HomeMy WebLinkAbout20210340 Ver 1_USACE Permit_20210303DEPARTMENT OF THE ARMY WILMINGTON DISTRICT, CORPS OF ENGINEERS 69 DARLINGTON AVENUE WILMINGTON, NORTH CAROLINA 28403-1343 March 3, 2021 Regulatory Division Action ID No. SAW-2021-00287, General Permit No. 197800056 Mr. Tommy Herring 41 Maple Leaf Lane Newton Grove, North Carolina 28366 Therring@hogslat.com Dear Mr. Herring: Through coordination with the North Carolina Division of Coastal Management we have learned of your request to expand an existing docking facility located at 409 Evelyn Avenue, along Banks Channel and Topsail Sound in Topsail, Pender County, North Carolina. On January 1, 2017, we renewed general permit No. 197800056, (copy enclosed), that authorizes the maintenance, repair, construction and installation of piers, docks, boathouses and boat shelters, mooring piles, dolphins, jetties and breakwater structures in navigable waters of the United States in the State of North Carolina pursuant to Section 10 of the Rivers and Harbors Act of 1899. Your work is authorized provided it is accomplished in strict accordance with your submitted plans, the enclosed general conditions, and the following special conditions: 1. All work authorized by this permit must be performed in strict compliance with the submitted plans received by DCM Wilmington on February 3, 2021, which are a part of this permit. 2. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish and Wildlife Service’s Manatee Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at https://www.fws.gov/raleigh/pdfs/ManateeGuidelines2017.pdf. If any change in your work is required because of unforeseen or altered conditions or for any other reason, plans revised to show the change must be sent promptly to this office and the North Carolina Division of Coastal Management prior to performing any such change or alteration. Such action is necessary as revised plans must be reviewed and the authorization modified.
