Thank you for the audit report and the summary email.
I concur that these sites have been visited and that the impact activities are in compliance with the DOT’s Water Quality
Certification for these pipeline sites, and that conditions were met.
I agree that at this point, DOT can consider these sites done and closeout active inspections on them. It is with our
understanding that any changes to these sites from what the attached Audit report shows would be by the Landowner
and are not the responsibility of NCDOT.
Following concurrence from USCOE, you may consider these sites “closed out” from the certification reviews and
inspections.
Thank you for your efforts in water quality compliance for this project and keeping agencies informed and involved.

Good afternoon Eric and Rob –

As you recall, part of the Complete 540 project included the relocation of portions of a Colonial Liquid Petroleum
pipeline. The impacts associated with this relocation were included in the permit requests and subsequent
authorizations by both the USACE and DWR. As you are also aware, the Colonial Pipeline exists within an easement
where property ownership is still retained by the property owner and not NCTA or NCDOT. As such, now that the
pipeline has been relocated and construction activities are completed, the contractors for Colonial are in the process of
finalizing the site(s) and leaving the project. This in turns means that the construction corridor will no longer be
maintained by the construction crews and will revert back to the property owners. It is our intent to demonstrate
through the attached report that all the permit conditions and requirements have been met, the pipeline has been
relocated in compliance with those conditions and the permit sites are stable. You’ve both visited this portion of the
project at different times during construction and post construction compliance. All of the timber mat crossings have
been removed, stream banks and the surrounding riparian area have been seeded with appropriate seed mixes and
covered/secured with coir fiber matting, streambank stabilization has been keyed in where approved and all the
permitted rock fords have been installed. As you can see in the report, a few of the fords have already naturalized and it
is difficult to see any rip rap in the channel bottom itself.
After reviewing this report, and knowing that the contractor will be leaving the area, the Department would like your
“approval” regarding the completion of these permit sites. We understand that typically a certificate of completion is
sent in to your offices once the entire project is completed, however, that will be at least another 2-3 years from
now. We cannot guarantee the actions of the property owners and we do not wish to be held responsible for anything
they choose to do (or not do) in these permit areas over the course of the next few years while the rest of the project
continues on. Additionally, compliance inspections will all but be impossible as Department staff will in effect be
trespassing on private property.
Please let me know if you have any questions or concerns and your thoughts on closing this section of the project out.

Permit Site U2 (STA 106+00 Lt/Rt): The pipeline has been relocated, most of the inactive line was removed
except for a portion of the inactive line left below the stream channel which was flowable filled,the permanent
ford and stream bank stabilization were installed, the temporary timber mat crossing was removed and the
disturbed area matted.

Permit Site U3: There were no jurisdictional impacts at this site, even though there was a small amount of
buffer impact authorized at the pond across the road; the pond closest to the work area was protected during the
installation. The pipe line has been relocated and the area stabilized.

Permit Site U7 (Panther Branch): Prior to Colonial construction activities, the property owner cleared and
grubbed the area. The channel at this location was heavily impacted by those actions. The pipeline has been
relocated, the permanent ford and stream bank stabilization were installed, the temporary timber mat crossing
was removed and the disturbed area matted.

temporary impact area seeded and matted.
Permit Site U9: The pipeline has been directionally drilled in this permit location and the final connection to
the existing active line has been completed. The stream and wetland area complex are stable and intact. The
wattles previously placed across the stream channel have been removed. USACE and DWR representatives
visited the site in January to confirm that the area was stable and completed satisfactorily.
