Expedited permits are generally simple 100% domestics (e.g., schools, mobile home parks, etc) that can be administratively renewed with minor changes, but can include facilities with more complex issues (Special Conditions, 303(d) listed water, toxicity testing, instream monitoring, compliance concerns). Facility Overview: The Days Inn West WWTP operates a facility with a permitted wastewater discharge of 0.02 MGD which receives 100% domestic wastewater and serves 20 employees and 112 rooms. The facility has an influent lift station, flow equalization basin, manual bar screen, extended aeration basin with dual blowers, rectangular hopper clarifier with skimmer and sludge return, aerobic sludge digester, tablet chlorinator and chlorine contact chamber, and tablet dechlorinator. Facility has a continuous discharge. A dye test was performed in September 2020 as part of a site inspection to determine the location of the outfall and was again done in October 2020 to confirm the exact pipe the discharge came from. The dye test revealed that outfall location on the map in the permit needs the arrow to be above (Northside) the 3 lane road (19/23/74) instead of below (Southside) the 3 lane road (19/23/74). The ARO inspector stated that the outfall was in the same watershed area, just on the other side of the DOT box culvert. The dye test also revealed that the discharge is in the high flow part of George Branch. The discharge location in the permit will remain as George Branch and applicable permit limits will continue using dilution. Page 1 of 8 Section 2. The current permit contains ammonia nitrogen limits for winter (November 1 - March 31) that are greater than 2 times those for summer (April 1 - October 31). A review of discharge monitoring data from August 2015 to June 2020 shows that the permittee will be able to meet stricter limits in winter a majority of the time. As such, the ammonia nitrogen limits for winter will be reduced per 15A NCAC 02B .0404(c). Page 3 of 8 NPDES Implementation of Instream Dissolved Metals Standards - Freshwater Standards The NC 2007-2015 Water Quality Standard (WQS) Triennial Review was approved by the NC Environmental Management Commission (EMC) on November 13, 2014. The US EPA subsequently approved the WQS revisions on April 6, 2016, with some exceptions. Therefore, metal limits in draft permits out to public notice after April 6, 2016 must be calculated to protect the new standards - as approved. Table 1. However, application of the dissolved and hardness -dependent standards requires additional consideration in order to establish the numeric standard for each metal of concern of each individual discharge. The hardness -based standards require some knowledge of the effluent and instream (upstream) hardness and so must be calculated case -by -case for each discharge. Metals limits must be expressed as `total recoverable' metals in accordance with 40 CFR 122.45(c). The discharge -specific standards must be converted to the equivalent total values for use in the RPA calculations. We will generally rely on default translator values developed for each metal (more on that below), but it is also possible to consider case - specific translators developed in accordance with established methodology. RPA Permitting Guidance/WQBELs for Hardness -Dependent Metals - Freshwater The RPA is designed to predict the maximum likely effluent concentrations for each metal of concern, based on recent effluent data, and calculate the allowable effluent concentrations, based on applicable standards and the critical low -flow values for the receiving stream. If the maximum predicted value is greater than the maximum allowed value (chronic or acute), the discharge has reasonable potential to exceed the standard, which warrants a permit limit in most cases. If monitoring for a particular pollutant indicates that the pollutant is not present (i.e. consistently below detection level), then the Division may remove the monitoring requirement in the reissued permit. 1. To perform a RPA on the Freshwater hardness -dependent metals the Permit Writer compiles the following information: Page 5 of 8 • Critical low flow of the receiving stream, 7Q10 (the spreadsheet automatically calculates the 1Q10 using the formula 1 Q 10 = 0.843 (s7Q 10, cfs) 0.993 • Effluent hardness and upstream hardness, site -specific data is preferred • Permitted flow • Receiving stream classification 2. In order to establish the numeric standard for each hardness -dependent metal of concern and for each individual discharge, the Permit Writer must first determine what effluent and instream (upstream) hardness values to use in the equations. The permit writer reviews DMR's, Effluent Pollutant Scans, and Toxicity Test results for any hardness data and contacts the Permittee to see if any additional data is available for instream hardness values, upstream of the discharge. If no hardness data is available, the permit writer may choose to do an initial evaluation using a default hardness of 25 mg/L (CaCO3 or (Ca + Mg)). Minimum and maximum limits on the hardness value used for water quality calculations are 25 mg/L and 400 mg/L, respectively. If the use of a default hardness value results in a hardness -dependent metal showing reasonable potential, the permit writer contacts the Permittee and requests 5 site -specific effluent and upstream hardness samples over a period of one week. The RPA is rerun using the new data. The overall hardness value used in the water quality calculations is calculated as follows: Combined Hardness (chronic) = (Permitted Flow, cfs *Avg. Effluent Hardness, mg/L) x (s7Q 10, cfs *Avg. Upstream Hardness, mg/L) (Permitted Flow, cfs + s7Q10, cfs) The Combined Hardness for acute is the same but the calculation uses the 1Q10 flow. 3. The permit writer converts the numeric standard for each metal of concern to a total recoverable metal, using the EPA Default Partition Coefficients (DPCs) or site -specific translators, if any have been developed using federally approved methodology. Page 6 of 8 EPA default partition coefficients or the "Fraction Dissolved" converts the value for dissolved metal at laboratory conditions to total recoverable metal at in -stream ambient conditions. This factor is calculated using the linear partition coefficients found in The Metals Translator: Guidance for Calculating a Total Recoverable Permit Limit from a Dissolved Criterion (EPA 823-B-96-007, June 1996) and the equation: Cdiss Ctotal 1 1 + { [Kpo] [SS(l+a)] [10-6] } Where: ss = in -stream suspended solids concentration [mg/1], minimum of 10 mg/L used, and Kpo and a = constants that express the equilibrium relationship between dissolved and adsorbed forms of metals. A list of constants used for each hardness -dependent metal can also be found in the RPA program under a 4. The numeric standard for each metal of concern is divided by the default partition coefficient (or site -specific translator) to obtain a Total Recoverable Metal at ambient conditions. In some cases, where an EPA default partition coefficient translator does not exist (ie. silver), the dissolved numeric standard for each metal of concern is divided by the EPA conversion factor to obtain a Total Recoverable Metal at ambient conditions. This method presumes that the metal is dissolved to the same extent as it was during EPA's criteria development for metals. For more information on conversion factors see the June, 1996 EPA Translator Guidance Document. 5. The RPA spreadsheet uses a mass balance equation to determine the total allowable concentration (permit limits) for each pollutant using the following equation: Ca = (s7Q 10 + Qw) (Cwqs) — (s7Q 10) (Cb) Qw Where: Ca = allowable effluent concentration (µg/L or mg/L) Cwqs = NC Water Quality Standard or federal criteria (µg/L or mg/L) Cb = background concentration: assume zero for all toxicants except NH3 * (µg/L or mg/L) Qw = permitted effluent flow (cfs, match s7Q 10) s7Q 10 = summer low flow used to protect aquatic life from chronic toxicity and human health through the consumption of water, fish, and shellfish from noncarcinogens (cfs) * Discussions are on -going with EPA on how best to address background concentrations Flows other than s7Q 10 may be incorporated as applicable: 1 Q 10 = used in the equation to protect aquatic life from acute toxicity Page 7 of 8 QA = used in the equation to protect human health through the consumption of water, fish, and shellfish from carcinogens 30Q2 = used in the equation to protect aesthetic quality 6. The permit writer enters the most recent 2-3 years of effluent data for each pollutant of concern. Data entered must have been taken within four and one-half years prior to the date of the permit application (40 CFR 122.21). The RPA spreadsheet estimates the 95th percentile upper concentration of each pollutant. The Predicted Max concentrations are compared to the Total allowable concentrations to determine if a permit limit is necessary. If the predicted max exceeds the acute or chronic Total allowable concentrations, the discharge is considered to show reasonable potential to violate the water quality standard, and a permit limit (Total allowable concentration) is included in the permit in accordance with the U.S. EPA Technical Support Document for Water Quality - Based Toxics Control published in 1991. 7. When appropriate, permit writers develop facility specific compliance schedules in accordance with the EPA Headquarters Memo dated May 10, 2007 from James Hanlon to Alexis Strauss on 40 CFR 122.47 Compliance Schedule Requirements. 8. The Total Chromium NC WQS was removed and replaced with trivalent chromium and hexavalent chromium Water Quality Standards. As a cost savings measure, total chromium data results may be used as a conservative surrogate in cases where there are no analytical results based on chromium III or VI. In these cases, the projected maximum concentration (95th %) for total chromium will be compared against water quality standards for chromium III and chromium VI. 9. Effluent hardness sampling and instream hardness sampling, upstream of the discharge, are inserted into all permits with facilities monitoring for hardness - dependent metals to ensure the accuracy of the permit limits and to build a more robust hardness dataset. 10. Anyhow, I work with Water Quality (used to be DENR) in the Asheville Office and am trying to figure out the best option for one of our Permitted Wastewater Treatment Plants (WWTP), the Days Inn at the East Canton exit. This WWTP and its discharge line have been in place for decades (1980's). My Agency was informed decades ago that the Days Inn discharge line went to Georges Branch, however it does not, it goes to an Unnamed Tributary (UT) to Georges Branch. Both the UT and Georges Branch are within the DOT ROW; this ROW is where the UT and George Branch flow together and are fortunately daylighted (not culverted). I spoke with Greg Benton and he could not find any documentation of this from way back when; he suggested I contact you to see how to proceed. And I met with Chad Young last week to verify the location of the discharge line from the Days Inn WWTP via a dye test. So, we've done a bit of work figuring out what we are dealing with here; however this discharge line likely needs to be extended "40-50' along the Unnamed Tributary (UT) down to George Branch within the DOT ROW. No road crossings, just a pipe extension. Chad said he would speak with you regarding this line and its location, so I have included him here. I attached a Google Earth image to assist you. I "attempted" to draw in the UT (the lighter blue line), George Branch, the Days Inn line that has been there for decades and the extension that may be needed. I hope this helps. TRANSPORTATION INDUSTRY IS TAKING TO STOP THE SPREAD OF COVID-19 The North Carolina Department of Transportation (NCDOT) and their partners expect all parties involved in the delivery of transportation projects to abide by the guidelines issued from the Centers for Disease Control and Prevention (CDC) and the North Carolina Department of Health and Human Services (NCDHHS). Response to COVID-19 is rapidly evolving; new information and guidelines may be issued from the CDC, NCDHHS, or other state or federal agencies. NCDOT and their partners should review the current CDC and NCDHHS guidance, including the resources listed at the end of this document, for up-to-date information on how to respond to COVID-19. Additional guidelines may be issued by state or federal agencies that should be followed in addition to the guidance included in this document. Though certain Americans with Disabilities Act (ADA) requirements have been relaxed in response to the pandemic, employers must still maintain all information about employee illness as a confidential medical record in compliance with the ADA. If an employee is suspected of having or tests positive for COVID-19, it is essential that management keep the identity of the employee and details related to the employee's health confidential. Below are precautions required by NCDOT and from encroaching parties and their contractors performing construction within NCDOT Rights of Way. The term employee refers to any person on a job site within NCDOT right of way for the purpose of constructing or inspecting the work related to construction of a facility under an approved encroachment agreement and where that employee may or may not be under employment by or under contract to NCDOT. EMPLOYEE WELLNESS • If an employee has not yet reported to work and develops any COVID-19 symptoms (i.e. fever, coughing, or shortness of breath) — STAY HOME and immediately: o Call a health care provider o Self -Isolate o Communicate with your supervisor o Remain calm and follow all instructions from your health care provider • Employees who appear to have acute respiratory illness symptoms (i.e. cough, shortness of breath) upon arrival to work, or become sick during the day, should be separated from others and sent home immediately. PERSONAL HYGIENE • Clean hands often by washing with soap and water for 20 seconds. If soap and water are not available and hands are not visibly dirty, an alcohol -based hand sanitizer that contains 60%-95% alcohol may be used. • Avoid touching your eyes, nose, mouth, or other parts of your face. • Do not breathe, cough, or sneeze on another person or into the open air. Employees should cover their noses and mouth with a tissue when coughing or sneezing (or an elbow or shoulder if no tissue is available). • A facemask for covering nose and mouth is encouraged on the job site. • Appropriate gloves are encouraged while performing functions of the job. CLEANING/DISINFECTING • Wash stations and/or hand sanitizer are encouraged on each project site. • Appropriate cleaning staff should clean frequently touched surfaces and objects with disinfectants at a minimum of once per day. o Office/buildings: door knobs, light switches, phones, computers/keyboards, copy machines, elevator buttons, toilets, faucets, sinks, countertops, paper towel dispensers, desktops, handrails, folders, vending machines, counters, tables, cabinets/knobs, etc. o Shop Yard/Jobsite: vehicle/equipment door handles, keys, gear shifts, steering wheel/operator controls and levers, fuel pump dispensers, touch points on machinery, etc. o Electronic equipment: cell phones, computers, keyboards, etc. • Appropriate cleaning staff should sanitize/disinfect facilities and work areas after persons suspected/confirmed to have COVID-19 have been in the facility or work area. GENERAL • Increase communication measures between all parties regarding schedule, daily activities, etc. to reduce/minimize worker exposure in accordance with but not limited to the requirements below. • Minimize on -site personnel such as subcontractors, work crews, QC personnel, and inspection staff to those required for that day's activities. If work is postponed or cancelled, immediately notify appropriate parties. • Practice "Social Distancing" whenever feasible. Social Distancing is designed to limit the spread of a disease by reducing the opportunities for close contact between people. All personnel have the responsibility to remind each other to stay 6 feet or more apart. Examples of Social Distancing include: o Reducing face-to-face exposure by using conference calls and video conferencing ■ If an in -person meeting is absolutely required and cannot be rescheduled or attended remotely, the meeting is limited to a maximum of 10 people while maintaining Social Distancing of 6 feet or more. o Avoiding unnecessary travel • Do not congregate at lunch or breaks. Bringing your lunch is encouraged. • No communal coolers or drink stations are allowed. Supervisors should confirm with employees prior to beginning work for appropriate hydration and nutrition availability to employees for the duration of the employee's shift and without direct contact with others on the job site. • First line of communication should be by phone, rather than in -person. • Do not shake hands. • Do not share iPads, tablets, pens, or clipboards for signing or any other purpose. Take pictures as proof of attendance at meetings. • Sharing of Personal Protective Equipment (PPE) is strictly prohibited. • Vehicles, equipment, and tools o Limit the number of people riding in a vehicle together. o Wipe down and disinfect vehicles after each trip. o As much as possible, do not share tools or equipment. If a tool or piece of equipment must be shared, the parts of it that are touched should be sanitized between uses. Depending on what I find, I have concerns for the Permittee. Brianna we touched on this on the phone but the closer I looked the more I am concerned. Let me explain. If it is indeed going to Georges Branch, then the limits won't need to change as drastically. However, if the discharge is going to the UT and the NH limits are dropped considerably then we should give them a timeline to prepare for the lower "0" flow NH limits. It is the MA that will be tough to meet. I looked at their DMR data from 1-2018 to present and there would have only been one DM violation (which only would have generated a NOV), however their MA for that timeframe would have generated 11 Civil Penalties. They would need a reasonable amount of time to come into compliance with such low NH limits. I don't know if "operations" alone can meet a 2 and 4 MA, they may have to install tertiary treatment to meet those numbers, which would be a large expense. This is not a stream standard violation scenario, regardless of which stream they discharge to, it is a highly modified DOT Interstate ROW culverted stream. Decades ago someone may have misrepresented where they discharge and now that I may have found out differently, we would be setting them up for failure immediately if we don't offer a timeline. More specifically, the answer is not yet - and maybe not at all. Sections 402(o)(2) and 303(d)(4) of the CWA and federal regulations at 40 CFR 122.44(1) prohibit backsliding of effluent limitations in NPDES permits. These provisions require effluent limitations in a reissued permit to be as stringent as those in the previous permit, with some exceptions where limitations may be relaxed (e.g., based on new information, increases in production may warrant less stringent TBEL limits, or WQBELs may be less stringent based on updated RPA or dilution). We have new information, but that information may not change the basis for the limits. I've attached the WLA summary pages from 1996. The Travel Center had a prior permit that was rescinded before it received NC0085952. 2 Max Haner talked with Jackie Nowell about the discharge location and the basis for the tertiary limits. His original staff report listed George Branch as the receiving stream, but his discussion with Jackie led to both parties agreeing that is was a discharge to a UT. If the effluent now travels through a DOT culvert to reach George Branch, the culvert is considered an unnamed tributary. 15A NCAC 02B allows for effluent channels [see attachment], but a DOT culvert doesn't qualify per 15A NCAC 02B.0228 (1). Unless the Travel Center has its own pipe directly to George Branch, the UT restriction would remain, as would the current limits. However, since your email stated that the Travel Center and the Days Inn have the same receiving stream, we may have to consider tighter limits for NC0025933. If Days Inn has their own pipe directly to George Branch, they're fine. If they are discharging to the DOT culvert, they are discharging to a UT with zero flow. To change existing permit limits without a request from the permittee, the permit has to be reopened by the Director. That's rarely allowed, and particularly unlikely now. IF the Travel Center has its own line to George Branch they could request a major permit modification, and pay the major mod fee. We would need updated 7Q10 data for George Branch, as the data used to permit NC0025933 and NC0085952 is >20 years old. We would also require an EAA. What is the sewer availability for the Travel Center today? It's been 22 years since the it received NC0085952, and the available sewer lines could be much closer. Simply put, the solution for a facility that doesn't meet limits is not "just give them softer limits". Two different sections of the Clean Water Act prohibit that. The best option for the Travel Center is to get out of the wastewater business. Connection to a POTW would solve their compliance problems and eliminate the associated costs. I'll put a copy of this email in the file for both NC0085952 and NC0025933. This issue will be addressed during the permit renewals in 2020 if the Travel Center does not request a major mod before then. The receiving stream Latitude and Longitude and outfall location depicted in the permit is incorrect. The reason for the incorrect information is the receiving streams are culverted by DOT for Hwy 40, Hwy 70 and Wiggins Rd. You will note that Days Inn has normal limits, whereas Candler Travel has restrictive limits. I looked at the original sheet for Candler Travel; Max Haner must not have considered this. ARO staff have field verified the outfalls and receiving stream for both facilities. The correct receiving stream for both is George Branch, Latitude and Longitude is 35 32' 27" N/82 45' 8" W. Please take this into consideration. Landon's (ARO) request (email May 9): Charles - Linville Falls and Candler Travel Plaza are two facilities where staff are concerned that the limits may be too restrictive. Linville Falls has had a technical assistance review and found no recommendations. I've also have Dan Boss review the operation and he generally agreed that it could be difficult to meet the permit limits. With regard to Candler, Linda believes the discharge may actually be to a larger stream than the permit indicates.
