The below referenced FINAL As -Built Monitoring Report review has been requested by Water & Land
Solutions, LLC. Per Section 332.8(o)(9) of the 2008 Mitigation Rule, this review follows the streamlined review
process, which requires an IRT review period of 15 calendar days from this email notification. Please provide
any comments by 5 PM on the 15-day comment deadline shown below. Comments provided after the 15-day
comment deadline (shown below) may not be considered.
SITE VISIT: Please note, it is my intention to schedule a site visit; however, given how booked the IRT is right
now, I will likely issue the as -built credit release prior to our site visit. Based on the IRT's current schedule, it
looks like April 14th or 15th is the earliest date. Please let me know if either of these dates work for you and I
will schedule the site visit.
At the conclusion of this comment period, a copy of all comments will be provided to Water & Land Solutions,
LLC and the NCIRT along with District Engineer's intent to approve or disapprove this Final As -Built and as -built
implementation credit release.

Dear Ms. Dailey:
Water & Land Solutions (WLS) respectfully requests the second credit release on the Scarborough
Mitigation Project for 15% of the total stream and wetland credits, and a Modification Request of assets.
The second credit release amount would be 1,623.45 stream credits and 16.34 riparian wetland credits.
These amounts account for 1) adjusting the stream assets due to an amended conservation easement to
remove a utility easement from the conservation easement boundary (UT1-R2), and 2) adjusting the
wetland assets due to a berm that was constructed wider than the design plans. The berm near the
property boundary on the eastern side of the project was constructed wider than in the design plans,
which was a field change designated by the engineer. The berm footprint has been removed from the
creditable wetland area. This wetland area was 6.3 acres in the mitigation plan and the as -built acreage is
5.6 acres.
The total amended stream credits for the site are 10,863 stream credits and 109.67 riparian wetland
credits. The second release based on the revised total would be 1,629.45 stream credits and 16.45 riparian
wetland credits. WLS received a credit release of 1,635.45 stream credits and 16.56 riparian wetland
credits for the first release, which is 6.0 stream credits and 0.11 wetland credits over the modified total
and has been deducted from this second credit release amount. The tables below show the mitigation
plan credits vs. as -built credits, and the calculations for the second credit release.

Also included in this letter is the revised bank credit release schedule per the USACE-Wilmington template
and the most current WLS stream and wetland credit ledgers. Per the USACE's request, WLS is also
including an exhibit that shows the amended conservation easement boundary. This is the same boundary
as used in the as -built report and record drawings.
The following items have been completed regarding completion of Task 2: site earthwork, site planting,
installation of monitoring devices, As -Built Baseline (MYO) Report and Drawings, and the monitoring
financial assurance (casualty insurance policy) is active. There were no deviations to the design plans that
would affect credits as noted in the as -built report, except the reduction in wetland credits due to the
berm. The easement amendment decreased overall stream credits by 40 credits and the berm decreased
wetland credits by 0.70 credits as compared to the Mitigation Plan credits (10,903 stream credits and
110.37 wetland credits).
