PROJECT SUMMARY: The applicant proposes to construct a new bulkhead waterward of an existing bulkhead and construct a new private docking facility into Futch Creek. Whelan and Jones Page 2 9. PROJECT DESCRIPTION: The project site is located at 1729 Futch Creek Road, adjacent to Futch Creek, in New Hanover County. To locate the property from the Wilmington Regional Office (WiRO) turn right onto Market Street (NC Highwayl7) and travel north approximately 5 miles and turn onto Porter's Neck-Road. Travel east approximately 1 mile until you reach a traffic circle while continuing to head east on Porter's Neck Road beyond the traffic circle a distance of approximately 1 mile until you reach a stop sign. At the stop sign, turn left onto Bald Eagle Lane and travel north approximately 1 mile until you reach Futch Creek Road. Turn left on Futch Creek Road and travel approximately 0.3 miles until you reach the property of interest, which will be located on the right. The lot is currently undeveloped and is approximately 0.6 acres and the elevation ranges from approximately 5' to 20' above normal high water (NH W). Upland vegetation consists of wild grasses and hardwood species, primarily oak trees. The property has approximately 115 linear feet of shoreline which is currently stabilized by a wooden bulkhead. Approximately 35 linear feet of the existing bulkhead, located on the western end of the property, runs perpendicular to the creek and is currently dilapidated. The application also states that this portion of the bulkhead is currently located beyond the property boundary. Approximately 25 linear feet of this bulkhead is bordered by Coastal Wetlands consisting primarily of Smooth Cordgrass (Spartina alterniora), which continues towards the west along the shorelines of the adjacent riparian properties. There is a also a narrow band of mixed Coastal Wetlands, § 404 type wetlands and upland vegetation which is waterward the existing bulkhead approximately 12' in width located on the eastern end of the property, which consists of sparse Smooth Cordgrass (Spartina alterniora) and Sea Oxeye (Borrichia frutescens). The property borders a small channel; measuring approximately 20' across which connects to Futch Creek. Located between this channel and the main stem of Futch Creek is a band of Coastal Wetlands consisting primarily of Smooth Cordgrass (Spartina altern iora), which measures approximately 70' in length by 25' in width. Waterward of this area of low marsh along Futch Creek are several areas of oyster reefs which are visible in the mud flat at low water. Based on site visits at this location, the water depth within this channel and towards Futch Creek is approximately -0.5' along the waterward edge of the marsh and approximately -2.0' within the channel at normal low water (NLW). There is currently no docking facility located at this property; however, the previous property owner obtained a CAMA General Permit No. 53941 on October 14, 2009 for a private docking facility. The proposed configuration of this docking facility essentially mirrored the existing docking facility that is located on the adjacent riparian property to the east that also borders this channel (See sheets 1 through 4 and CAMA permit and project narrative). The New Hanover County -City of Wilmington 2006 CAMA Land Use Plan Update classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. The waters of Futch Creek are classified SA by the Division of Water Quality. The area is designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to construct a new bulkhead waterward of an existing bulkhead and construct a new private docking facility into Futch Creek. The application states that 90 linear feet of bulkhead would be located no more than 2' waterward of the existing bulkhead that borders the channel. The new bulkhead would then return landward and follow the eastern property boundary to the adjacent existing bulkhead, measuring approximately 13 linear feet. This return would average approximately 3' waterward of existing bulkhead. The applicant states that the existing dilapidated bulkhead located on the western end of the property would be entirely removed and new timber bulkhead, measuring 44 linear feet would be installed along the property boundary. The applicant also proposes a new docking facility, which would essentially match what was authorized to the previous property owner. A new fixed access pier, measuring approximately 55' in length by 6' in width would extend from the new bulkhead towards Futch Creek, and would span over the deep water of the channel approximately 12' in width and elevated 6' above NHW to provide for small boat navigation during all tides. Whelan and Jones Page 3 The pier would then terminate to a new covered platform, measuring approximately 16' in length by 16' in width, oriented on the western side of the access pier creating an "L- shaped" configuration which would be located entirely over open water. Waterward of the platform towards the west and the mouth of the channel an access ramp would then lead onto a new floating dock, measuring 30' in length by 6' in width, which would run parallel to the edge of deep water of the channel. A boatlift, measuring 13' in length by 14' in width would be located on the northern end of the proposed floating dock. The application states that the proposed docking facility would be located in water depths of approximately -2' to -3'@ NLW. The application also states that the new configuration would accommodate up to four (4) vessels (See sheets 1 and 2 of 4 and project narrative). 10. ANTICIPATED EMPACTS: The proposed new timber bulkhead along the eastern property boundary would result in the filling of a total of approximately 15 sq. ft. of mixed Coastal Wetlands and § 404 type wetlands, which consists of primarily of sparse Smooth Cordgrass (Spartina alterniora) and Sea Oxeye (Borrichia frutescens). The proposed bulkhead which borders the channel would also incorporate approximately 180 sq. ft. of shallow bottom. Once the existing dilapidated bulkhead located on the western end of the property is removed, the new bulkhead would be installed along the highground portion of the property boundary and would, potentially create 40 sq. ft. of low marsh within the area of substrate along the NHW boundary. The application states that this would result in a 25 sq. ft. increase of Coastal Wetlands on -site. Approximately 2,600 sq. ft. of Estuarine Shoreline would be impacted for the associated backfill and tie -back anchor system of the new bulkhead. As proposed, the project would result in the shading of approximately 144 sq. ft. of Coastal Wetlands. The access pier, covered platform, floating dock and boatlift would incorporate approximately 768 sq. ft. of Public Trust Area and Estuarine Waters. The proposed structures would be located within the applicant's riparian access area and would not encroach-into the 15' riparian corridor setback requirements. The proposed access pier would span over the deep water of the channel approximately 12' in width and elevated 6' above NHW to provide for small boat navigation during all tides. The proposed structures would extend approximately 30' into a waterbody, which measures approximately 550' in width across. As proposed the structures would not exceed the' /4 width limitation. Further, based on the provided drawings and historical aerial photography, the proposed structures would not encroach into the established channel of Futch Creek. Submitted by: Robb L.
