Chapter 143, Article 21 of the North Carolina General Statutes (NCGS) authorizes and directs the
Environmental Management Commission of the Department of Environment and Natural Resources
(NCDENR) to protect and preserve the water resources of the State. The Division of Water Quality (DWQ)
has the delegated authority to enforce adopted pollution control rules and regulations.
On October 29, 2012, Lon Snider with NCDENR-DWQ observed raw sewage being released from a
private pump station located at 4318 Waxhaw Marvin Road. This private pump station pumps across the
road intathe collection system serving the Prescott subdivision. The unpermitted discharge from the pump
station is entering a storm drain that leads to Twelve Mile Creek. This sewer extension and pump station
was constructed under DWQ permit No. WQ0029161 that was issued on August 18, 2005, to Prescott
Development, LLC. Current tax records indicate that Butterfield Land Company is the owner of the subject
property.
Be advised that pursuant to NCGS 143-215.1(a)(1), No person shall make any outlets onto land and,
into waters of the State unless that person has received a permit from the Department and has complied
with all conditions set forth in the permit. Be advised that NCGS 143-215.6A provides for a civil penalty
assessment of not more than twenty-five thousand dollars ($25,000.00), or twenty-five thousand dollars
($25,000.00) per day when the violation is of a continuing nature, against any person who is required but
fails to apply for or to secure a permit required by NCGS 143-215.1. Penalties may also be assessed for any
damage to land and/or surface waters of the State that may result from the unpermitted discharge.

Dear Mr. Davis:
The Division respectfully requests the status of the final engineering certifications for the subject permits.
Both permits are currently in house for a change of ownership and we would like to have the
certifications prior to re -issuing the permit to the new owners. As you are aware, there has been a
compliance issue with WQ0019493 being put into operation prior to a certification being received as
the project was not completed. Our Mooresville Regional Office has been communicating with your
office to get this project completed and the final certification submitted since early September.
If the projects are completed, please submit a final engineering certification with supporting
documentation as requested in the certification form to my attention at the letterhead address. Note
that a plan and profile view of the lines is required. Additionally, these permits had a special condition
regarding the labeling of the force mains with the responsible party. Verify that this condition was met in
your certifications. Use the form provided on the back of each permit. Using this form for certifications
.provides us the information necessary to process the certification in a timely manner as well as having
the approved certification language_ Please keep this in mind for all your sewer extension certifications
as the Division may return them as incomplete if our form is not present.
Note that the Division has recently reorganized. All sewer related matters are now handled through the
Pretreatment, Emorgoncy Rospon..o Sysfert= Uri+ under the. Point tnurren Rrnne-h FXC:FPT
FOR FAST -TRACK SEWER PERMITTING WHICH CONTINUES TO BE ADMINISTERED THROUGH OUR REGIONAL
OFFICES. The Unit is located on the 13th floor of the Archdale building in downtown Raleigh. Please
ensure the letterhead information is used for all correspondence to ensure timely delivery.

Attached is the letter we discussed by telephone on December 21, 2004. We cannot
issue the change of ownership permits until the referenced certifications are received.
These permit applications were submitted in September 2004 and we are unduly past
due in processing these requests due to this issue. Since the sewers are connected,
and you were the contracted engineer, it is your responsibility to submit a completed
engineering certification prior to operation. There is at least one of these in operation
now and therefore the permit condition and 15A NCAC 2H .0220 relating to certification
of completion has been violated. if there is some reason why these certifications
cannot be submitted to my attention at the letterhead address by February 28, 2005,
please advise.

Chapter 143, Article 21 of the North Carolina General Statutes (G.S.) authorizes and
directs the Environmental Management Commission of the Department of Environment &
Natural Resources to protect and preserve the water resources of the State. The Division of
Water Quality (DWQ) has the delegated authority to enforce adopted pollution control rules and
regulations.
On February 15, 2008, Mr. Jeff Knight of the Union County Environmental Health
Department conducted an investigation of the property located at 3002 Moonstone Lane. As a
result of this investigation, the following condition was found on the property in violation of G.S.
143-215.1(a):
Discharge of domestic wastewater (sewage) to the ground surface.
Be advised that pursuant to NCGS 143-215.1(a)(1), No person shall make any outlet onto
land and into the waters of the State unless that person has received a permit from the Department.
Be advised that NCGS 143-215.6A provides for a civil penalty assessment of not more than twenty-
five thousand dollars ($25,000), or twenty-five thousand dollars ($25,000) per day when the
violation is of a continuing nature, against any person who is required but fails to apply for or to
secure a permit required by G.S. 143-215.1. Penalties may also be assessed for any damage to the
surface waters of the State that may result from the unpermitted discharge You will he advised of
any enforcement recommendation

On October 30,2007, an inspection of your property by the Union County Health Department indicated the following
violations:

15A NCAC 18A.1961 (e) — A contract shall be executed between the system owner and a management entity prior to the
issuance of an Operation Permit for a systemrequired to be maintained by a public or private management entity, unless the
system owner and certified operator are the same. The contract shall include the specific requirements for maintenance and
operation, use, and other requirements for the continued proper perfonnance of the system. It. shall also be a condition of the
Operation Permit that subsequent owners of the system execute such a contract.
15A NCAC 18A. 1961 (a)-(1) Ground absorption sewage treatment and disposal systems shall be operated and maintained to
prevent the following conditions: (A) a discharge of sewage or effluent to the surface of the ground, the surface waters, or
directly into the groundwater at any time.
You are hereby ordered to bring your wastewater system into compliance by completing the following:
X Immediately cease the discharge of sewage effluent to the ground surface.
X Eliminate wastewater discharge and connect to an
Approved wastewater system.
If the wastewater violation is not brought into compliance by November 7, 2007 , appropriate legal action will be taken.
Failure to comply with the laws, rules and this notice will subject you to the following legal remedies; Injunction Relief [G.S.
130A-18], Administrative Penalties [G.S. 130-22(c)], Suspension or Revocation of Permits [G.S. 130-23], and Criminal
Penalties [G.S. 130-25].

Enclosed please find a copy of a Complaint Investigation Report for the investigation
conducted on June 21, 2007, by Union County Health Department. As a result of this investigation,
the following condition was found on the property in violation of North Carolina General Statute

A discharge of sewage was occurring from your property due to a failure of the
sewage grinder pump for this house. The sewage was discharging into a storm drain
that flows to Rays Fork in the Yadkin Pee- Dee River Basin.
Be advised that pursuant to NCGS 143-215.1(a)(1), No person shall make any outlets onto
land and into waters of the State unless that person has received a permit from the Department and
has complied with all conditions set forth in the permit. Be advised that NCGS 143-215.6A
