Dear Ms Higgins
This response for the above referenced project is in regard to a Request for Additional Information Letter from
your office dated July 31 2012 The following are my comment responses according to Mr Danny Smith s
original numbered comments
We are hereby submitting to you our current site plan as coordinated with NC Division of Land
Resources which now phases' our construction of the gravel drive in Zone 2 of the buffer We
currently are only proposing to grade and re vegetate in Zone 2 of the buffer which is an exempt'
activity in accordance with 15A NCAC 2B 0233 The gravel drive is now shown on our plan as a future
phase which will require new /modified approvals for erosion control and buffer impacts (including
purchase of mitigation credit if required) from NC Division of Land Resources and your office
However our plan as it currently stands is considered exempt from buffer requirements and mitigation
is not required
We understand that our plan is likely not considered a low- density project by the state and as you
stated the project therefore must meet or provide certain controls for TSS or other pollutants The
Town of Benson is an NPDES Phase 2 Community and is required to adhere to the same post
construction requirements for stormwater Furthermore the Town of Benson has a Memorandum of
Understanding with Johnston County whereby Johnston County reviews and approves these Phase 2
post - construction requirements for stormwater A stormwater plan has indeed been prepared that
removes at least 85% TSS by using a permanent wet pond on the site and this stormwater plan has
been reviewed and approved by Johnston County on behalf of the Town of Benson We are providing
to you a copy of the stormwater approval obtained through the County for the Town of Benson We
trust that our stormwater plan as approved verifies the TSS requirements and other Phase 2
requirements for post - construction
