Development in an Area of Environmental Concern pursuant to NCGS 113A 118 Excavation and/or filling pursuant to NCGS 113 229 Permit Number 49 -00 Issued to Roger Ingram, Ron Brown & John Fountain, 178 Big Hammock Point Rd , Sneads Ferry, NC 28460 authorizing development in Onslow County at adl New River Lots 11 & 13 Bluff St., Jacksonville as requested in the permittee s application dated 1/6/00 including attached workplan drawings (3) 2 dated 1/6/00 and 1 dated 11/1/99 This permit issued on -3 "Ia1 42 =,V is subject to compliance with the application (where consistent with the permit) all applicable regulations special conditions and notes set forth below Any violation of these terns may be subject to a fine impnsonment or civil action or may cause the permit to be null and void Shoreline Stabilization 1) The alignment of the proposed bulkhead has been staked by a representative of the Division of Coastal Management Failure to nutiate construction within 12 months or erosion of the shoreline by adverse weather conditions will require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction 2) The bulkhead must be constructed prior to any backfilling activities 3) The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the structure (See attached sheets for Additional Conditions) This permit_action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date An appeal requires resolution prior to work initiation or continuance as the case may be This permit must be accessible on site to Department personnel when the project is inspected for compliance Any maintenance work or project modification not covered hereunder requires further Departmental approval All work must cease when the enmit expires on December 31.20 In issuing this permit, the State of North Carolina agrees that your project is consistent constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel No excavation is permitted except for that which may be required for the construction of the bulkhead wall nprap deadmen cables etc Tlus permit does not authorize any excavation waterward of the approved alignment 5) All backfill material will be obtained from a highground source and confined behind the permitte bulkhead 6) The back fill material will be clean and free of any pollutants except in trace quantities 7) The temporary placement or double handling of excavated or fill material within waters or vegetated wetlands is not authorized Doclung Facility 8) This permit authorizes only the docks piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application No other structure whether floating or stationary may become a permanent part of this docking facility without permit modification No non -water dependent uses of structures may be conducted on in or over public trust waters without permit modification 9) No sewage whether treated or untreated shall be discharged at any time from any boats using the docking facility Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible This prohibition shall be applied and enforced throughout the entire existence of the permitted structure 10) The pier and associated structures shall have a munmum setback distance of 15 feet between any parts of the structure and the adjacent property owner s riparian access corridor which is determined by drawing a line parallel to the channel then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water s edge 11) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work 12) The authorized structure and associated activity must not cause an unacceptable interference with navigation Ingram, Brown & Fountain ADDITIONAL CONDITIONS Permit #49 -00 Page 3 of 3 13) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party Sedimentation and Erosion Control 14) Sedimentation and erosion control measures must be implemented to ensure that eroded materials do not enter adjacent wetlands or waters 15) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion General 16) No excavated or fill material will be placed at any time in any vegetated wetlands or open waters outside of the alignment indicated on the workplan drawmg(s) NOTE This permit does not eliminate the need to obtain any additional permits, approvals or authorizations that may be required NOTE Future development of the permittee s property may require a modification of this permit Contact a representative of the Division at (252) 808 -2808 prior to the commencement of any such activity for this determination NOTE The permittee and/or his contractor is urged to meet with a representative of the Division prior to project initiation NOTE The N C Division of Water quality has authorized the proposed project under General Water Quality Certification No 3112 (DWQ Project No 000245) wluch was issued on 2/23/00 NOTE The U S Army Corps of Engineers has authorized the proposed project under General Permit No 197800056 (COE Action Id No 200000918) and Nationwide Permit No 18 (COE Action Id No 200000917) both issued on 3/20/00
