Dear Mr. Lucas:
1. Mr. Tony Parker of the Mooresville Regional Office of the NC Division of Water
Resources (DWR or the Division) conducted a compliance evaluation inspection (CEI) of
the subject wastewater collection system (WWCS) on February 25, 2020. The assistance
provided during the inspection by Mr. Scott Lowder and Mr. Michael Burris was greatly
appreciated. A copy of the inspection report is attached for your records and inspection
findings are summarized below.
Site/System Review
2. The following system components were inspected:
a. Various manholes were inspected. No issues observed.
b. One pump station was inspected. No issues observed.
c. One R/W outfall was inspected. No issues observed.
3. As you are aware, owners of peiiuitted collection systems must comply with their permit
and all rules listed under NC Administrative Code 15A NCAC 02T .0400, et seq. The
system status is outlined below:
a. 15A NCAC 02T .0403(a)(1): Requires that the system be effectively maintained
and operated at all times to prevent discharge to land or surface waters and any
contravention of ground or surface water standards.
Observations: The system has had no reportable spills for the review period.
Compliance Status: Compliant
b. 15A NCAC 02T .0403(a)(2): Requires that a map of the wastewater collection
system be developed and actively maintained.
Observations: A detailed map was available.
Compliance Status: Compliant
c. 15A NCAC 02T .0403(a)(5): Requires that the peiniittee or its representative
inspect high -priority sewers (HPS - as defined in 15A NCAC 02T .0402(2)) at least
once every six months and document the inspections.
Observations: The system has 3 High Priority lines or aerial crossing. These are
inspected and documented.
Compliance Status: Compliant
d. 15A NCAC 02T .0403(a)(6): Requires that the permittee or its representative
conduct a general observation of the entire wastewater collection system at least
once per year.
Observations: The collection system R/W is viewed/mowed and documented as
required.
Compliance Status: Compliant.
e. 15A NCAC 02T .0403(a)(7): Requires that overflows and bypasses from the
system be reported to the Division's Mooresville Regional Office in accordance
with 15A NCAC 02B .0506(a), and that public notice must be provided as required
by G.S. 143-215.1C.
Observations: The system had no reportable spills for the review period. The NC
regulations and statutes, which cover the reporting requirements for SSOs, are
found in NC Administrative Code 15A NCAC 02B .0506(a) and NC General
Statute 143 -215.1 C, respectively. You may access the NC regulations online at the
NC Office of Administrative Hearings (OAH) website at:

review them to ensure you are fully familiar with all requirements.
When reporting SSOs to DWQ, you must call the Mooresville Regional Office
(MRO) at 704-663-1699 during normal business hours. If outside normal business
hours, you must report the spill to the NC Division of Emergency Management at
1-800-858-0368. Please note that all reportable SSOs must be reported within 24
hours of the occurrence, or first knowledge, of the SSO. Please also note that voice
mail or faxed messages are not considered as the initial verbal report. You must
talk to and report the spill to a live person.
Compliance Status: Compliant
f. 15A NCAC 02T .0403(a)(8):. Requires that a grease control program be developed
and implemented as follows:
g.
1. For publicly owned collection systems, the Grease Control Program shall
include at least bi-annual distribution of grease education materials by the
owner or representative.
Observations: Educational information is mailed to all customers and is available
on line, posted at pay centers and available on the Utilities Annual Report.
15A NCAC 02T .0403(a)(10): Requires that documentation be kept for all
activities you undertake to comply with the requirements of 15A NCAC 02T .0403,
subparagraphs (a)(1) through (a)(9), for a minimum of three years, with the
exception of the map, which shall be maintained for the life of the system. Also any
new additions, subdivisions or phased development needs to be incorporated as
well.
Observations: Records and a system map were available.
Compliance Status: Compliant

Stanly wastewater collection system (WWCS) on March 7, 2017. The assistance of Mr.
Clinton Hinson during the inspection was greatly appreciated. A copy of the inspection

copies at the office. This system serves to carry flow from Pfeiffer College and Richfield and

Comment: The generator was cranked and worked properly. The inspection log showed that it had been
run under load on 3/2/17. The high water float was pulled, and the audio and visual alarms
functioned properly. The telemetry call could be heard at the pump station, but the call wasn't
received over the phone. The operator reset the Verizon modem and the call was received. He
said they would start resetting the modem during their inspections. This will need to be resolved,
if the problem occurs again.

A review has been conducted of the self -reported Sanitary Sewer Overflows (SSO's) 5-Day Report/s submitted by
Stanly County. The Division's Mooresville Regional Office concludes that the Stanly County violated Permit
Condition I (2) of Permit No. WQCSD0419 by failing to effectively manage, maintain, and operate their collection
system so that there is no SSO (Sanitary Sewer Overflow) to the land or surface waters and the SSO constituted
making an outlet to waters of the State for purposes of G.S. 143-215.1(a)(1), for which a permit is required by
G.S. 143-215.1.
The Mooresville Regional Office is providing the Stanly County an opportunity to provide evidence and justification
as to why the Stanly County should not be assessed a civil penalty for the violation(s) that are summarized

to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed
against any person who violates or fails to act in accordance with the terms, conditions, or requirements. of any
permit issued pursuant to G.S. 143-215.1. --
This office requests that you respond to this Notice, in writing, within 10 business days of its
receipt. In your response, you should address the causes of non-compliance, remedial actions, and all other
actions taken to prevent the recurrence of similar situations. The response to this correspondence will be
considered in this process. Enforcement decisions will also be based on volume spilled, volume reaching surface
waters, duration and gravity, impacts to public health, fish kills or recreational area closures. Other factors
considered in determining the amount of the civil penalty are the violator's history of non-compliance, the cost of
rectifying the damage, whether the spill was int `ional and whether money was saved by non-compliance.

A review has been conducted of the North Stanly's self reported Sanitary Sewer
Overflows (SSOs) 5-Day Report(s) for May 2009. This review has shown North Stanly to be in
violation of the requirements found in Collection System Permit WQCSD0419 and/or G.S. 143-
215.1(a)(1). The violations that occurred during May 2009 are summarized in Attachment A.
Remedial and corrective actions, if not already implemented, should be taken to prevent
further SSOs. As of December 1, 2007, any reportable SSO may be issued a Notice of Violation
(NOV) and some may be assessed a civil penalty. Civil penalties will be issued for SSOs based
on volume, volume reaching surface waters, duration and gravity, impacts to public health, fish
kills, and recreational area closures. Other factors considered in determining the amount of the
civil penalty are the violator's history of spills, the cost of rectifying the damage, whether the
spill was intentional, and whether money was saved by non-compliance.

Be advised that G.S. 143-215.6A provides for a civil penalty assessment of not more than
twenty-five thousand dollars ($25,000), or twenty-five thousand dollars ($25,000) per day when the
violation is of a continuing nature, against any person who is required but fails to apply for or to
secure a permit required by G.S. 143-215.1. Penalties may also be assessed for any damage to the
surface waters of the State that may result from the unpermitted discharge.
The SSOs noted in Attachment A under violation action as "Proceed to NOV " are
overflows that the regional office has determined, after review of the CS-SSO 5-day report, that
may result in a civil penalty assessment. You have 15 days from receiving this Notice of
Violation letter to provide any additional justification for the identified SSOs as to why
these spills do not meet the criteria listed in this letter for civil penalty assessment.

Dear Mr. Krebs:
This letter is in response to the Notice of Violation letter issued June 17, 2009 for Collections System
Permit No. WQCSD0419. This sanitary sewer spill occurred as a result of the malfunction of an air
release valve on a pressurized collection system. An estimated 1500 gallons of wastewater was spilled
onto the ground near the roadside. None of the discharge from the collection system reached any surface
water. There was no damage to the surrounding area in the vicinity of the spill. A spill of this type has
not been documented in this collection system or any part of the Stanly County Utilities collection system
for more than seven years, which is my tenure with Stanly County Utilities. Given these circumstances
Stanly County Utilities request that no penalty be assessed as a result of this violation.
