "toxicity testing results obtained over time are independent of each other. Therefore, a facility must regularly perform toxicity tests since the results of a given test will not determine the results of subsequent tests. Temporal changes in the effluent composition could shift the concentrations at which toxicity occurred, thereby resulting in possible failure of the next sample tested. Tests conducted over time would provide a more accurate profile of effluent toxicity." The quarterly testing requirement is the minimum frequency given by the Division. Sampli g at the mouth of the First Broad River: There is o access to the mouth of the First Broad River except about a one (1) mile hike over very rough terrain. The most easy accessible point nearest to the mouth is at the bridge crossing on rural paved road 1140, this would be the preferred location. It is located 7.5 miles from the WWTP. The next best sampling point would be at the bridge where rural paved road no. 1148 crosses the river. (see inclosed map) Also', would prefer weekly or monthly sampling as opposed to three tiaes weekly. 2. Metal limits and testing: During the last half of 1990, weekly sampling of the effluent from the WWTP were performed. (results inclosed). They tend to show that the metals in the effluent are consistently lower than the limits you have specified in the draft permit. This WWTP is not equipped with the means to perform metal analysis. Therefore the cost of daily metals analysis would be in the neighborhood of one hundred fifty dollars ($150.00) daily or thirty six thousand dollars ($36,000.00) yearly. 3. Toxicity testing: The Shelby WWTP has been testing for toxity for the past two years and has "passed" each time.
