The Wooten Company 350 North Cox Street, Suite 26 Asheboro, NC 27203 Dear Mr. Grey: On April 11, 2007, the North Carolina Division of Water Quality (DWQ) received the City of Winston- Salem's application fora 401 General Water Quality Certification to impact 320 linear feet of stream and 0.241 acre of wetland in Forsyth County. These impacts are proposed in order to install 7,750 linear feet of gravity sewer outfall to serve Annexation Area C. Based on the information provided in the application prepared by you, additional information is required in order that we may determine the project's compliance with 15A NCAC 2H .0500. Please provide five (5) copies of the following information: 1. Please provide the name of a contact individual for the City of Winston-Salem. This person should be the individual responsible for, or having oversight of, this project. Please provide this information in Section II., Applicant Information, on Page 5 of the Pre-Construction Notification (PCN). 2. The nature and scope of the proposed impacts are not clear from the information provided in the PCN. In Section VI., Proposed Impacts to Waters of the United States/Waters of the State, please individually list all wetland impacts using the table in Section VI., Item 2., Page 8. On page 9 of the PCN, please individually list all impacts to intermittent and perennial streams using the table in Section VI., Item 4. 3. If the U. S. Army Corps of Engineers has determined that the wetlands to be impacted meet the criteria for classification as Isolated Wetlands, then please indicate that the City of Winston- Salem is applying for an Isolated Wetland Permit from DWQ as well as a Section 404 Permit and a Section 401 Water Quality Certification. This information should be shown by marking the appropriate boxes under Section I., Processing, Item 1. (Check all the approvals requested for this project.) on Page 5 of the PCN. In Section VII., Impact Justification (Avoidance and 1l~Iinimization) on Page 10, please provide more specific and detailed information about the efforts made to avoid and/or minimize impacts to the streams and wetlands on the project site. 5. In Section XN., Cumulative Impacts on Page 13, please provide more specific and detailed information concerning the current state of development within the project area. Specifically, please discuss the current zoning and land use of parcels which will be served by this sewer line, and note in particular the presence and size of any undeveloped parcels which could be served by the installation of additional collector lines. Until the information requested in this letter is provided, I will request (by copy of this letter) that the U.S. Army Corps of Engineers place this project on hold. Also, this project will be placed on hold for DWQ processing due to incomplete information (15A NCAC 2H .0507(h)). The processing of this application will begin when the requested information is received. Please be advised that if your proposed activity is subject to Section 404 of the Clean Water Act (33 U.S.C. 1344), you must also receive a Section 401 Water Quality Certification from the N. C. Division of Water Quality before you begin any work. Please send the requested information to Mr. Ian McMillan, N. C.
