The contractor completed all of the work in jurisdictional areas, but had continued to do some work on the project. The USACE is considering this work independent of the existing 404 and 404 permit. So I have this as a non-reporting NWP 13 and of which qualifies as a non-written 401 per GC4134 less than 150’ temp/perm impacts; not HQWs, trout etc. Any new impacts with this work? I have that B-5152 was completed on Sept 30, 2020 per signed certificate of completion. Is this new work then separate from B-5152, and as such essentially a new non-reporting project? Amy: As we discussed by phone today, I couldn’t figure out how to call this a Nationwide Permit (NWP) 3, so I am verifying it under an NWP 13. On 3/9/21, the US Army Corps of Engineers, Wilmington District received your e-mail notification that you intend to remove a collapsed pipe, and stabilize the banks at a 2:1 slope with coir fiber matting, associated with TIP B-5152, SR 1100, Lasater Road, Bridge Replacement project in Forsyth County, NC, which was verified for authorization under NWPs 13, 33, and 23 on 11/9/17. Based on the information provided in your application, your work is authorized by NWP 13 Bank Stabilization, and does not require a pre-construction notification (PCN) provided it is accomplished in strict accordance with the attached conditions and your submitted description. Any violation of the attached conditions or deviation from your submitted description may subject the permittee to a stop work order, a restoration order and/or appropriate legal action. Attached are copies of the NWP 13, and the applicable permit conditions. If the nationwide permit authorization expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit, will remain authorized provided the activity is completed within twelve months of the date of the nationwide permit’s expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend or revoke the authorization. This response to your notification does not relieve the permittee of the responsibility to obtain any other required Federal, State or local approvals/permits. The pipe carried the old Lasater Road alignment and is no longer needed. We plan to remove the pipe, and stabilize the banks at a 2:1 slope with coir fiber matting. For reference, I have linked the approved permits here. I have also attached a plan sheet showing the location of the pipe. We believe this can occur under a non-reporting NW 3 with no new permanent impacts. Let me know if you have any questions or concerns.
