Director Division of Water Quality DWQ Project # 06-1965v2 Franklin County Subject Property: Linda Wellnitz -Lot 431 Lake Royale [030301, 28-31-(1), B, NSW] REQUEST FOR MORE INFORMATION Dear Mr. & Mrs. Wellnitz: On May 9, 2007, the Division of Water Quality (DWQ) received your application dated May 8, 2007, to impact an unknown square footage of Zone 1Tar-Pamlico River basin protected riparian buffers for the purpose of constructing a seawall at the subject property. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetland, streams and/or buffers on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 1 SA NCAC 2H .0506 and 2B .0259(8) and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Impact Amount Please indicate the square footage of protected riparian buffer impacts and any acreage of open water (lake) impacts that will occur with the construction of your seawall. 2. Impact Avoidance/Minimization Please have Mike Horan of the Raleigh Regional :Office verify whether or not there is an erosion problem at your site. Please respond within three weeks of the date of this letter by sending this information to me in writing and Mike Horan of the DWQ Raleigh Regional Office. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers.
