Dear Mr. Swope:
On April.26, 2001, Mr. D Will Autry of the Mecklenburg County Department of
Environmental Protection (MCDEP) conducted an inspection of the subject collection system.
This inspection was conducted as part of a cooperative working agreement between Mecklenburg
County and the Division of Water Quality. The attached report should be self-explanatory.
Also, attached is an excerpt from the regulation applicable to collection system permitting
and a copy of the relevant permit shell. Please review these two documents closely. Presently
the subject system is deemedpermitted pursuant to 15A NCAC 2H.0227(d); however, in
accordance with 15A NCAC 2H.0227(e), if inadequate operation and maintenance (O&M) of the
system is documented or there is a failure to implement an adequate O&M management program,
then the Division may issue an individual permit.
The Spinnaker Reach Owners Association needs to correct the deficiencies noted in the
Inspection Summary and Additional Comments sections of the attached report. It is requested
that you respond to this matter in writing by no later than June 11, 2001, indicating actions
taken to correct the deficiencies. Please address your response to Mr. Don Price. In addition,
please send a copy of your response to Mr. Rusty Rozzelle, Mecklenburg County Department of
Environmental Protection, 700 N. Tryon St., Suite 205, Charlotte, NC 28202.
