Also, I included an image below the matrix table as a visual reminder of the project (I actually used this to help explain the regulatory aspects of the project to the folks I am supporting, but included it here because you probably see many projects). Stephanie, If possible, I would like to continue pursuing NCDEQ approval for the Duke Energy overhead line project along New Bethel Road in Garner. Unfortunately, storm related activities often disrupt the normal work schedules for me and my peers, so now I can get back to this project. During a recent site visit, I marked the point where the riparian buffer Zone 1/Zone 2 line intersects the Perpendicular/Parallel impacts line as a reference, and the project folks I support stated that the right-of-way for the overhead line will need to encroach into Zone 1 approximately ten feet. The project impacts will still remain at least ten feet from the edge of the creek; however, this means that the project needs NCDEQ approval. That said, I wanted to address any remaining concerns, including any from an earlier email and ask what information you still need. Below is what you emailed to Jimmy Perry on January 4: 1. Please provide a plan view of the lot layout and infrastructure (roads, utilities, stormwater, etc.) for the entire proposed development overlaid on a survey of the streams and/or wetlands. This plan is necessary to evaluate avoidance and minimization measures and potential indirect impacts for the project. 2. The Johnston County paper soil survey depicts multiple stream features potentially within the extension. Please indicate the project boundary on the paper soil survey of Johnston County. I plan to visit the site again tomorrow with a measuring tape, but I think the project may be slightly into the Allowable Upon Authorization category (qq, as you indicated). That said, and this is a check of my understanding, if I measure 50 feet from the top of the bank in the perpendicular crossing section and I'm 30 feet or more from the top of the "parallel" bank as I enter the parallel impact section, then the parallel impact is Zone 2 and would be classified Deemed Allowable, yes? I lean towards this project being a Deemed Allowable use as it appears to fit the definition in 0714(pp)(i) because we are crossing the creek in a perpendicular fashion, will disturb less than 150 linear feet (severe trimming of three trees), and do not need to encroach within 10 feet of the creek edge. However, the creek has an immediate bend parallel to the needed right-of-way which then bends the buffer into the right-of-way. Easier to see than describe. In your email below you ask about the method of buffer determination, which confused me. I identified this area as being affected by Neuse River riparian buffer rules because this creek appears to be a tributary of the Neuse River using available mapping resources, including through the NCDEQwebsite. I may be misunderstanding your comment/question. Regardless, I will attempt to review/correct the information we originally provided to the NCDEQ this weekend to find any errors or missing information.
