On July 20, 2012, the Division of Water Quality (DWQ) received your Variance Request
application form. Your application appears to be for impacts to 602 linear feet of stream,
by placement of drainage tiles, and removal of 602 linear feet of riparian buffer as a
result of the placement. Please be advised that you have submitted the incorrect
application form. It is necessary to fill out a Pre Construction Notification (PCN) form
(see enclosed) and give description of proposed project, amount of stream impacts, buffer
impacts, and provide documentation of mitigation for proposed impacts. The PCN form
can also be found online at the DWQ web site with detailed instructions on how to
complete application. Please note also that impacts equal to or greater than 150 linear
feet of stream impacts changes your application to a Major 401 certification requiring a
higher application fee. Further instructions may be found on the DWQ web site by going
