Describe the overall project in detail, including indirect impacts and the type of equipment to be used:* Phase V, Project VK Construction Area 32, Section 1, is located in the Wendover Place, Hickory Run, Pine Crest Park, Pine Ridge Acres area. The project includes construction of approximately 16,325 linear feet of gravity sanitary sewer collection lines and 12,485 linear feet of water lines. Some of the proposed sewers and water lines are anticipated to be within existing City of Fayetteville streets. However, approximately 14,235 linear feet of new permanent easement will be required. The total acreage disturbed by the project will be 22.8 acres. An aerial sewer crossing in the vicinity of Westbranch Dr. is proposed that will result in 0.07 ac. of wetland impact within the permanent easement resulting from conversion of forested wetland to herbaceous wetland. Temporary clearing will occur within the temporary easement resulting in 0.04 ac. of temporary wetland impact. Typical land clearing and sewer construction equipment will be used. The total easement width will be 45' in order to be allow for construction of the concrete piers and pipe bridge across the UT to Little Rockfish Creek. 4j. If yes, explain Fayetteville Annexation Area 32 is comprised of five project construction areas: Area 32 Section I, Area 32 Section II, Area 32 Stewart's Creek Ouffall, Area 32 North, and Area 32 South. Area 32 Sections I and II are not dependent on Area 32 Stewart's Creek Ouffall due to topography and can be independently constructed and tied into PWC's existing sewer outfalls at different tie-in points. Area 32 Section I, which is the first construction project for Fayetteville Public Works Commission infrastructure improvement, is planned to begin construction in September 2021. Area 32 Section II will likely result in additional impacts to waters of the US (WOTUS), but design plans for this future project are not final and quantitative estimates of cumulative impacts are not possible at this time. However, during this project, all practicable measures to avoid and minimize additional impacts will be implemented into the design of the project. This construction project is planned to begin construction in February 2023. No trench will be dug within wetland WA or the LIT to Little Rockfish Creek. Land disturbance will be limited to excavation for the piers supporting the aerial crossing. Two piers supporting the crossing will total 28.1 sq ft of excavation. Loss of waters is limited to 0.07 ac, which is belowthe 0.1 acre wetland mitigation threshold. No stream impacts are proposed, as the piers have been situated to avoid the Uf to Little Rockfish Creek. Temporarily cleared areas will be left undisturbed and re -seeded following construction to allow them to return to pre -construction conditions (see erosion and sediment control notes in attached plan set). 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: Timber mats and bridges will be laid within the wetland areas to minimize ground and vegetation disturbance, and all applicable sediment and erosion control statutes will be followed to limit sedimentation to WOTUS. 2. Area 32 Sections I and II are not dependent on Area 32 Stewart’s Creek Outfall due to topography and can be independently constructed and tied into PWC’s existing sewer outfalls at different tie-in points. Area 32 Section I, which is the first construction project for Fayetteville Public Works Commission infrastructure improvement, is planned to begin construction in September 2021. Area 32 Section II will likely result in additional impacts to waters of the US (WOTUS), but design plans for this future project are not final and quantitative estimates of cumulative impacts are not possible at this time. Based on the information provided and other information available, it appears that the proposed action is not likely to adversely affect any federally -listed endangered or threatened species, their formally designated critical habitat, or species currently proposed for listing under the Act at these sites. We believe that the requirements of section 7(a)(2) of the Act have been satisfied for your project. Please remember that obligations under section 7 consultation must be reconsidered if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is subsequently modified in a manner that was not considered in this review; or, (3) a new species is listed or critical habitat determined that may be affected by the identified action. However, the Service is concerned about the potential impacts the proposed action might have on aquatic species. Aquatic resources are highly susceptible to sedimentation. Therefore, we recommend that all practicable measures be taken to avoid adverse impacts to aquatic species, including implementing directional boring methods and stringent sediment and erosion control measures. An erosion and sedimentation control plan should be submitted to and approved by the North Carolina Division of Land Resources, Land Quality Section prior to construction. Erosion and sedimentation controls should be installed and maintained between the construction site and any nearby down -gradient surface waters. In addition, we recommend maintaining natural, vegetated buffers on all streams and creeks adjacent to the project site. The North Carolina Wildlife Resources Commission has developed a Guidance Memorandum (a copy can be found on our website at (http://www.fws.gov/raleigh) to address and mitigate secondary and cumulative impacts to aquatic and terrestrial wildlife resources and water quality. 2 We recommend that you consider this document in the development of your projects and in completing an initiation package for consultation (if necessary).
