This review has shown the subject facility to be in violation of the discharge limitations and/or monitoring requirements found in NPDES WW Permit No. NC0020737. The violations, which occurred in. August 201.9, are summarized in Attachment A to this letter. Based upon the above facts, I conclude as a matter of law that City of Kings Mountain violated the terms, conditions or requirements of NPDES WW Permit No, NC0020737 and G.S. 143-215.1(a)(6) in the manner and extent shown in Attachment A. In accordance with the maximums established by G.S. 143-215.6A(a)(2), a civil penalty may be assessed against any person who violates the terms, conditions or requirements of a permit required by G.S. 143-215.1(a). Daily max exceeclances was found on 8/8/2019 and 8/15/2019, with the monthly average exceeded also, We believe a few different events caused the exceeclance, Listed below are the findings of the investigation: Midge flies have become anissue atPilot Creek, the plant iscurrently treating for this infestation. Midge flies consume sludge inthe aeration basins causing amextremely low MLSS. Cormetech was discharging arsenic higher than normal. The City isinthe process of addressing the power issue we have currently in order to allow more power at the plant tooperate mixers inthe aeration basins. F/K4 data from the beginning of August to date has decreased significantly. The Historical City The following corrective actions have taken place to address the non -co POTW is treating the ride fly issue with "Aquabac and Ru juice" from Aquafi , Inc:. The pretreatment department is completing weekly sampling at Cormetech to determine the amounts of arsenic (and all other parameters) that are discharged from the facility, The PTW is working with the electric department and Duke Energy to address the power coming into the plant, Quotes have been received on the mixers: Adjustments have been made in hopes of increasing the F/M at the plant.
