On July 2, 2012 your application was received for the subject project. Prior to that date, on June 13, 2012, staff
met at the site with your representatives to discuss the project. Based on the review of the application and discussions at
the site the following needs to be addressed:
1) The request to cross the stream channel is not required for the purpose of the construction of more homes
within the subdivision. Thus the stream crossing doesn't meet the issue of avoidance and minimization.
2) The plan indicates that the road stub is only crossing the stream and being stubbed on the northeast side of
the creek. There is no indication that it will be connected Bailey Road. The raises a question of the purpose
and need for the stream crossing.
3) If this is a town requirement, it may be prudent for the City of Cornelius to apply for the stream crossing, given
that currently you have no ownership of the tract of land on the northeast side of the stream.
Until further clarification and information, please be advised that this project will be placed on hold pursuant to
15A NCAC 2H .0507(h). In addition, this office is requesting that the Army Corps of Engineers place a hold on processing
the application.
