Dear Mr. Whitley:
A recent review of files pertaining to subject administrative
hearing has revealed that this division has no record of its conclusion.
By letter of March 6, 1979, Mr. A. F. McRorie, then Director, Division of
Environmental Management, transmitted to you an offer to amend the
compliance schedule in subject permit and to amend the effluent
limitations for BOD5 and ammonia. In this letter he requested that you
return to him a letter waiving the town's right to 60 days' notice of
amendment to the permit, and withdrawing the town's request for an
administrative hearing. A copy of the letter is attached for your
reference. The division has no record of an answer by you.
By this letter I am repeating the offer previously transmitted by Mr.
McRorie, and am again requesting that you send me a letter waiving the
town's right to notice, and withdrawing request for an administrative
hearing. Upon receipt of such a letter, I will give notice of the
modifications to the permit in the manner established for issuance of new
permits by rule 15 NCAC 2H .0109.
If I do not receive the requested information from you by April 30,
1980, I will proceed with plans to hold an administrative hearing. This
hearing will be held on June 24, 1980 in the Valdese area. You will be
given notice of the hour and location of the hearing. You are zeminded
that at the present time, the B0D monthly average effluent limitations
are 18 mg/I, and the ammonia mon'thly average effluent limitation is 8
mg/1.
