(DN1R) submitted by Stanly County for the month of April 2017, This review has shown the subject facility to be in. violation of the discharge limitations ancFor monitoring requirements found in NPDES WW Permit No, NC00435.32, The violations, which occurred in April 201.7, are summarized in Attachment A to this letter. Based upon the above facts., 1 conclude as a matter of law that Stanly County violated, the terms, conditions or .requirements ofNPDES WW Permit No. NC0043532 and G.S. 1.43-215„.1(a)(6) in the manner and extent shown in Attachment A. (5) 'the amount of money saved by noncompliance: (6) Whether the violation was committed willftilly or intentionally; (7) The prior record of the .violator in complying or failing to comply with programs over which the Environmental Management Commission has regulatory authority; and (8) The cost to the State of the enforcement procedures. Due to the file size, our daily logs for the month of April 2017 are attached to a separate email. All violations are a direct result of excessive' & 1 fforo the collection systems owned by the surrounding municipalities. As can be seen in the attached weekly flow charts and the daily logs that are attached to an additional email, whenever we receive a significant rain, plant effluent flow increases dramatically. For 3 days, from April 4th to the 6th, we received a total of 1,85" of rain. The flow total for the same time period was 2.421.4 MG. Also, as seen in the .flow chart for the week of 04-03-1.7, the flow is not consistent which causes the 'biological cycle within the plant to he disrupted. It must be noted that a single high flow event does not ordinarily cause the plant to be in violation of our permit. However, we had an additional, even more substantial rain event from the 23rd to the 25th. During this 3 day period, we had 3,4" of rain with a flow total of 4.1632 MG. b, Please note in the attached ORC Journal for April 2017 that Roberto Schiller of DENR - Mooresville was contacted on the 25th and the 26th to report our extreme flow conditions and to notify' him that we would probably be in violation of our permit for the month of April. We discussed plant operation and he understood that we were doing everything possible to stay within permit limits. 16 As is well known in the Mooresville office. West Stanly WWTP was not in good condition when it was purchased by Stanly County from the "Town of Oakhoro. As is also well known in the Mooresville office, we have been working hard to improve the quality of the effluent as well as plant operability and resilience during extreme conditions. However, there is a limit to what we can achieve when flow often exceeds 5 times our average daily flow simply due to a local rain event.
