Phelps, Harry T. Phelps, Jr., & Michael Todd Phelps, has submitted the attached application for a CAMA Major Permit to conduct new channel & canal entrance excavation in order to deepen the existing, eroded shallow water connection to an existing man-made U- shaped basin, and construct a bulkhead, boat ramp, two boat lifts, and a building with a lean to within & adjacent to the basin, respectively. The project site is located at 234 Albemarle Shores Extension (off SR 1237) near Columbia, adjacent a man- made U- shaped basin connected to an area of the Albemarle Sound commonly referred to as Bull Bay in Tyrrell County, North Carolina. The 7 parcels covered under this application total ±42 acres in size, the majority of which is fallow farmland located on the southern side of the tract. The project site is located on the western end of Albemarle Shores Subdivision ±1 mile west of the mouth of the Scuppernong River in Bull Bay of the Albemarle Sound. The western half of the ±1,300 linear feet of Sound frontage shoreline of the project consists of a natural wetland fringe, while the eastern half consists of upland residential lots. The residential lots consist of native lawn grasses, trees, and shrubs, and are elevated ±4' above normal water level (NWL). The wetlands consist of native, hardwood wetland tree species and a stand of Phragmites spp. in the eroded areas. This swamp fringe averages 200' wide, and has a small gut connected to the canal running through the middle of the wetlands, parallel to the Sound. There are no Coastal Wetlands on the site. Existing development on the residential lots include three single family dwellings with concrete driveways that all lead to one gravel access, all of which were constructed in 1991, a contiguous wooden bulkhead, and two residential pier structures in Albemarle Sound. There exists a U- shaped man-made basin on the property with natural shoreline with the exception of a return wall on the western side of the developed lots connected to the Sound frontage bulkhead. This connection separates the existing wooded wetlands from the developed portion of the Sound front. The two fingers of the U- shaped basin currently extend ±950' landward of NWL of Albemarle Sound, and range from ±90' wide to as much as ±150' wide in an area of the eastern finger due to storm erosion. The eastern finger of the U- shaped basin was formerly a wooded wetland finger that was begun to be excavated in 1988. CAMA General Permits were also issued during this time to stabilize the Sound frontage of the lots with a stacked concrete bridge piling structure. CAMA Major Permit No. 73 -92 was issued on 31 July 1992 to replace the concrete bulkhead with a wooden bulkhead and construct groins, a pier, boat ramp, and a swimming pool associated with Harry T. Phelps' home. In 1999, the western finger of the U- shaped basin, which was formerly upland farm land, was dug and connected to the other finger to create the U- shape; however, the man-made excavation did not connect the basin to the Albemarle Sound. Over the course of ±10 years since the wooden bulkhead was installed in 1992, the adjacent wetland has been impacted by natural erosion, and accelerated erosion has occurred adjacent the bulkhead return wall. Hurricane Isabel damaged the western corner of the bulkhead in 2003, and the replacement bulkhead was installed in 2005 with a much longer return wall than the previous structure. An area of natural high ground existed between Albemarle Sound and the man-dug portion of the basin until it was breached in the Fall of 2005 due to erosion, creating a surface water connection. A correspondence was sent to Mr. Phelps on 7 September 2005 from DCM that notified him that DCM had jurisdiction within the basin area due to its recent connection via erosion. Harry T. & Shirley C. Phelps, Jr., & Michael Todd Phelps Man-made basin & Bull Bay of Albemarle Sound Page 2 of 3 The man-made basin has an average excavated depth of 4, the naturally eroded canal entrance is ± -2' deep and ±30' wide, and Bull Bay of the Albemarle Sound is ± -3' deep at the channel entrance and deepens to 4 at ±160' waterward of the channel entrance. Albemarle Sound at this location is ±10 miles wide. The riparian property to the west (upstream) is a single - family residence with a pier structure, located ±750' from the project site canal entrance, and is the most eastern dwelling of Bulls Bay Subdivision. The riparian property to the east (downstream) is a single - family residence with a pier structure, located ±650' from the canal entrance, and is within the Albemarle Shores Subdivision. The adjacent subdivision to the east is Colonial Beach. There are no known SAV's located within the proposed project area. Albemarle Sound is classified SB by the Environmental Management Commission, and is closed to shellfishing. There are no documented archaeological sites on the applicant's property. Project Description The applicant proposes to excavate the open water connection with a new canal entrance 310' long by 50' wide (15,500 ft2), and excavate a 206' long by 50' wide (10,300 ft2) channel into Estuarine Waters (EW), Public Trust Area (PTA) Area of Environmental Concern (AEC) of Albemarle Sound, which will be to a connecting water depth of 4. Average existing water depths are -2.5' and -3' in the canal entrance and access channel, respectively. In addition, a 520 ft2 area of the canal's southeast corner of uplands at the landward end of the bulkhead return wall will be excavated to 4 deep in order to widen the canal entrance into the basin for boating safety and to promote better flushing. All of the near shore project excavation will be done by an excavator sitting on land with a clamshell bucket. Each bucket of material will be transferred to a dump truck and hauled to an onsite, upland spoil area surrounded by silt fence. The channel excavation will either be conducted using an excavator on mats that will transfer material to a dump truck or by a barge mounted excavator with a containment structure. If done by barge, the excavator will empty the clamshell bucket into a containment structure on the barge. The barge will be moved adjacent shore where the containment structure will be emptied by a backhoe, to a dump truck, and moved to the designated onsite spoil area. The applicant proposes to install 3,520' of vinyl bulkhead around the U- shaped basin. The alignment will average 1' waterward of NWL and be a maximum of 42' waterward of NWL in the eastern finger of the U -shape to reclaim land lost by storm erosion. Backfill material will come from dried material from the spoil disposal site and an upland source, if necessary. The bulkhead will be tied into the existing return wall of the Sound frontage bulkhead on the eastern side of the channel entrance, and it will return westward ±40' along the wetland line on the west side of the bulkhead project. In order to straighten the alignment of the U- shaped basin, there will be a total of 8,001 ft2 of upland excavation and 4,573 ft2 of filling of EW, PTA AEC. The upland land disturbance associated with an average 10' wide tieback area for the bulkhead installation will cover 35,200 ft2. The maximum area of filling waterward of NWL for the bulkhead installation will cover an 8,754 ft2 area to create uplands to construct a building outside the 30' AEC. The 80' long by 40' wide (3,360 ft2) building will be metal framed for storage of an RV, boat and other items, and will have an attached 40' long by 20' wide (800 Harry T. & Shirley C. The building location adjacent the basin will primarily serve as one of the temporary spoil areas, and the spoil areas will cover 2,677 ft2 of grassy uplands, excluding the footprint of the building and lean to. Existing County water supply will be hooked up to the new building. a There is a proposed boat ramp and two boat lifts proposed within the basin adjacent the building as boating access amenities for the project. The entire 80' long by 12' wide concrete boat ramp will constitute fill within the basin; however, final project appearance after the bulkhead is installed, will have a 30' land approach. A 468 ft2 area within the basin at the end of the ramp will be excavated to 4' due to existing -2' depth currently at this location. Two uncovered 15' long by 15' wide (225 ft2 each) boat lifts will be installed on 4 piling sets each adjacent the building and ±90' apart. They will be located in -3.5' water depths and over 1,000' to the nearest docking facility and/or riparian property line. The eastern basin finger will be f 110' wide at their location. Anticipated Impacts Total excavation within EW, PTA AEC will be 10,300 ft2 (381 yds3) of new channel in Albemarle Sound, 15,500 ft2 (861 yds3) of new canal entrance to the basin, and 468 ft2 (35 yds3) at the end of the proposed boat ramp within the basin. Total upland excavation within the ES AEC will be 520 ft2 (116 yds3) for canal entrance widening and 8,001 ft2 (1,483 yds3) to straighten the bulkhead around the U- shaped basin. Total fill within EW, PTA AEC will be 8,754 ft2 (1,297 yds3) of land recovery to backfill the bulkhead adjacent the roposed building, 4,573 ft2 (508 yds3) to straighten the U- shaped basin bulkhead, and 960 ft (71 yds ) for the concrete boat ramp installation. Total upland fill partially located within the ES AEC will be 3,360 ft2 for the building structure roof dripline, 800 ft2 for the lean- to off the building, and 2,677 ft2 for the portion of temporary spoil pile located outside the building footprint area. Total upland land disturbance for the installation of the bulkhead tieback area around the basin will be 35,200 ft2. There will be some short-term turbidity during sheet and pile installation. There are no proposed impacts to wetlands or SAV for this project. The proposed building and existing impervious features on the project site will be 0.1% impervious surfaces within the Estuarine Shoreline (ES) AEC, and 0.01% impervious surfaces over the entire project site. Michael Todd Phelps 214 Albemarle Shores Road, Columbia, NC 27925 Existing Conditions The subject property is located on Bull Bay in Tyrrell County, North Carolina and consists of approximately 42 acres (1 large parcel and three smaller residential parcels on Bulls Bay). The property is accessible from Albemarle Shores Road (SR 1237). The subject property consists of four soundfront lots and one larger parent tract. Harry T. Phelps, Sr. and Shirley C. Phelps own the large parcel and two of the soundfront lots as depicted on the CAMA plan. Mr. Phelps' sons, Harry T. (Tommy) Phelps, Jr. and Michael Todd Phelps own the other two soundfront lots. There is a small designated common /community picnic area near the basin entrance on one of the lots. Over the years, this community area has dramatically decreased in size from erosion. The common area is an easement on property owned Harry T. Phelps, Sr. who is an applicant. The large parcel is part of a former 120 acre tract that had been referred to as South Fork Farms, the majority of which was sold to the State of North Carolina in 2008. The property contains a man -made basin that is now connected to Bull Bay through storm erosion and has been for ten years or more. There are also approximately 3 acres of jurisdictional wetlands on the property. The uplands consist of an agricultural field except for the bay front lots, two of which include homes. The approximate wetlands location is depicted on the CAMA plan. The extent of wetlands on the tract was field evaluated by USACE in 2006. The basin has been and is intended to continue to be utilized by the Phelps family for boating. Their bay front lots include piers, but rough conditions present make it difficult for boat slips. The basin offers a calm and easy boating access location, however, the area near the mouth of the basin and the channel entering the basin are shoaled in which makes it difficult or impossible to navigate through during lower than normal wind tides. The U- shaped basin was originally permitted and excavated without a connection to the Sound. A bulkhead was permitted along the soundfront shoreline with a wing -wall adjacent to a Section 404 wetlands area. Natural erosion of the wetland area created the connection that exists today. The upland areas around the basin are eroding at varying rates, but Irene caused substantial bank collapse and erosion (up to 15 ft in some areas) based on aerial photography and observations by Mr. Phelps. In 2006, in association with a potential development plan, an inter - agency scoping meeting was held in Washington, NC to discuss existing and proposed development activities. That development plan was never implemented and a large portion of the property was subsequently sold to the State of North Carolina. Prior to the 2006 scoping meeting, there was an earlier development plan (2005) that included residential lot development. In association with that plan (which never was adopted) an Erosion Control and Sedimentation Control Plan was created and approved by DLR, Land Quality Section. Previous CAMA permits that have been issued for the property include: 1. CAMA Major 72 -92, 7/31/1992, Harry Phelps; issued for bulkheading, piers and jetties (not all work has been complete) 2. CAMA GP 40579B, 5/24/2005, Harry Phelps; issued for bulkheading 3. CAMA GP 54783B, 11/23/2009, Harry Phelps; issued for bulkheading 4. CAMA GP 54784B, 11/23/2009, Tommy Phelps; issued for bulkheading The shallow water sound bottom consists of exposed clay and sand. A SAV analysis was performed in 2006 in Bulls Bay adjacent to the property and also in the existing basin. No rooted SAV was observed in this area during this early October survey. Based on notes from the 2006 scoping meeting, Ms. Sara Winlsow (former DMF representative) has not known this to be an SAV area, likely from the high wave energy, especially from NE wind events. In our experience, clayey substrates do not provide a quality SAV habitat either. A cursory SAV analysis was also performed by Quible in June 2012 and no rooted SAV was discovered, only some ripped up SAV, presumably from a different area of the sound. Proposed Work New Dredging: The purpose of the proposed dredging is to maintain adequate water depths along the entrance to and within the existing man -made canal /basin and channel connected to Bull Bay so that there is safe ingress and egress. The bay bottom here consists of a natural submerged swale and bar sequence without a consistent deep water access. Within the basin entrance leading from the basin to the bay, there has been recent accumulation of sediment. The attached calculation sheet, application and CAMA plan break new excavation into channel versus canal. There is also proposed excavation in the canal where it connects with the basin. This involves 520 sq.ft. of material removal to enhance flushing by widening this connection in a bell -shape fashion. There is a significant amount of wind tide, with extreme low tides being somewhere on the order of 2 ft lower than normal. We have identified the area in current need of dredging and have estimated there to be approximately 1,242 cu yds of material to be removed, in addition to the 35 cu yds of material associated with boat ramp area excavation (1,277 cu yds below NWL) and 116 cu yds of material associated with entrance widening. The excavation work will be performed with the use of a barge mounted and/or land based excavator using a clamshell bucket. A barge mounted excavator will dig material from the maintenance area onto a material (hopper) barge with sides. Use of a clamshell bucket minimizes the amount of bottom disturbance, and when the bucket is fully loaded, the amount of water transferred to the barge is minimal. The barge, when loaded, will be moved inside the basin and the material will be transferred to a designated soil stockpile area adjacent to the basin. If excavation is from land and mats instead of barge, the full bucket of material will be directly transferred to a dump truck and then it will be transferred to the stockpile /disposal area prior to being dried and used as bulkhead backfill. Erosion Control Bulkheading: It is proposed that the basin be bulkheaded. The shoreline of the basin suffers from collapse mass wasting as well as slow erosion. This erosion adds sediment and increased turbidity to the natural system while eating away at the existing uplands and associated buffers. No bulkheading or backfill is proposed in wetlands. The total length of proposed bulkhead is 3,520 ft. The calculation sheet includes estimates of excavation and fill associated with the bulkhead. 2 Established Slips With Lifts: The owner currently ties up two boats in the basin. There are no additional slips proposed at this time and the owner does intend to permit lifts at each of the tie - up locations shown on the plan. Boat Ramp: A 12 ft wide concrete boat ramp is proposed as depicted in plan view and in cross - section. The calculation sheet includes estimates of excavation and fill associated with the boat ramp. Upland Development: A metal accessory structure to house an RV, boat and other items is proposed as depicted. This includes a lean -to shed style roof on the waterward side. In order to maintain enough buildable area landward of the 30 ft buffer, approximately 8,754 sq.ft. of eroded shoreline is proposed to be filled and permanently established with bulkhead. The total land disturbance associated with the work as proposed is 42,557 sq.ft. The purpose of the proposed dredging is to maintain adequate water depths along the entrance to and within the existing man- made boat basin and channel connected to Bull Bay/ Albemarle Sound so that there is safe ingress and egress. In recent years there has been a significant amount of shoaling and accumulation of sediment, especially in the bottleneck canal leading from the basin to the Sound. Within the Sound, there has not been a consistent deep water connection (to 4) and there is a natural submerged swale and bar system. c. Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type of equipment and where it is to be stored. The new and maintenance excavation work will be performed with the use of a barge mounted and/or land based excavator using a clamshell bucket. Piles and bulkhead sheeting will either be driven or jetted in place. d. List all development activities you propose. There is a significant amount of wind tide, with extreme low tides being somewhere on the order of 2 ft lower than normal. We have identified the area in current need of dredging and have estimated there to be approximately 1,242 cu yds of material to be removed. It is proposed that the basin be bulkheaded. The shoreline of the basin suffers from collapse mass wasting as well and slow erosion. This erosion adds sediment and increased turbidity to the natural system while eating away at the existing uplands and associated buffers. No bulkheading or backfill is proposed in wetlands. The owner currently ties up two boats in the basin. There are no additional slips proposed at this time and the owner does intend to permit lifts at each of the tie -up locations shown on the plan. Also proposed is a 12 ft wide concrete boat ramp as depicted in plan view and in cross - section. Lastly, a metal structure to house an RV, boat and other items is proposed as depicted. This includes a lean -to shed style roof on the waterward side. In order to maintain enough buildable area landward of the 30 ft buffer, approximately 8,754 sq.ft. of eroded shoreline is proposed to be filled and permanently established with bulkhead.
